RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT'
#1221 FOR A RECREATIONAL FACILITY (SHOOTING RANGE) IN THE
A (AGRICULTURAL) ZONE DISTRICT - PAWNEE SPORTSMANS CENTER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners held a public hearing on the 26th day
of May, 1999, at the hour of 10:00 a.m. in the Chambers of the Board for the purpose of
hearing the application of Pawnee Sportsmans Center, % Allen Rechnagel, for a Site Specific
Development Plan and Special Review Permit#1221 for a Recreational Facility (Shooting
Range) in the A (Agricultural) Zone District on the following described real estate, to-wit:
All of Sections 1 and 12, Township 7 North,
Range 63; the SW114 of Section 6, Township 7,
Range 62; and part of Section 7, Township 7 North,
Range 62; all lying West of the 6th P.M., Weld
County, Colorado
WHEREAS, said applicants, Tim Brough, Richard Beck, and Allen Rechnagel, were at
said hearing, and
WHEREAS, Section 24.4.2 of the Weld County Zoning Ordinance provides standards
for review of said Special Review Permit, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Weld County Planning Commission and all of the exhibits and evidence presented in this
matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Board of County Commissioners that the applicant has
shown compliance with Section 24.4.2 and 45.3 of the Weld County Zoning
Ordinance as follows:
A. Section 24.4.2.1 -- This proposal is consistent with the Weld County
Comprehensive Plan. The soils on the subject property are defined as
prime if irrigated, high potential dry cropland and other ground by the
U. S. D. S.; however, the application proposes to utilize the least
productive portions of the property. Additionally, the proposed shooting
ranges will not interfere with surrounding agricultural practices and should
the Use by Special Review Permit be abandoned in the future, the site
could easily be incorporated back into agricultural production as the
application proposes minimal improvements.

B. Section 24.4.2.2 -- This proposal is consistent with the intent of the
A (Agricultural) Zone District. Section 31.4.3 of the Weld County Zoning,
Ordinance allows for recreational facilities, including shooting ranges, as
a Use by Special Review in the A (Agricultural) Zone District.
C. Section 24.4.2.3 -- The proposal will be compatible with the existing
surrounding land uses. The 1,720-acre site is surrounded by agricultural
uses on all sides and the nearest neighboring residence is located
approximately 1.3 miles north of the northern property boundary.
Additionally, as is required by Section 45.3.3.2, the proposal takes
advantage of natural terrain barriers when possible.
D. Section 24.4.2.4 -- The proposed uses will be compatible with future
development of the surrounding area as permitted by the A (Agricultural)
Zone District and with the future development as projected by the
Comprehensive Plan or Master Plan of affected municipalities. The
subject property is located approximately 3% miles southwest of the
unincorporated community of Briggsdale. The property consists of 1,720
acres, with the nearest neighboring residence located approximately 1.3
miles north of the northern property boundary.
E. Section 24.4.2.5 -- The proposal is not located within the Overlay Distric:
Areas identified by maps officially adopted by Weld County.
F. Section 24.4.2.6 -- The applicant has demonstrated a diligent effort to
conserve productive agricultural land. The application proposes to utilize
the least productive portions of the property.
G. Section 24.4.2.7 -- The Design Standards (Section 24.5 of the Weld
County Zoning Ordinance), Operation Standards (Section 24.6 of the
Weld County Zoning Ordinance), Conditions of Approval, and
Development Standards ensure that there are adequate provisions for
the protection of the health, safety, and welfare of the inhabitants of the
neighborhood and County.
H. Section 45.3 -- The attached Conditions of Approval and Development
Standards ensure that the operation maintains compliance with the
supplemental regulations as set forth in Section 45.3 of the Weld County
Zoning Ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the application of Pawnee Sportsmans Center for a Site Specific
Development Plan and Special Review Permit#1221 for a Recreational Facility (Shooting
Range) in the A (Agricultural) Zone District on the hereinabove described parcel of land be, and
hereby is, granted subject to the following conditions:

