ORDER OF BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY
VACATING CERTAIN PORTIONS OF COUNTY ROADS AND DEDICATED
ALLEY IN EAST SIDE ADDITION TO TOWN OF EATON
1. On June -k , 1960, at a meeting of the Board of County Com-
missioners of the County of Weld, Colorado, at which all members of
the Board were present, The Great Western Sugar Company, a New Jersey
corporation, presented its Petition dated June 6, 1960, to the Board
to vacate certain portions of Linden Street, Clark Street, 3rd Street
and the alley in Block 1, East Side Addition to Town of Eaton.
2. The Board finds that it would be in the best interests of the
County to vacate the east 45 feet of Linden Street lying south of the
south line of 4th Street in the East Side Addition to Town of Eaton in
order to permit The Great Western Sugar Company to install truck scales
in said 45 foot strip to facilitate the receipt of sugar beets from
farmers in the Eaton factory district and to alleviate traffic congestion
and hazards on the county roads leading to such beet receiving area.
3. The Board also finds that Petitioner, The Great Western Sugar
Company, has continuously and exclusively used all of Clark Street lying
south of the south line of 4th Street extended in said Addition, all of
3rd Street lying within said Addition, and the alley in Block 1 of said
Addition for many years in its factory and beet receiving operations and
that said streets and alley have not been used by the general public.
4. Wherefore the Board of County Commissioners of Weld County hereby
orders the vacation of the following:
(1) The east 45 feet of Linden Street lying south of the south line
of 4th Street in the East Side Addition to Town of Eaton;
(2) All of Clark Street lying south of the south line of 4th Street
extended, East Side Addition to Town of Eaton;
(3) All of 3rd Street lying within the boundaries of East Side
Addition to Town of Eaton;

(4) The alley in Block 1, East Side Addition to Town of Eaton.
5. This order to vacate shall not affect existing rights of way for
sewer, gas, water or similar pipe lines, or for electric, telephone and
similar lines and appurtenances.

PETITION FOR VACATION OF PORTIONS OF COUNTY ROADS AND
DEDICATED ALLEY IN EAST SIDE ADDITION TO TOWN OF
EATON, COLORADO
To the Honorable Board of County Commissioners of Weld County,
Colorado:
1. The Great Western Sugar Company, a New Jersey corporation,
with principal offices in the City and County of Denver, Colorado, hereby
petitions the Board of County Commissioners to vacate (1) the east 45 feet
of Linden Street lying south of the south line of 4th Street, East Side
Addition to Town of Eaton, Colorado, (2) all of Clark Street lying south
of the south line of 4th Street extended in said Addition, (3) all of 3rd
Street lying within said Addition, and (4) the alley in Block 1 of said
Addition.
2. The East Side Addition to the Town of Eaton lies wholly with-
in the County of Weld, Colorado, and without the town limits of the Town of
Eaton, Colorado.
3. The areas sought to be vacated are shown outlined in yellow
on the map of East Side Addition to Town of Eaton, marked "Exhibit A",
attached hereto and made a part hereof.
4. Petitioner has legal title to all of Block 1, East Side
Addition to Town of Eaton and as such is the abutting land owner on the east
side of Linden Street lying south of the south line of 4th Street in said
Addition.
5. In its beet receiving operations, Petitioner has need to
install truck scales in the east 45 feet of that part of Linden Street
lying south of the south line of 4th Street in said Addition to facilitate
the receiving and weighing of sugar beets from farmers in the area, and to
prevent or alleviate traffic congestion on the county roads leading to
Petitioner's beet receiving station on its Eaton factory site. Said scales
cannot be located elsewhere on the factory premises without impeding the beet
receiving operations which in turn create traffic congestion and hazards.
6. In the event the Board of County Commissioners vacates the
east 45 feet of Linden Street lying south of the south line of 4th Street,
there will remain a 30 ft. road dedicated to the public which is sufficient
to provide ingress and egress to the abutting land -owners who reside on the
west side of Linden Street, south of the south line of 4th Street being
Lots 1 to 9 inclusive, Block 2, East Side Addition to Town of Eaton, Colorado.
7. Petitioner has title to (1) all land on each side of Clark
Street, lying south of the south line of 4th Street extended in said East
Side Addition to Town of Eaton, (2) to all land surrounding that portion of
3rd Street which lies within said Addition except that portion which adjoins
Union Pacific Railroad right of way, and (3) to all land on each side of the
platted alley in Block 1 of said Addition.
8. For many years that portion of Clark Street lying south of the
south line of 4th Street extended, all of 3rd Street lying within said
Addition, and the alley lying within Block 1 of said Addition have been
continuously and exclusively used by Petitioner in its factory operations
and have not been used by the general public.
9. In the event of vacation as requested, existing rights of way
for sewers, gas, water or similar pipe lines and for electric, telephone and
similar lines and appurtenances shall continue in full force and effect.
10. Wherefore Petitioner prays that the Board vacate the
following:
(1) The east 45 feet of Linden Street which lies south of the
south line of 4th Street in the East Side Addition to Town of Eaton;
(2) All that part of Clark Street lying south of the south line
of 4th Street extended in the East Side Addition to Town of Eaton;
(3) All that part of 3rd Street which lies within the boundaries
of the East Side Addition to Town of Eaton; and
(4) The alley in Block 1 of the East Side Addition to Town of Eaton.

The undersigned has been advised of a Petition to be filed with
the Board of County Commissioners of Weld County, Colorado, by The Great
Western Sugar Company, seeking authority to vacate the east 45 feet of
Linden Street lying south of the south line of 4th Street, East Side Addi-
tion to Town of Eaton, Colorado, for the purpose of installing therein
truck scales to facilitate the receiving and weighing of sugar beets.
The undersigned has no objection to the vacation of the east 45
feet of Linden Street lying south of the south line of 4th Street as re-
quested in the Petition.
The undersigned has legal title to the following real estate
which abuts on the west side of Linden Street south of the south line of
4th Street in the East Side Addition to Town of Eaton, Colorado:
