Owens Brothers Concrete Company wishes to obtain the necessary land use approval to mine sand and gravel to supply their ready-mix concrete plants. This mining operation would be for Owens' own use and is not planned as a commercial operation in the sense of selling construction aggregates to multiple customers as quickly as it can be mined. The Del Camino site is located north and east of Weld County Road Nos. 26 and 15 and in southwest Weld County (see Vicinity Map). The site is bordered by County Road No. 26 on the south, County Road No. 15 on the west, County Road No. 26-3/4 on the north, and Union Pacific Railroad right-of-way (R.O.W.) on the east. The property is currently used for irrigated cropland. A Regular 112 Reclamation Permit application will be submitted to the Colorado Mined Land Reclamation Board (CMLRB) at a later date. 2.1 Adjacent Land Uses and Zoning The subject property, adjacent properties, and properties within 1/2-mile are zoned Agricultural (A). Existing land uses of adjacent properties are low-density rural in character with scattered farm houses and farms. Permitted sand and gravel mining operations are present within 1/4-mile west of the site. 2.2 Community Information Program The applicant invited comment and questions from interested parties by letter. The purpose was to provide for information exchange regarding the mine and reclamation plans and related issues. A copy of the letter is found in Appendix A of this application. The mailing list (including adjacent property owners within 500 feet) is found in Section 1.3.1 of this application. A summary of comments and questions will be forwarded to Weld County Planning Services when they have been received and analyzed. 2.3 Geology and Hydrology The project property is located within the St. Vrain Creek valley, approximately 1/4 mile south of the creek. Topographic relief is very gradual, with a downslope gradient of less than one percent from the southeast to the northwest property boundaries. The site is underlain by Piney Creek alluvium and Post-Piney Creek alluvium. The Piney Creek alluvium is a dark-gray humic sandy to gravelly alluvium ranging in thickness up to twenty feet. The Piney Creek alluvium typically underlies terraces whose surfaces are ten to twenty feet above a nearby floodplain. Post-Piney Creek alluvium, a dark-gray humic, sandy to gravelly alluvium (ranging from five to fifteen feet in thickness) may be included. The Post- Piney Creek alluvium typically underlies floodplains of major streams and terraces less than 10 feet above stream level. According to Hillier et al, the project is located in an area where depth to water table in unconsolidated alluvium is five to ten feet. Measurement taken in 1976 or 1977 from a well located north of County Road 26-3/4 adjacent to the mine property indicated water level at SAG R A6US6 Earth & Environmental Owens Brothers Concrete Company AEE Project E95-7040 Del Camino Mining and Reclamation November 6, 1995 Weld County, Colorado Page (13) 7.3 feet below the ground surface at that location (Hillier, et al, 1976, 1977.) Site specific groundwater level measurements taken in February, 1995 during gravel reserve drilling activities indicate water table levels range from eight to ten feet on the property (Western Testing Laboratories, Inc. report included as Appendix B). 2.4 Soils Soils generally consist of deep, well to poorly drained sandy and loamy alluvium, formed on terraces and bottom lands. The capability classification by the United States Department of Agriculture (USDA) Soil Conservation Service (SCS) of most of the soils on-site is Its irrigated (as shown on the Vicinity Map). Topsoil will be stockpiled during mining operations and redeposited and reseeded during reclamation. 2.5 Veaetation The site has supported irrigated crop production in recent years. The vegetation resource on the property is not unique. The capability classification of the soils is relatively good cropland if irrigated. 2.6 Wildlife Historic mining activity in the area, roads and agricultural activity have significantly disturbed the wildlife habitat on the property. Colorado Division of Wildlife records were researched for species of birds, mammals,amphibians and reptiles likely to inhabit the area(Colorado Latilong Distribution Studies). Migratory fowl such as the sandhill crane, long-billed curlew, and western sandpiper have historically migrated through this area. There are numerous bird species present, but the western meadowlark and various species of sparrows are the most populous. With a fairly diverse rodent and bird population in the area, raptors such as the red-tailed hawk, prairie falcon and golden eagle can be assumed to use the site for hunting. Mining will cause a temporary loss of food and habitat for wildlife, until reclamation is complete. The proposed reclamation plans will restore the land to ponds capable of supporting wildlife. OAGRA Earth & avminental Owens Brothers Concrete Company AEE Project E95-7040 Del Camino Mining and Reclamation November 6, 1995 Weld County, Colorado Page (15) 3.0 MINE PLAN The total acreage within the Use by Special Review Permit boundary is 105 acres, of which approximately 86 acres will be mined. Existing site features are shown on the Extraction Plan Map and Vicinity Map. 3.1 General Description Mining will begin in the western part of the property and move east and south in four general phases. The mine phases and general direction of mining are shown on the Extraction Plan Map. Areas to be mined will be dewatered