RIGHTS-OF-WAY AND EASEMENTS
Other than those rights—of—way and easements shown specifically on this plat,
the public records contain several rights—of—way or easements which may apply
to this property but do not specify the exact location. These are listed cs
follows:
1. Right—of—Way Easement for underground electric distribution line purposes
as granted to Union Rural Electric Association, inc., by instrument recorded
May 27, 1980 in Book 904 under Reception No. 1825838, Weld County Fecords.
The route of said Right—of—Way is more particulorly described as follows: An
easement 12 feet wide for an underground electric distribution line on, over,
and across a portion of the South seven (7; acres of the South one—half of the
Southwest quarter Section Nine (9), Township 1 North, Range 68 West, 6th P.M.,
Weld County, Colorado, being more particularly described as the East 12 feet
of the North 150 feet of said seven (7) acres.
2. Rignt—of—Way Easement for water pipeline purposes as granted to Left Hand
Water Supply Company, by instrument recorded September 25, 1989 in Book 1244
under Reception No. 2192767, Weld County Records. The route of said Right—of—
Way is not set forth in said instrument.
3. Reservation as contained in Deed dated May 8, 1902, recorded June 4, 1902
in Book 201 at page 13, from Union Pacific: Railroad Company to Katherine W.
Toll, which is as follows: Excepting and reserving to said Union Pacific
Railroad Company, its successors and assigns:
FIRST, all coal and other minerals within or underlying said lands,
SECOND, the exclusive right to prospect ir and upon said land for coal and
other minerals therein or supposed to be therein, and to mine for and remove
from said land all coal and other minerals found thereon ny anyone,
THIRD, the right of ingress, egress and regress upon said land to prospect.
for, mine and remove ail such coal and other minerals, and to use so much land
as convenient or necessary for the right—of—way to and from such prospect
places or mines and for roads and approaches thereto, or for the removal
therefrom of coal, mineral, machinery or other material,
FOURTH, the right to said Union Pacific Railroad Company to maintain and
operate its railroad in its present form of construction and to make any
change in the form of construction or method of operation of said Railroad.
4. Reservation of the right to construct, operate and maintain over, upon or
across said land such canals, ditches, laterals and waterways of such
dimensions and capacities as may be required for the proper irrigation of
other lands now owned by the first party, together with rights of Ingress aid
egress along, upon, over, to and from said canals, ditches, laterals and
waterways in Deed recorded May 4, 1927 in Book 814 at page 541.
5. Right—of—Way for telephone and telegraph purposes as granted to Mountain
States Telephone and Telegraph Co., by insturment recorded May 7, 1930 ir Book
894 at page 396, Weld County Records. ,-he route of said Right—of—Way is not
set forth in said instrument.
6. Rights—of—Way far the Mock Water Supply as filed in the office of the Weld
County Clerk and Recorder March 27, 1931.
7. Right—of—way for county roads 30 feet wide on either side of section and
township lines, as established by the Board of County Commissioners for Weld
County, recorded October 14, 1889 in Book 86 at Page 273, Weld County Records.
8. Rights—of—way for telephone, gas, electricity, water and cable television
are located in undescribed locations in the. right—of—way of County Rood 10-
