HomeMy WebLinkAbout650011.tiffRESOLUTION WHEREAS, a public hearing was held in the Weld County Court House on February 1, 1965 concerning the request of Jim Ord to re -zone an area hereinafter described from R (Residence) to B (Business), and, WHEREAS at said hearing it was ascertained that there were six parties present who favored the change and only two of whom were property owners in the area, and, WHEREAS, at said hearing it was ascertained that there were eighteen parties present who were against the change, all of whom were property owners in the immediate vicinity, and, WHEREAS, in addition the Commission had two letters stating opposition to said change from persons owning property in the immediate vicinity, and, WHEREAS, the area that was sought to be changed was one mile from Highway #34 where presently there is located two shopping centers, one proposed shopping center and one discount center, and, WHEREAS, the area is also one mile from the proposed By -Pass of Highway #34, and, WHEREAS, said area is adjacent to 35th Avenue which is a highly congested avenue due to the West Greeley High School and will continue to be congested with the future expansion of said school facility, and, WHEREAS, the area borders on the east to a planned drainage and park area being developed by the City of Greeley, and, WHEREAS, the immediate area to the North and South of the proposed zoing change area is now residential, and, WHEREAS, to the North of this proposed zoning change area, 20th Street West is to carry traffic to the new school, Elks Building, American Legion, Municipal Golf Course, residential -1- 650011 area and Episcopal Church, and, WHEREAS, the representatives of the petitioner also stated at the hearing that the area was not to be developed for a period of two to three years, and, WHEREAS, the representatives of the petitioner further stated that they would have to draw business from previously established and zoned areas for shopping centers, and, WHEREAS, the Commission feels that with a business arterial street one mile north and one mile south of the said proposed zoning change area, that this area should remain as residential property. NOW THEREFORE, BE IT RESOLVED that the petition of Jim Ord for the re -zoning of the area herein described from R (Residential) to B (Business), to -wit: That part of the Northwest Quarter (NW 1/4) of Section 13, Town- ship 5 North, Range 66 West of the 6th P. M., Weld County, Colo- rado, more particularly described as follows: Beginning at the Northwest Corner of said Section 13; thence east along the North line of said Section 13 a distance of 775.8 feet more or less to a point; thence south and parallel to the west line of said Sec- tion 13 a distance of 987.5 feet more or less to a point; thence 541°18'50"W 422.0 feet to a point; thence west and parallel to the north line of said Section 13 a distance of 430.2* feet to a point which is the centerline of 35th Avenue; thence north along the west line of said section 13 also being the centerline of 35th Avenue a distance of 1309.67 feet to the point of begin- ning -2- shall be and is hereby denied and not recommended based upon each and every statement herein made.
