RESOLUTION RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL ACTION AGAINST TIM AND REUBEN BERNHARDT FOR VIOLATION OF THE WELD COUNTY ZONING ORDINANCE WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Tim and Reuben Bernhardt, VI #96000844, are allegedly in violation of the Weld County Zoning Ordinance, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 14th day of May, 1996, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Tim Bernhardt and Reuben Bernhardt, property owners, were present at said hearing, and WHEREAS,the Board of County Commissioners deems it advisable to delay referral of said violation to the Weld County Attorney's Office for a period of sixty (60) days to allow adequate time for the property owners to submit a completed Flood Hazard Development Permit application, and WHEREAS, the Board deems it advisable to proceed with legal action against the above named individuals without further Board action if said permit is not approved and subject property is not brought into compliance. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that if property owners fail to submit said permit application by July 15, 1996, the Weld County Attorney be, and hereby is, authorized to proceed with legal action against Tim and Reuben Bernhardt to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties. 960844 PL0824 VIOLATIONS -VI #9600013 - BERNHARDT PAGE 2 The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 14th day of May, A.D., 1996. Based on the information you provided, this office has determined that your work within Colorado can be authorized by the Department of the Army Nationwide Permit found at 33 CFR Part 330 Appendix A, (B)(26). Enclosed is a fact sheet which fully describes this Nationwide Permit and lists the General and Section 404 only conditions which must be adhered to for this authorization to remain valid. Although an Individual Department of the Army permit will not be required for the project, this does not eliminate the requirement that you obtain any other applicable federal, state, tribal, or local permits as required. Please note that deviations from the original plans and specifications of your project could require additional authorization from this office. You are advised that this verification of the nationwide permit authorization is valid until January 27, 1997. I am not sure if the property in question is in a wetland or stream, but I am enclosing an air photo and a copy of the Flood Map for the property in question, Panel#080266-750C,dated September 28, 1982. I am also enclosing a copy of the full legal description of the property;the general legal description is the W2/SW4 of Section 18,Township 4N, Range 66W of the 6th P.M.,Weld County, Colorado. The property owner is Herbert B. Bernhardt, 11814 Weld County Road 46, Milliken, CO 80543. Their telephone number is 970-587-4259. • The problem is that Mr. Bernhardt has built a dike, 12-15 feet in height, around a plowed farm field on his property. The adjacent property owners are very concerned because they are in the 100 Flood Plain and last year they had considerable flooding on their property. The adjacent property owner is John Mauzy and he would be a good contact person because the dike is difficult to access. I contacted Mr. Mauzy and he drove me to the area in question in his four wheel drive truck. We inspected the dike from his property,which is directly south of the dike. This is a violation of Section 53, which states the purpose of the floodplain regulations: 53.2.1 To protect human life 53.2.3 To insure that those who occupy FLOOD HAZARD AREAS assume responsibility for their actions 53.2.7 To promote the public health, safety and general welfare 53.2.10 In order to accomplish its purposes, this Ordinance includes methods and provisions for: 53.2.10.1 Restricting or prohibiting USES which are dangerous to health, safety, and property due to water or erosion hazards, or which result in damaging increases in erosion or in FLOOD heights or velocities; 53.2.10.3 Controlling the alteration of natural FLOOD PLAINS, stream channels, and natural protective barriers, which help accommodate or channel FLOOD waters; 53.2.10.4 Controlling filling, grading, dredging, and other DEVELOPMENT which may increase FLOOD damage; and 53.2.10.5 Preventing or regulating the construction of FLOOD barriers which will unnaturally divert FLOOD waters or which may increase FLOOD hazards in other areas.
