BE IT RESOLVED, by the Board of County Commissioners of Weld County,
Colorado, that they hereby approve a certain operation and maintenance agree-
ment with the Soil Conservation Service, United States Department of Agriculture,
"Service, and the West Greeley Soil Conservation District, The Pierce Lateral
Company, and the Water Supply and Storage Company "Sponsors" (with Weld County)
relative to the responsibility for and the carrying out of operation and main-
tenance of Works of Improvement for the Coalbank Creek Watershed Protection and
Flood Prevention Project, as per attached Operation and Maintenance Agreement.

OPERATION AND MAINTENANCE AGREEMENT
This agreement, made and entered into the 29th day of EEbP k91 , 1960, by
and between the Soil Conservation Service, United States Department of Agricul-
ture, hereinafter referred to as the "Service", and the West Greeley Soil Coe
vation District, the County of Weld of -the State of Colorado, the Pierce Lateral
Company and the Water Supply attd Storage Company, hereinafter referred to as the

"Sponsors", relating to the rsaRuneibility for and the calfrying out of operation

and maintenance of the following descpibed Works of Imyrinrement for the Coalbank
Creek Watershed Protection and Fleod Prevention Project, copies of the proposed
Work Plan having been furnihed to all portion hereof,
WITNESSETR:
Whereas, it has been determined by the parties hereto that the operaticb'end
maintenance of said Forks of Improvement will provide protection from floodwater
in Coalbank Creek for certain county roads of Weld County and for certain irri-
gation works of the Pierce Lateral Company and of the Water Supply and Storage
Company, and for certain lands within the boundaries of the West Greeley Soil
Conservation District,

A. Weld Canty, the Piero, Lateral Company n4 the Water Sappj' and if, •Company jointly assume responsibility for the operatics and adrteatce of

the following structures describe'sed located in, the proposed Watershed
Work Plan for the Coalbank Creek Watershed, dated Febraaft 1960, contingea%
upon final approval of eat& work plan. The total cost of the perforsmanpe
of annial maintenance and operation in terms of money, equipment use, labor
or the equivalent thereof, willbe divided on the teals of 1/2 by the Pierce
Lateral Company, 1/4 by the hater Supply and Storage Company,.and 1/4 by
Weld County. An annual accounting will be made between the parties and a
copy will be furnished, to the Soil Conservation Servioe.

the planned:elevations or to deflect cr decrease the planned
flow through thc spillway, in any manner.
L. Prohibit the installation of dikes or other atiuptures which eta"
decrease the capacity of the ^resent flood channel or deflect the
flow from the channel bottom.

representatives of the Cpon;ora.
Prepare and furnish to th fponsur: a report of incpeetion findings,
.r:clw'irg recommendations for maintenance work needed and the time
