RE: APPROVE RESUBDIVISION (S #430) TO REPLAT LOTS 13 AND 14, AND VACATE OF
LOT 13 IN LUPTON MEADOWS LAND COMPANY DIVISION NO. 1 - EUGENE AND
SHIRLEY WAGNER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 25th day of
August, 1997, at the hour of 9:00 a.m. in the Chambers of the Board for the purpose of hearing
the application of Eugene and Shirley Wagner, 9990 Weld County Road 23, Fort Lupton,
Colorado 80621, for Resubdivision (S #430) to replat Lots 13 and 14, and vacate Lot 13, on the
following described real estate, to -wit:
Lots 13 and 14, Lupton Meadows Land Company
Division No. 1, in part of the N%: of Section 13,
Township 2 North, Range 67 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, Eugene and Shirley Wagner, applicant, were present, and
WHEREAS, Section 7.3.6 of the Weld County Subdivision Ordinance provides standards
for review of said Resubdivision S #430, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the following
reasons:
1. The submitted materials are in compliance with the application requirements of
Sections 7.3.6 of the Weld County Subdivision Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Sections 7.3.6, specifically:
a. Section 7.3.6.1 -- That the proposed resubdivision is located within an
Urban Growth Boundary area as defined and adopted in any approved
intergovernmental agreement(s), or as defined in the Weld County
Comprehensive Plan. The property under consideration is located in the
three (3)mile referral area of Fort Lupton. The City of Fort Lupton
reviewed the application and stated no conflict with the resubdivision and
vacation of land.

b. Section 7.3.6.2 -- Compliance with the Weld County Comprehensive Plan
and the zone district in which the proposed resubdivision is located. Lots
13 and 14 comprise approximately 83 acres of agricultural ground.
Through this resubdivision proposal, the applicants are requesting to
adjust the boundary line between Lots 13 and 14 and, secondly, to vacate
Lot 13 from Lupton Meadows Subdivision. The reason for the vacation
request is that, in the future, they wish to make application for a Recorded
Exemption to divide Lot 13. If this resubdivision request is approved,
zoning of the resulting parcels will be allowed to remain A (Agricultural).
Agricultural uses, including some crop production, are intended to remain
on the property in the future.
c. Section 7.3.6.3 -- That comments received from referral agencies have
been addressed, if applicable. Referral agencies comments have been
incorporated into the conditions of approval contained herein.
d. Section 7.3.6.4 -- That definite provision has been made for water supply
that is sufficient in terms of quantity, dependability, and quality to provide
water for the resubdivision lot including fire protection. No additional water
is required with this resubdivision, as no additional lots are proposed. The
Fort Lupton Fire Protection District indicated no conflict with the request.
e. Section 7.3.6.5 -- That if a public sewage disposal system is proposed,
provision has been made for the system and, if other methods of sewage
disposal are proposed, evidence that such systems will comply with state
and local laws and regulations which are in effect at the time of
submission of the resubdivision. Individual septic systems will provide
sewage disposal to the lots in question. The Weld County Health
Department has reviewed the application and its comments are included in
the conditions of approval.
f. Section 7.3.6.6 -- That streets within the subdivision are adequate in
functional classification, width, and structural capacity to meet the traffic
requirements of the subdivision. Weld County Road 23 provides access to
Lots 13 and 14. The Weld County Public Works Department has reviewed
the application and its comments have been incorporated into the
conditions of approval.
g.
Section 7.3.6.7 -- That off -site street or highway facilities providing access
to the subdivision are adequate in functional classification, width, and
structural capacity to meet the traffic requirements of the subdivision in
accordance with the requirements set forth in Section 10 of this
Ordinance. Weld County Road 23, which is a paved and county -
maintained collector, provides access to the site.

h. Section 7.3.6.8 -- That facilities providing drainage and storm water
management are adequate. Weld County Public Works Department
indicated no conflict with drainage on the site.
Section 7.3.6.9 -- The resubdivision will not cause an unreasonable
burden on the ability of local governments or districts to provide fire and
police protection, hospital, solid waste disposal, and other services. The
proposed resubdivision will not impact the ability of these entities to
provide services to the site.
Section 7.3.6.10 -- There subdivision will not cause air pollution violations
based on Colorado Department of Public Health and Environment
standards. In its review of the application, the Weld County Health
Department indicated no concerns regarding air pollution.
k. Section 7.3.6.11 -- The resubdivision conforms to the subdivision design
standards of Section 10. Lupton Meadows Land Company Division No. 1
is a nonconforming subdivision recorded prior to the implementation of the
design standards of Section 10 of the Weld County Subdivision Ordinance.
The addition of utility easements to Lot 13 was recommended by the Utility
Advisory Board in its August 14, 1997, meeting and has been made a part
of the conditions of approval.
Section 7.3.6 12 -- The resubdivision will not have an undue adverse
effect on wildlife, its habitat, the presentation of prime agricultural land,
and historic sites. The Colorado Division of Wildlife, in a telephone
conversation, indicated no conflict with the application. No known
historical sites are associated with this request.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the application of Eugene and Shirley Wagner for Resubdivision (S #430)
to replat Lots 13 and 14, and vacate Lot 13, on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:
1. The applicant shall submit a mylar plat to the Department of Planning Services
within 30 days of approval by the Board of County Commissioners. The plat shall
be recorded in the office of the Weld County Clerk and Recorder. The applicant
shall be responsible for paying the recording fees. (Planning Department)
2. The following access requirements of the Public Works Department shall be met:
a) One access each shall be granted for Lots 13 and 14.

