THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. She submitted materials are in compliance with the application requirements
of Section 28.5 of the Weld County Zoning Ordinance.
2. It is the opinion of the Department oI Planning Services' staff that the
applicant has shown compliance with Section 28.8 of the Weld County Zoning
Ordinance as follows:
The proposed Planned Unit Development (PUD) District is located within
the I-25 Mixed Use pevelopment Area (I-25 M.U.D.). The uses
associated with the proposed PUD District are consistent with the uses
identified in the I-25 M.U.D. Conceptual Land Use Plan of the Weld
County Comprehensive Plan.
The uses allowed in the proposed PUD District will conform to the
Performance Standards set forth in Section 35.3 of the Weld County
Zoning Ordinance.
The uses permitted ahall to compatible with the existing or future
development of the surrounding area as permitted -by the existing
zoning, and with the future development as projected by the
Comprehensive Plan. Surrounding land uses include outside storage and
a contracting business, vacant commercial ground, manufactured home
sales and Interstate 25 right-of-way.

Adequate water and sewer service will be made available to the
property to serve the proposed uses. Central Weld County Water
District and St. Vrain Sanitation District will provide water and
sewer service to the site.
Highway facilities providing access to the property are adequate in
functional classification, width, and structural capacity to meet the
traffic requirements of the proposed commercial uses. 1-25 Frontage
Road will provide access to the PUD, in accordance with the letter
from Teresa Jones, Colorado -Department of Transportation, dated May
16, 1995.
- No overlay districts, restrictive soil conditions, or zommeriai-al
mineral deposits are known to be located on the -subject site.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Department of Planning Services' staff recommendation for approval is
conditional upon the following:
1. The Change of Zone plat shall to delivered to the Department of Planning
Services and be ready for recording in the Weld County Clerk and Recorder's
Office within 15 days of the date of approval by the -Board of County
Commissioners.
2. The following notes shall be placed on the-PUD District plat:
a. Uses_allowed within the PUD District shall comply with uses identified
in the C-3 (Commercial) District as set forth in -Section 33.4 of the
Weld County Zoning Ordinance.
b. A site plan review shall be required for all uses within the POD, in
accordance with Section 33.4.5 of the Weld County Zoning Ordinance.
c. All streets within the POD District are private and shall be built to
County standards. All streets within the POD District shall be
maintained by the lot owners of the "POD -District.

d. Central Weld County Water District shall provide the PUD District
water supply.
e. St. Vrain Sanitation District shall provide sewer service to the PUD
District.
f. Installation of utilities shall comply with Section 10 of the Weld
County Subdivision Regulations.
g.
Each lot within the -POD shall be developed with no less than 15 per
cent open space.
h. Landscaping within the I-25 Frontage road right-of-way on Lots 1 -or 2
shall be maintained in -such a way that it -does not impair site
distance at any access, does not present -a safety hazard to the
travelling public on the 2-25 _Frontage Road, and shall be maintained
by the respective lot owners. No trees shall be all -owed within the I-
25 Frontage road right-of-way.
3. The PUD Plan application submittal shall _contain the following information:
a. Identify a location on the PUD plan plat where potential oil and gas
uses will occur within the PUD District.
Document the applicant's willingness to satisfy concerns expressed by
Teresa Jones, Colorado Department of Transportation, regarding future
additi-on of auxiliary lanes to the I-25 Frontage Road, drainage,
utility _permit and temporary state highway access permit, in her
letter dated May 15, 1995.
c. Evidence that all permits required by the Department of the Army -Corps
of Engineers have been obtained for this PUD development.

Quinlan Construction Inc.
Staff has not yet received a referral response from Colorado Geological Survey regarding on -site
soil conditions and the presence of commercial mineral deposits underlaying thesix acres.
Comments are expected prior to the Board of County Commissioners consideration of this
change of zone request.
Approved access to the property is by way of a shared access easement with property owner to
the north. The easement is thirty (30) feet in width, lying fifteen (15) feet on each side of the
property line. The easement is recorded in Book 1364 as Reception number 02116562.
The applicant is requesting that -a twenty (20) foot utility easement located in a north -south
direction near the center -of the parcel be vacated, as a part of the PUD process. The property
owner has documented that Flatiron Structures owns the easement, that there are no users of the
easement nor does any other party have an interest in the easement.

Colorado.

Your application and related materials for the request described above are being processed at the present time. I have scheduled a meeting
with the Weld County Planning Commission for June 6, 1995, at 1:30 p.m. This meeting will take place in the County Commissioners'
Hearing Room, First Floor, Weld County Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you and/or a
representative be in attendance to answer any questions the Planning Commission members may have.
It isihe policy of Weld County to refer an application to any town or municipality lying within three miles of the property or if the property
islocated within the comprehensive planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted
materials to the Longmont and Mead Planning Commissions for their review and comments. Please call Brad Schol, City of Longmont at
651-8330, and Judy Hegwood at Town of Mead at 535-4477, for further details regarding the date, time, and place of these meetings. It
is recommended that you and/or a representative be in attendance at the Planning Commission meeting to answer any questions the
Commission members may have with respect to your application.
A representative from the Department of Planning Services will be out to the property a minimum of ten days prior to the hearing to post
a sign adjacent to and visible from a publicly maintained road right-of-way which identifies the hearing time, date, and location. In the event
the property is not adjacent to a publicly maintained road right-of-way, one sign will be posted in the most prominent place on the property
and a second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the Weld County Planning
Commission. This -recommendation will be available twenty-four (24) hours before the scheduled hearing. It is the responsibility of the
applicant to_call the Department of Planning Services' office before the Planning Commission hearing to make arrangements to obtain the
recommendation.
