HEARING CERTIFICATION DOCKET NO. 97-46 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1162 FOR A PUBLIC CHURCH WITH AN ASSOCIATED GRASS PLAYGROUND AREA AND BALLFIELD IN THE A (AGRICULTURAL) ZONE DISTRICT - IGLESIA MONTE CALVARIO SPANISH ASSEMBLIES OF GOD CHURCH A public hearing was conducted on October 8, 1997, at 10:00 a.m., with the following present: Commissioner George E. Baxter, Chair Commissioner Constance L. Harbert, Pro-Tem Commissioner Dale K. Hall - EXCUSED Commissioner Barbara J. Kirkmeyer Commissioner W. H. Webster Also present: Acting Clerk to the Board, Esther Gesick County Attorney, Bruce Barker Planning Department representative, Kerni Keithley Health Department representative, Jeff Stoll Public Works representative, Drew Scheltinga The following business was transacted: I hereby certify that pursuant to a notice duly published September 11, 1997, in the South Weld Sun, a public hearing was conducted to consider the request of Iglesia Monte Calvario Spanish Assemblies of God Church for a public church with an associated grass playground area and ballfield in the A (Agricultural) Zone District. Bruce Barker, County Attorney, made this a matter of record. Kerni Keithley, Department of Planning Services representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Ms. Keithley stated this is a five -acre tract east of Enchanted Hills Subdivision. The church has approximately 170 members who plan to use the site twice on Sundays and each Wednesday evening with possible special events. There have been numerous complaints received from surrounding property owners. Ms. Keithley noted that the applicant's submitted materials are in compliance with the application requirements of Section 24.7, as well as the requirements of Section 24.3 of the Weld County Zoning Ordinance. In response to Commissioner Webster, Ms. Keithley stated the site is located approximately'/ mile north of Weld County Road 22. Drew Scheltinga, County Engineer, recommended the applicant be required to pave the road due to concerns about dust and traffic to the site. He added the right-of-way belongs to the subdivision but would be accepted by Weld County for maintenance, and improvements will cost about $50,000. 972238 PL1224 Gc h- HEARING CERTIFICATION - IGLESIA MONTE CALVARIO SPANISH ASSEMBLIES OF GOD CHURCH (USR #1162) PAGE 2 Becky Ramirez represented the applicant and stated the applicant is willing to meet any conditions in order to continue the project. The property is located in an area that has many Spanish speaking people who could benefit from the church. In response to Commissioner Harbert, Ms. Ramirez stated the property has been purchased, not donated, and they anticipate about 30 cars on an average day. In response to Commissioner Kirkmeyer, Ms. Ramirez noted that many of the church members are from Longmont, but there are also members from Denver, Greeley, Boulder, and other surrounding cities, so the location is a driving compromise for many who attend. Ms. Ramirez explained that Tom Lindsey, realtor, located the property for the church. In the past they met at the Roosevelt Club House; however, they currently meet at the First Congregational Church of Longmont. Ms. Ramirez stated that one main factor in choosing the property over something closer to Longmont was the difference in cost. Ms. Ramirez said they are prepared for the additional costs to upgrade the road and septic system and plan to build in stages if necessary. Margaret Williamson, surrounding property owner, addressed her concerns and opposition to the church. She stated she lives on Elm Street which is a direct unpaved route to the church from Longmont. She is concerned about increased traffic, dust, the church's finances, and possible health dangers from cropdusting. Ms. Williamson questioned the septic system and the type of structure to be placed on the property. She asked the Board to consider that there is almost 100% opposition among the surrounding property owners, for reasons other than religious or racial prejudice. Barbara Northcutt, surrounding property owner, also lives on Elm Street. She stated her concerns are the same as Ms. Williamson's and compared the applicant to the Wren Church. Ms. Northcutt further stated her concerns regarding the applicant's financial stability and noted the costs involved in construction, upgrading the road, installing a septic system, and clearing winter road conditions. Craig Owen, surrounding property owner, stated that he owns 75 acres of farmland bordering the church property on the south and east property lines. After speaking with Bruce Nickerson, City Planner of Firestone, Mr. Owen feels that 2 inches of asphalt is not enough to handle the traffic generated by regular church meetings and special events and suggested 4 inches is more suitable. Mr. Owen also noted that if Weld County Road 15.5 is to be paved, Elm and Maple Streets should also be paved. Mr. Owen further stated that the church property is surrounded by farmland on three sides and crop spraying could be a hazard to the congregation. In response to Commissioner Harbert, he said there are two sanitation districts on either side of the property; however, neither of them service this area. After further discussion, Commissioner Harbert questioned whether there is a problem with the property to prevent it from being used for a residence. Mr. Owen said that it is suitable for a 5 -acre ranchette. In response to Commissioner Harbert, Mr. Scheltinga said that 2 inches of asphalt and 4 inches of base is the minimum requirement; however, he feels that it is suitable for the proposed use. If there are future developments, the road will need further consideration. Jeff Stoll, Health Department, responded to Chair Baxter that there are several options for an engineered septic system which are suitable for the proposed use. Depending on the type of engineering, Mr. Stoll continued, the costs would vary between $3,000 to $10,000. Ms. Keithley added that there is a possibility of 1,500 capacity in a 27,500 square foot building. Ms. Ramirez responded to the concerns and questions raised. She stated the church recently changed contractors to obtain a more realistic building plan which will be considerably lower in square footage and will not include a baseball field or other unneeded items. The church does plan to build in stages in order to pay for any unanticipated costs. In response to Ms. Northcutt, Ms. Ramirez stated the present pastor has only been there for three years; however, the congregation has been meeting for almost 18 years. She questioned the suggestion that a five -acre lot can be used for residential use but not for a church, since a full time resident would be at a higher risk from cropdusting than a group of people who spend only a few hours a week on -site. Ms. Ramirez stated the church plans to work with the surrounding community to gain their trust and work together. She also stated the church is planning on receiving volunteer help from a missionary group which helps construct churches, as well as other churches. Ms. Ramirez further stated the church is unsure of the type of structure that will be constructed until they have a chance to speak with their new contractor; however, it will be considerably smaller than the previous plans. After discussion, Chair Baxter verified the applicant is willing to meet all Conditions of Approval and Development Standards. Commissioner Webster moved to approve the request of Iglesia Monte Calvario Spanish Assemblies of God Church for a Site Specific Development Plan and Special Review Permit for a public church with an associated grass playground area and ballfield in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Commissioner Kirkmeyer seconded the motion; however, she also moved to amend the motion to delete the last part of the sentence in Condition of Approval 26 which states, "to the specifications identified in the referral from Weld County Public Works dated July 25, 1997" since it will be considered in the improvements agreement. Commissioner Harbert seconded the motion to amend the motion, which carried unanimously. Commissioner Kirkmeyer also moved to add a condition stating when sewer service is within 400 feet, the applicant is required to hookup and that there be a 300 occupancy limit. Any growth over 300 would require an amendment. Chair Baxter stated that according to the Planning Commission, if a completed plat was not submitted within three years, the USR would be abandoned. Chair Baxter added that he felt it unfair to base his decision on whether the church was built by local people or by an outside group; the issue is to decide if the property is suitable for a church building. Commissioner Harbert stated that she wanted the road to be completed before construction began; however, Mr. Barker stated the conditions for the off -site improvements will be included in a separate agreement.