1. The attached Development Standards for the Special Review Permit shall be
adopted and placed on the Special Review Plat prior to recording the plat. The
completed plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder's Office within 15
days of approval by the board of County Commissioners.
2. The northern access point, which accommodates the proposed 200-yard
rifle/pistol, archery and sporting clays ranges and the 600-yard rifle range, shall
require a 15-inch CMP culvert approximately 30 feet in width.
3. Prior to recording the plat:
A. The plat shall be amended to reconfigure the 200-yard rifle/pistol range n
a northeasterly direction and not parallel to Weld County Road 71. A
safety zone shall be designated on the plat to identify the distance
between Weld County Road 71 and the berm.
B. The applicant shall submit a proposed Parking and Circulation Plan to the
Department of Planning Services for review. Upon approval by the
Department of Planning Services, the parking areas shall be delineated
on the plat. The Plan shall address and delineate the following:
1) Adequate parking for maximum proposed users at each range
area.
2) Adequate turn-around area for proposed semi tractor-trailer
delivery truck.
3) Traffic circulation to the 600-yard range.
4) Both access points shall be recessed from Weld County Road 71
to accommodate at leash one vehicle to open the locked gates.
5) The southern access point located at the crest of the hill with
adequate sight distance in both directions.
C. The applicant shall submit a Landscaping Plan to the Department of
Planning Services for review and approval. In accordance with Section
45.3.3.4, the perimeter of range shall be landscaped to provide natural
noise barriers. The remainder of the range shall be planted and
maintained with grass or other suitable ground cover.
D. The applicant shall meet with the Weld County Department of Public
Works to determine whether both of the agricultural access points
(labeled C and E on the plat) north of the northern shooting range access
point will be closed or only utilized when the 200-yard range is being
used. If the accesses remain open, the applicant shall indicate the
method of closing these accesses during use of the 200-yard range. The
applicant shall submit evidence of approval by the Department of Public
Works to the Department of Planning Services.

E. The applicant shall submit evidence to the Department of Planning
Services that all issues pertaining to land under Conservation Reserve
Program Contract have been addressed.
F. The applicant shall submit evidence to the Department of Planning
Services that the concerns of the Briggsdale Fire Protection District have
been addressed and/or that a good faith effort has been made.
G. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plal
is ready to be recorded in the office of the Weld County Clerk and
Recorder.
4. Prior to the release of building permits:
A. The applicant shall include foundation and structural drawings prepared
by an engineer or architect licensed by the State of Colorado in the
building permit application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 26th day of May, A.D., 1999.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS
PAWNEE SPORTSMANS CENTER

1. The Site Specific Development Plan and Special Use Permit is for a Recreational Facility
(Shooting Range) in the A (Agricultural) Zone District, as indicated in the application
materials on file in the Department of Planning Services and subject to the Development
Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to Section 90 of the Weld
County Zoning Ordinance.
3. The site shall maintain compliance with the supplemental regulations as set forth in
Section 45.3 of the Weld County Zoning Ordinance at all times. Notwithstanding the
foregoing statements, shooting backstops and berms shall be constructed according to
National Rifle Association standards, detail drawings of which shall be submitted to the
Board of County Commissioners for its approval.
4. All activities at this site shall comply with the rules and regulations of the National Skeet
Shooting Association,the American Trap Association, and the Colorado Division of Wildlife.
5. The site shall use only non-toxic, biodegradable clay targets.
6. All liquid and solid wastes shall be stored and removed for final disposal in a manner that
protects against surface and groundwater contamination.
7. No permanent disposal of wastes shall be permitted at this site.
8. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive
dust, blowing debris, and other potential nuisance conditions.
9. Fugitive dust shall be controlled on this site.
10. The maximum permissible noise level shall not exceed the industrial limit of 80 db(A), as
measured according to Section 25-12-102, C.R.S. Enforcement of the provision will occur
only in accordance with Section 25-12-109(3)(a), C.R.S.
11. An individual sewage disposal system is required for any private residence according to the
Weld County Individual Sewage Disposal regulations.
12. Adequate toilet facilities shall be provided for patrons of the facility. This includes access
to the clubhouse and shop building during overnight events.
13. Individual sewage disposal systems are required for the two proposed clubhouses/shop
buildings. The septic systems shall be designed by a Colorado Registered Professional
Engineer according to the Weld County Individual Sewage Disposal Regulations. The
systems shall be appropriately designed to allow for the hydraulic load for day-to-day
business, as well as temporary, overnight events.