b) The minimum distance between the center line of access driveways on
Lots 13 and 14 shall be no less than 300 feet.
c) The minimum size for access culverts shall be 15 inches x 20 feet for
residential accesses and 15 inches x 30 feet for agricultural accesses.
3. The plat shall be amended as follows:
a) The 100 -foot strip described as "deeded to Belle Watson..." which appears
within the boundaries of Lots 13 and 14 on the plat, and all references to
said strip, shall be removed from the area delineated as the Wagner
property on the plat.
b) A utility service statement block shall be added to the plat, in accordance
with Section 7.2.7.10 of the Weld County Subdivision Ordinance, as
amended.
c) The accesses for Lots 13 and 14 shall be clearly delineated on the plat.
d) A fifteen (15) -foot front line utility easement and ten (10) -foot side and rear
line utility easements shall be delineated along the perimeter of Lot 13, as
recommended by the Weld County Utility Advisory Board.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

It is the opinion of the Department of Planning Services' staff that the applicant has shown
compliance with Section 7.3.6 of the Weld County Subdivision Ordinance, as amended, as follows:
Section 7.3.6.1 That the proposed resubdivision is located within an Urban Growth Boundary

Your application and related materials for the request described above are complete and in order at the present
time. I have scheduled a meeting with the Weld County Utilities Advisory Committee for Thursday, August 14,
1997, at 10:00 a.m. This meeting will take place in the Weld County Administrative Offices, 1400 N. 17th
Avenue, Greeley, Colorado. In addition, I have scheduled a meeting with the Board of County Commissioners for
Monday, August 25, 1997, at 9:00 a.m. This meeting will take place in the Weld County Centennial Center, 915
Tenth Street, Greeley, Colorado.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials to
the Fort Lupton Planning Commission for its review and comments. Please call Susan Lira with the Town of Fort
Lupton, at 970-346-0326, for information regarding the date, time and place of the meeting and the review
process. It is recommended that you and/or a representative be in attendance at each of the meetings described
above in order to answer any questions that might arise with respect to your application.
A representative from the Department of Planning Services will be out to the property to post a sign adjacent to
and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In
the event the property under consideration is not adjacent to a publicly maintained road right-of-way, one sign will
be posted in the most prominent place on the property and post a second sign at the point at which the driveway

PROPOSED SUBDIVISION AND REPLAT:
Lupton Meadows is a rural agricultural subdivision consisting of large (approximately
40 acre) lots. Applicants seek to subdivide and replat Lots 13 and 14, Lupton Meadows
Subdivision by redefying the boundary between Lots 13 and 14 into what will become Lots A and
B, as depicted in the attached sketch. At the same time, Applicants seek by separate application
to create a Recorded Exemption on a 6 acre parcel located on the Southwest edge of Lots 13 and
14.

recommended to be a part of any approval:
COMMENTS:
This proposal will be handled as a three -parcel application.
The Lupton Bottom Ditch splits the third parcel by natural boundaries.
REQUIREMENTS:
One access per legal parcel will be granted to each of the three proposed parcels. In the spacing standards for
a Collector status road, the minimum distance requirement between the center line of access driveways is 300
feet. The minimum size for access culverts is 15 inches x 20 feet for residential -type accesses and 15 inches x
30 feet for agricultural related operations, if needed.

This work shall be completed within Thirty • . ( 30 ) days from the issue
date. No work shall be allowed on Saturdays or Sundays.

IT IS UNDERSTOOD that the Permittee will cause the Installation at no expense whatsoever to Weld County and that
the Permittee will own and maintain the same after Installation.
The electrical cable line shall be installed beneath the surface of the right of way at a minimum cover
of 36 inches and the disturbed portion of the right of way shall .be restored to Its original condition. All backfilling shall be
in eight inch lifts and mechanically compacted to 95% of Standard Proctor.
All road crossings shall he bored. Said Installation shall be encased in pipe of larger diameter when required and the
crossing shall be as nearly perpendicular to the roadway as physically possible. No water shall be used In the boring and no
tunneling shall be permitted.
Where the installation crosses any ditch, canal or water carrying structures, wherever possible it shall be pushed through
and beneath In a pipe of larger diameter thereby. eliminating the necessity of trenching. In no case shall the flow of water ever
be impaired or interrupted. The applicant shall obtain permission.to cross all irrigation ditches from the owner of each ditch.
This work must be accomplished In accordance with accepted good practices and conform to the recommendations of the
National Electric Safety Code and to such statutes as are applicable.
Construction warning signs, conforming to the Uniform Traffic 'Control Device Manual and to the Colorado Supplement.
