RESOLUTION
RE: APPROVE REVISIONS TO FEE SCHEDULE FOR FEES COLLECTED BY THE WELD
COUNTY DEPARTMENT OF PLANNING SERVICES FOR PROCESSING AND
REVIEWING LAND-USE PERMIT APPLICATIONS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 20th day of May, 1996, at 9:00 a.m., in the
Chambers of the Board for the purpose of considering a revision to the fee schedule by increasing
fees collected by the Weld County Department of Planning Services; specifically, increasing the
fee for processing and reviewing the application for a Zoning Permit for a Mobile Home from
$200.00 to $230.00, and
WHEREAS, at said public hearing the Board also considered amending the land-use
application fee schedule by adding Item #25 for an application for amendments to an existing
Special Review Permit for a Solid Waste Disposal Site and Facility, as described in Exhibit A
attached hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board deems it advisable to approve the proposed
amendments to the fee schedule, which were approved by the Planning Commission on March 19,
1996, and May 7, 1996, to be effective immediately upon passage of this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the fee for processing and reviewing the application for a Zoning Permit for
a Mobile Home be, and hereby is, increased from $200.00 to $230.00, effective May 20, 1996.
BE IT FURTHER RESOLVED by the Board that the amendment to the land-use application
fee schedule adding Item #25 for an application for amendments to an existing Special Review
Permit for a Solid Waste Disposal Site and Facility, as described in the attached Exhibit A, be, and
hereby, is approved, effective May 20, 1996.

AMEND THE DEPARTMENT OF PLANNING SERVICES LAND-USE APPLICATION FEE
&mend the existing application fees schedule by adding item#25 for amendments to an existing
Special Review Permit application for a Solid Waste Disposal Site and Facility.
The fee to amend an application for a Special Review Permit for Solid Waste Disposal Sites and
Facilities shall not exceed $17,114.00. The full amount shall be submitted to the Department of
Planning Services at the time a complete application is submitted. The full amount shall be
escrowed and charged against by the county based on the standard hourly rate for each
department administering or reviewing the permit. The departments shall include but not be
limited to the Department of Planning Services, Weld County Health Department, and Weld
County Public Works. The standard Hourly rate shall be established by the Weld County Finance
Department for the actual time spent on the review of the application and facility. The applicant
shall be provided copies of the billing five days prior to the cost actually being billed against the
escrow account and the applicant. The applicants sole remedy to appeal any billing shall be to
the Board of County Commissioners. The unused portion of the submitted application fee held
in escrow, shall be returned to the applicant within 30 days of recording the amended Special
Review plan map, or within 30 days after a denial of the application by the Board of County
Commissioners, or 30 days after the applicant submits a written request to withdraw the
application.

The Board of County Commissioners of Weld County, Colorado, will conduct a public hearing at 9:00
a.m., on Monday, May 20, 1996, in the Chambers of the Board of County Commissioners of Weld
County, Colorado, Weld County Centennial Center, 915 10th Street, First Floor, Greeley, Colorado,
for the purpose of considering an increased fee schedule for fees collected by the Weld County
Department of Planning Services.
All persons in any manner interested are requested to attend said hearing and may be heard.
Should any interested party desire the presence of a court reporter to make a record of the
proceedings, in addition to the taped record which will be kept during the hearing, the Clerk to the
Board shall be advised in writing of such action at least five days prior to the hearing. The cost of
engaging a court reporter shall be borne by the requesting party.
Please contact the Clerk to the Board's Office at phone (970) 356-4000, Extension 4226, or fax
(970) 352-0242 prior to the day of the hearing so that reasonable accommodations can be made if,
in accordance with the Americans with Disabilities Act, you require special accommodations in order
to participate in this hearing as a result of a disability.

RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Arlan Marrs that the following resolution be introduced for passage by the Weld County Planning
Commission. Be it resolved by the Weld County Planning Commission that the request for:

Review Permit application for a Solid Waste Disposal Site and Facility.
be recommended favorably to the Board of County Commissioners for the following reasons:
The existing fee schedule requires that the entire fee of$17,114.00 be collected prior to processing an amendment to
a Special Review Permit for a Solid Waste Disposal Site and Facility. This amendment to the fee schedule is to take
into account that the review of an amendment of this type may not take as much staff time to process as a new
application.
AMEND THE DEPARTMENT OF PLANNING SERVICES LAND-USE APPLICATION FEE
Amend the existing application fees schedule by adding Item#25 for amendments to an existing Special Review Permit
application for a Solid Waste Disposal Site and Facility.
The fee to amend an application for a Special Review Permit for Solid Waste Disposal Sites and Facilities shall not
