RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1133 FOR A
2500 -HEAD DAIRY WITH THREE ADDITIONAL ACCESSORY TO FARM MOBILE HOMES
IN THE A (AGRICULTURAL) ZONE DISTRICT - MIKE FAULKNER
A public hearing was conducted on January 8, 1997, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated December 4, 1996, and duly published
December 19, 1996, in the South Weld Sun, a public hearing was conducted to consider the
request of Mike Faulkner for a Site Specific Development Plan and Special Review Permit for a
2500 -head dairy with three additional accessory to farm mobile homes in the A (Agricultural) Zone
District. Lee Morrison, Assistant County Attorney, made this a matter of record. Kerni Keithley,
Department of Planning Services representative, presented a brief summary of the proposal and
stated the facility is currently a non -conforming use with 1050 head. She then entered the
favorable recommendation of the Planning Commission into the record, with Conditions of Approval
and Development Standards, as written. Commissioner Kirkmeyer questioned whether Condition
of Approval #7 is the same as Condition of Approval #2.d. concerning a fly control plan. Trevor
Jiricek, Health Department, clarified Condition of Approval #2.d. requires the applicant to submit
the plan for review and approval by the Health Department, and Condition of Approval #7 requires
the plan to be implemented; however, staff can change the wording for further clarification. Mike
Faulkner, applicant, stated he is currently milking 800 head and confirmed there are 1050 head on
site. He noted his property was grandfathered for a certain number of head. Mr. Faulkner stated
the facility is getting worn out and he will need to remodel or build a new barn in the near future.
He further explained a new barn will cost $700,000.00 to $800,000.00; therefore, it is necessary
for him to milk more cows for financing purposes. He stated at the current level of 1050 head, he
is not even allowed to raise his own replacement animals and reiterated he needs the 2500 -head

Permit to milk a projected 1400 to 1600 head. Mr. Faulkner stressed he needs flexibility for
efficiency. Responding to a question from Chair Baxter, Mr. Faulkner stated he may buy additional
land to raise the necessary replacement animals. He confirmed acceptance of all Conditions of
Approval and Development Standards. No public testimony was offered concerning this matter.
Commissioner Webster moved to approve the request of Mike Faulkner for a Site Specific
Development Plan and Special Review Permit for a 2500 -head dairy with three additional
accessory to farm mobile homes in the A (Agricultural) Zone District, based on the
recommendations of the Department of Planning Services staff and the Planning Commission, with
the Conditions of Approval and Development Standards as entered into the record. The motion
was seconded by Commissioner Kirkmeyer. Ms. Keithley stated staff suggests deleting Condition
of Approval #7 and adding said language to Development Standard #11. Mr. Faulkner agreed, and
Commissioners Webster and Kirkmeyer agreed to so amend the motion, which carried
unanimously.
This Certification was approved on the 13th day of January, 1997.
