Box 758 Greeley, CO 80632 RE: Amendment of Recorded Exemptions for Rampey, Morehouse and Gonzales Dear Ladies and Gentlemen: I am writing this letter on behalf of Edward Rampey and Beverly Rampey and Brian Morehouse and Doria Morehouse . Attorney Robert Ray joins in this letter on behalf of his client, Luis Gonzales . These people are currently involved in litigation concerning the common boundary line between Mr. Gonzales on one side and the Rampeys and the Morehouses on the other side . I have attached a copy of the Complaint filed in Weld County District Court which spells out in more detail the factual basis of the lawsuit . Over 20 years ago, an 80-acre parcel was divided into four approximately equal parcels. I have attached as Exhibit A the survey from that dividing for your convenience . A boundary fence was placed between the property owned by Mr. Gonzales ' predecessors (N ',4 of the NW . of the NW 24 of Section 3 , Township 2, R67 West) and the Rampeys and Morehouses predecessors (S W of the NW '4 of the NW '/4 , Section 3 , Township 2, R67 West) . The two most northerly parcels belonged to these parties ' predecessors . At least one of the 20-acre parcels was erroneously described, and the description did not match the fenced boundaries. The document attached to this letter as Exhibit B shows the Rampey and Morehouse property, Recorded Exemption N° 1311-3-2-RE 722 . This is a plat of the S ≤ of the NW 1% of the NW Cor, Sec 3, T2 , NR67 West . The Morehouses now own Lot A as depicted on the plat and the Rampeys now own Lot B as depicted on the plat . Gonzales ' property is to the north of the Rampeys and Morehouses . Exhibit C is the plat of a survey prepared in 1993 for Billy Marlan Rice, Jr. , Mr. Gonzales ' predecessor. According to this survey, Mr. Gonzales ' southern boundary line is approximately 116 feet further south than the historical fence line . The parties have reached an agreement to remove the new fence erected by Mr. Gonzales and recognize the historical fence line as the actual boundary between the properties . This will require amendment of both recorded exemptions. The amount of land involved in dispute is less than two acres (approximately 75, 168 feet) . The sole purpose of seeking to amend the recorded exemptions will be to restore the status quo and to have the county records accurately reflect the actual boundaries of the properties . The amended plats will correct erroneous plats based on erroneous descriptions . The Rampeys, Morehouses, and Gonzales are asking the County Commissioners for a waiver of the application and any related fees associated with filing for an amended exemption based upon the financial hardship this dispute has already caused these parties . The problem is not of the parties own making it arises from an erroneous description prepared in 1971 and which now requires correction. Accordingly, the parties respectfully request that the Board of County Commissioners grant them a waiver of all fees required in connection with filing their application for amendment to their recorded exemptions .
