HomeMy WebLinkAbout961596.tiff BEFORE THE WELD COUNTY, COLORADO, PLANNING COMMISSION RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS Moved by Marie Koolstra that the following resolution be introduced for passage by the Weld County Planning Commission. Be it resolved by the Weld County Planning Commission that the application for: • CASE NUMBER: USR-1121 NAME: Anthony Gasparovich E _� ADDRESS: 19281 195th Ave. Hudson, Co. 80642 REQUEST: A Site Specific Development Plan and a Special Review Permit for an accessory building larger than 1500 square feet(3750 sq. ft.)to be used as storage for farm equipment and to house farm animals in the A(Agricultural)zone district. LEGAL DESCRIPTION: Lot 5 in Vantage Acres Subdivision, Third Filing, located in part of the S2 of Section 17, T1 N, R65W of the 6th P.M., Weld County, Colorado. LOCATION: North of and adjacent to 195 Ave., east of Western Drive, west of Vantage Drive. be recommended favorably to the Board of County Commissioners for the following reasons: 1. The submitted materials are in compliance with the application requirements of Section 24.7 of the Weld County Zoning Ordinance, as amended. 2. It is the opinion of the Planning Commission that the applicant has shown compliance with Section 24.3 of the Weld County Zoning Ordinance, as amended, as follows: a. This proposal is consistent with the Weld County Comprehensive Plan's Agricultural Goals and Policies. This land use is locating within the Urban Growth Boundary area of the Town of Hudson. The Urban Growth Boundary area section provides for the county to encourage land use development proposals as long as they conform to the desires of affected municipalities. The Town of Hudson recommends approval of this request. b. The proposal is consistent with Section 24.3.1.3 of the Weld County Zoning Ordinance, as amended, and is compatible with the intent of the A (Agricultural)zone district. The use is provided for as a Use by Special Review. c. The proposal is consistent with Section 24.3.1.4 of the Weld County Zoning Ordinance, as amended and will be compatible with future development of the surrounding area. d. No overlay districts affect this site. e. Special Review Permit Development Standards will provide adequate protection of the health, safety, and welfare of the neighborhood and county. 961596 RESOLUTION, USR-1121 Anthony Gasparovich Page 2 This recommendation is based, in part, upon a review of the application materials submitted by the applicant, other relevant information regarding the request, and responses from referral entities. The Planning Commission's recommendation for approval is conditional upon the following: 1. The attached Development Standards for the Special Review Permit shall be adopted and placed on the Special Review Plat prior to recording the plat. The completed plat shall be delivered to the Department of Planning Services within 15 days of approval by the Board of County Commissioners. 2. The Special Review activity shall not occur nor shall any building or electrical permits be issued on the property until the Special Review plat is ready to be recorded in the office of the Weld County Clerk and Recorder. 3. Prior to recording the plat: A. All accesses shall be clearly delineated on the plat. B. The applicant shall adhere to the application requirements for the Vicinity Map and Plot Plan Map stated in Section 24.7.4 Special Review Permit Map in the Weld County Zoning Ordinance, as amended. 4. The Special Review activity shall not be used on any basis as a dwelling or as overnight or temporary housing for any person. 5. The Special Review activity shall not be used on any basis for commercial or industrial uses. Motioned seconded by Arlan Marrs. Dated the 6th of August, 1996. Jill Boshinski Secretary 4Ri cam. SITE SPECIFIC DEVELOPMENT PLAN SPECIAL REVIEW PERMIT DEVELOPMENT STANDARDS Anthony Gasparovich 1. The Site Specific Development Plan and Special Use Permit is for an accessory building larger than 1500 square feet ( 3750 sq. ft.) in the A (Agricultural) zone district as indicated in the application materials on file in the Department of Planning Services and subject to the Development Standards stated hereon. 2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld County Zoning Ordinance, as amended. 3. The Special Review activity shall utilize the existing residential/agricultural access. No additional accesses shall be granted as stated in a referral from Weld County Public Works dated July 9, 1996. 4. All construction on the property shall be in accordance with the requirements of the Weld County Building Code Ordinance. 5. The property owner or operator shall be responsible for complying with the Design Standards of Section 24.5 of the Weld County Zoning Ordinance, as amended. 6. The property owner or operator shall be responsible for complying with the operation Standards of Section 24.6 of the Weld County Zoning Ordinance, as amended. 7. During construction, no materials shall be stockpiled nor vehicles stored on County roads. All materials and vehicles shall be contained on the site or on adjacent properties. 8. Personnel from the Weld County Health Department and Weld County Department of Planning Services shall be granted access onto the property at any reasonable time in order to ensure the activities carried out on the property comply with the Development Standards stated hereon and all applicable Weld County Regulations. 9. The Special Review area shall be limited to the plans shown hereon and governed by the foregoing standards and all applicable Weld County regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. 10. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Weld County Planning Commission. 961596 Hello