so that the full depth of gravel can be recovered. Vegetation and surface debris will be removed, and then available topsoil will be stripped and stockpiled for later use in reclamation. Unusable overburden material (i.e. silt and clay) will then be excavated and stockpiled. Overburden will subsequently be used for reclamation backfill and subsoil material. Sand and gravel will then be excavated and processed on-site. It is estimated that five to ten acres will be mined annually. Average annual production is estimated at approximately 150,000 tons per year. The applicant would like the right to produce up to 300,000 tons per year in order to accommodate an unusually large contract or an excellent business year. 3.2 Operation and Processina Eauioment to be employed Sand and gravel will be screened,crushed and stockpiled into the various aggregate products. Stockpiles and equipment will move around the property as the mining advances. Equipment will include: Dozers Loaders Radial Stacker Crusher Stacking Conveyor Portable Conveyor Screening Plant Dump trucks (25 ton capacity) Scraper 3.3 Number of shifts and maximum number of employees It is anticipated that up to ten shifts per week will be used, employing five to ten people. 3.4 Extraction Operation Areas to be mined will be dewatered so that the full depth of gravel can be recovered in a "dry pit" mining method. A pump will be installed at the low point of the trench and the ground water will be removed and discharged into St. Vrain Creek. The dewatering activities will be addressed by a well permit and plan of augmentation (Colorado Division of Water Resources) and by a NPDES permit (Colorado Department of Public Health and Environment) for the discharge. 3.5 County roads and bridges to be utilized/Transoortation. All aggregate material will be hauled off the property by gravel haul trucks. The ingress- egress point is shown on the Extraction Plan Map. The trucks will enter onto County Road 15, travel south to County Road 26, west to County Road 13, south to State Highway 119, and west to Interstate-25. Average annual production is estimated to range from 150,000 to 300,000 tons per year. Diversion ditches and berms will prevent uncontrolled off-site discharge into the natural drainage system. Runoff on the property will be directed to sumps on the pit floor where the runoff and seeping ground water will be diverted to the settling ponds. The clarified water will then be either recycled as process water or discharged according to the NPDES permit and stormwater management plan (if required). OAGRA 960506 Earth & Environmental Owens Brothers Concrete Company AEE Project E95-7040 Del Camino Mining and Reclamation November 6, 1995 Weld County, Colorado Page (181 4.0 RECLAMATION PLAN The post-mining land use will be ponds, native vegetation and wildlife habitat. The approximate post-mining land form is shown on the post-mining contour map. A reclamation permit application will be submitted to the Colorado Division of Minerals of Geology at a later date. That permit application will be submitted to Weld County at that time. The general reclamation process and purpose are presented below. 4.1 Reclamation Process Reclamation will take place concurrently with mining with no more than five to ten acres being disturbed at any one time before reclamation commences. Vegetation will be removed, and then available topsoil will be stripped and stockpiled for later use in reclamation. Unusable overburden material (i.e. silt and clay) will then be excavated and stockpiled. Overburden will subsequently be used for reclamation backfill and subsoil material. 4.1.1 Topsoil Preservation Soils on the site vary from sandy loam to clay loam to silty clay and with surface layers varying from seven to twelve inches thick. The agriculturally unproductive soils which are primarily sand will be excavated for road base material. The surface layer of productive loamy soils will be salvaged during the initial phases of mining and will be stockpiled for later use. The location of topsoil stockpiles will be within the permit area and in areas close to final placement. As mined areas become ready for topsoil replacement, topsoil may be hauled directly from the area to be mined to the area to be reclaimed, rather than stockpiled. Soil material that is stockpiled will be placed on a stable surface within the permit area and will be clearly marked. The topsoil will be protected from disturbance associated with the mining operation, and from wind and water erosion, compaction and other disturbances that would reduce its capability to support vegetation. The stockpiles may be temporarily seeded and/or situated to minimize action from wind and water. Topsoil will be removed before any mining or other surface disturbance takes place. Topsoil will be salvaged only from areas required for mining and mine related surface disturbance. Vegetation will be recovered with the topsoil material. Soil materials will be subjected to physical and chemical soil analyses to determine possible means of enhancing plant growth. Soil analyses may include pH, texture, specific conductivity, sodium adsorption ratio, nitrate nitrogen, plant available phosphorous and potassium. It is expected that the soils tests results will indicate little enhancement is necessary. Existing vegetation verifies the Soil Conservation Service determination for soils in the area as suitable for pasture and crops. 