14. Port-a-Pottys may be utilized to supplement the toilet facilities in the clubhouses temporarily
for large groups.
15. If more than five acres are disturbed during construction, the applicant shall obtain a
Stormwater Discharge Permit from the Colorado Department of Public Health and
Environment, Water Quality Control Division.
16. The water system shall comply with the requirements for a non-community water system
as defined in the Primary Drinking Water Regulations (5 CCR 1003-1).
17. No staging or parking shall be allowed on Weld County Road 71.
18. The applicant shall apply dust suppressant control on an area from 150 feet north of the
residence to 150 feet south of the corrals on Weld County Road 71 adjacent to the
residence located approximately 1.3 miles to the north of the property as determined by
the Weld County Public Works Department, at a minimum of two (2) times per year.
19. A locked gate at the two main entrances to the site shall be maintained during closed hours.
20. Warning signs shall be posted every 200 feet around each designated range safety zone,
as well as along Weld County Road 71. Fencing and signs shall be maintained by the
owner.
21. The hours of operation for shooting events shall be posted at the two main entrances and
shall be, as proposed in the application materials, as follows: 7:00 a.m. to 9:00 p.m, seven
days per week.
22. In accordance with Weld County Ordinance#85, special events and tournaments involving
more than 200 visitors shall require a Temporary Assemblage Permit from the Clerk to the
Board of County Commissioners office. The applicant shall be responsible for hiring
adequate security and other personnel to oversee the event.
23. Overnight camping shall be limited to two consecutive nights, and only self-contained
campers shall be allowed.
24. No concession or cooking facilities were reviewed as part of this application. Should the
applicant choose to add a concession or cooking facility in the future, such use shall be
reviewed by the Weld County Department of Public Health and Environment, Weld County
Building Inspection Department and any other appropriate County or State agency. The
applicant shall be required to obtain all appropriate permits and comply with all appropriate
regulations.
25. The design of the site (i.e. trap and skeet layouts, bullet stops, firing points, safety ranges,
etc.) shall maintain compliance with the supplemental regulations as set forth in
Section 45.3 of the Weld County Zoning Ordinance at all times. No portion of the Use by
Special Review Permit area which is required to maintain a safety buffer or other Condition
of Approval shall be allowed to be excluded from this application.

26. In accordance with Section 45.3.1, a Special Review Permit to operate an outdoor shooting
range may be conditioned on a requirement that every ten (10) years the safety of the
design of the range shall be reviewed and safety design changed taking into account the
history of the operation and changes in surrounding land uses and the relevant provisions
of Sections 45.3.2.2, 45.3.3.2 through 45.3.3.6, and 45.3.4 of the Weld County Zoning
Ordinance. Review of the Safety Plan shall be accomplished using the Site Plan Review
Process and such changes shall not constitute a major change from the Special Review
Permit. The operator, if he chooses not to accept the staff determination under the Site
Plan Review process, may request that the matter be determined by the Board of County
Commissioners who shall hear the matter in accordance with the procedures for
considering a Special Review Permit; provided, however, that no fee shall be charged.
27. Line of fire shall be as nearly horizontal as is practicable and never below horizontal.
Ranges may be constructed so that the firing point is below the target, provided the
gradient between the firing point and target does not exceed 2 percent.
28. If the shooting range is used by more than four (4) individuals on a regular basis, shooting
shall be supervised by a range officer or instructor qualified by the National Rifle
Association or military service or other similar training.
29. A sign shall be posted at the two main entrances stating, "No alcohol is allowed at this
facility. Anyone found to be in possession of alcohol will be asked to leave immediately."
30. The property owner or operator shall be responsible for complying with the Design
Standards of Section 24.5 of the Weld County Zoning Ordinance.
31. The property owner or operator shall be responsible for complying with the Operation
Standards of Section 24.6 of the Weld County Zoning Ordinance.
32. Personnel from the Weld County Departments of Public Health and Environment and
Planning Services shall be granted access onto the property at any reasonable time in
order to ensure the activities carried out on the property comply with the Development
Standards stated hereon and all applicable Weld County regulations.
33. The Special Review Permit area shall be limited to the plans shown hereon and governed
by the foregoing standards and all applicable Weld County regulations. Substantial
changes from the plans or Development Standards as shown or stated shall require the
approval of an amendment of the Permit by the Weld County Board of County
Commissioners before such changes from the plans or Development Standards a-e
permitted. Any other changes shall be filed in the office of the Department of Planning
Services.
34. The property owner or operator shall be responsible for complying with all of the foregoing
Development Standards. Noncompliance with any of the foregoing Development Standards
may be reason for revocation of the Permit by the Board of County Commissioners.