4.1.2 Regrading and Shaping The pit slopes and floor will be backfilled and/or graded to achieve the approved post-mining Q A G R A 960506 Earth & Environmental Owens Brothers Concrete Company AEE Project E95-7040 Del Camino Mining and Reclamation November 6, 1995 Weld County, Colorado Page (19) contour, in preparation for topsoil placement. Contour furrows or water bars will be established on the pit slopes to reduce erosion and encourage stable plant growth. 4.1.3 Topsoil Replacement Topsoil replacement will occur following regrading and scarification of the surface primarily in late summer and fall. This procedure limits the time that topsoil is exposed prior to revegetation and avoids moving topsoil when it is frozen or too wet. 4.1.4 Revegetation Revegetation of the upland areas to predominantly native grassland will be undertaken to stabilize the site and provide wildlife habitat. Seedbed Preparation After regrading and contouring are complete and based on the soil test results, the surface will, if necessary, be treated with organic and inorganic amendments. Following this treatment, the surface will be scarified to aid the penetration and dispersion of the amendments. Topsoil will then be spread. This material will provide seed, plant parts, and soil microbes for nutrients. Seeding Method Seeding will be accomplished using either a seed drill properly equipped to meter the native grasses of the mix, or using broadcast followed by harrowing or raking. Seeding will be done in the Fall after October 15. Following seeding,the area will either be hydromulched at 2000 lbs per acre with 100 lbs per acre of Psyllium-based tackifier, or covered with certified clean straw at the rate of two tons per acre, followed by tackifier at the rate of 100 lbs per acre. 4.2 Storm Drainage Plans Storm drainage will be diverted and directed into the mined-out areas to the extent possible such that no runoff from disturbed ground enters natural drainageways or ditches during mining and reclamation activities. Other flows will be directed through a sediment pond prior to discharge. A NPDES and Storm Water Runoff permit will be obtained from the Colorado Department of Public Health and Environment if necessary. OAGRA 96©5:36 Earth & Environmental Owens Brothers Concrete Company AEE Project E95-7040 Del Camino Mining and Reclamation November 6, 1995 Weld County, Colorado Page (20) 5.0 STATEMENTS OF COMPLIANCE WITH WELD COUNTY REQUIREMENTS This section discusses compatibility with surrounding land uses and compliance with the Weld County Comprehensive Plan policies. 5.1 Consistent with the Weld County Comprehensive Plan (Proposed May 2, 19951 The Weld County Comprehensive Plan county-wide growth and land use goals and policies (proposed May 2, 1995)as applicable to this mining project are discussed below. This project is consistent with the proposed Weld County Comprehensive Plan goals and policies as demonstrated in the following discussion. 5.1.1 Agricultural Goals and Policies According to the USDA SCS soil survey for the area,the property contains soils, which when in combination with available irrigation, would possibly constitute "prime farmland". The Site Specific Development Plan and Special Review permit is for a sand and gravel operation in the A (Agricultural) zone district as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance. 3. The open-cut sand and gravel operation shall comply with Sections 44.4 and 44.5 of the Weld County Zoning Ordinance. 4. Fugitive dust shall be controlled on this site. 5. All liquid and solid wastes shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 6. OAGRA 960596 Earth & Environmental date name & address SUBJECT: Information on Sand and Gravel Mining Permit Application • Owens Brothers Concrete Company is preparing to submit a permit application (Use by Special • Review) to Weld County for sand and gravel mining. The company owns approximately 105 acres (as shown on the attached map) as well as associated water rights. This letter is a voluntary effort by Owens Brothers Concrete to inform nearby homeowners of the plans and to ask for comments and questions that you may have. We are doing this before the final plans have been developed and before making the permit application because we are interested in your comments and we may be able to adjust the mining and reclamation plans to satisfy your concerns. About 100,000 to 150,000 tons per year of sand and gravel will be mined over a period of approximately 10 years once mining begins. The company produces ready mix concrete and is seeking its own source of concrete aggregate. Mining may not begin for several years although we wish to obtain the county permit now. A maximum of 25 to 30 trucks per day would haul gravel off the site for about 200 operating days per year. The trucks would exit the property on the west side and proceed south on Weld County Road 1 5. The trucks would proceed to 1-25 southbound and deliver the rock to Owens Brothers Concrete batch plants. This is a captive supply of sand and gravel and not a full-scale commercial operation. The gravel is for the company's own concrete plants. The mine would cover about 75 acres of the total 105 acres and would be full depth (down to the shale beneath the gravel). Groundwater would be exposed and a pond would be left as final reclamation. All Colorado water permits will be obtained and augmentation plans will be developed and implemented. The mining equipment and processing plant would be very similar to other gravel mines in the area. We are planning on submitting the permit application to Weld County in late summer/early fall 1995.
