RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST GABINO AND ROGER LARA/JOHN UNDERHILL FOR VIOLATION
OF THE WELD COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Gabino and Roger Lara/John Underhill, VI#9800104, are allegedly in
violation of the Weld County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of September, 1998, a public hearing was held before the
Board of County Commissioners for the purpose of hearing testimony relating to said violation,
and
WHEREAS, Gabino Lara, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Weld County Attorney's Office for legal action, with an instruction for delay of
action upon such referral until October 8, 1998, to allow adequate time for the property owners to
make significant progress towards bringing the subject property into compliance. If significant
progress is being made, the County Attorney is instructed to further delay action until
November 9, 1998, to allow the applicant to bring the property completely into compliance and for
an inspection of the property to be conducted by the Department of Planning Services.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that said violation be, and hereby is, referred to the Weld County Attorney's
Office for legal action against Gabino and Roger Lara/John Underhill to remedy the violation of
the Weld County Zoning Ordinance, and any other persons occupying the properties, any
persons claiming an interest in the properties, and any persons acting in active concert with the
identified parties, with an instruction for delay of action upon such referral until October 8, 1998,
to allow adequate time for the property owners to make significant progress towards bringing the
subject property into compliance. If significant progress is being made, the County Attorney is
instructed to further delay action until November 9, 1998, to allow the applicant to bring the

CASE SUMMARY
July 12, 1998 Initial complaint received. Information included the operation of a commercial activity
(the sale of railroad ties) in the A(Agricultural)zone district, numerous vehicles entering
the property to purchase the railroad ties, and the advertisement in the Greeley Tribune
stating the ties were for sale.
July 12, 998 Copy of the advertisement from the Greeley Tribune. [Railroad ties for sale, 330-1563
between 4-8 p.m.] Sharyn Frazer, Zoning Compliance Officer called the number and
reached an answering machine with a message that stated "you have reached Roger
and proceeded to advertise the sale of railroad ties.
July 16, 1998 Site inspection conducted. The gate was closed at the entrance to the site, but railroad
ties were stockpiled on the property. I did not observe anyone working at the site, nor
any vehicles.
July 16, 1998 Thirty day letter sent. Mr.John Underhill is still listed as the property owner so copies
of the letter were sent to both Gabino and Roger Lara and Mr. Underhill.
August 6, 1998 Progress inspection conducted. A Planning Department notice was left on the gate
asking the operators to contact Sharyn Frazer as soon as possible. A copy of the aerial
map was made to determine exactly which property the ties were being stored on.
August 13, 1998 Telephone called between Gabino Lara and Sharyn Frazer. Mr. Lara explained that
Roger is no longer selling the railroad ties from the property. I explained to Mr. Lara
that I had a copy of the advertisement from the Greeley Tribune and that due to the
numerous complaints received by the Department of Planning Services, it was
recommended that he attend the hearing and speak with the Board.
August 13, 1998 Telephone call between John Underhill and Sharyn Frazer. The same information that
was given to Mr. Lara, was also given to Mr. Underhill (see above). Mr. Underhill
stated that he would plan to attend the hearing.
August 13, 1998 Letter sent to both Gabino and Roger Lara and John Underhill reiterating exactly which
property the railroad ties are being stored on. The exact parcel number is 1469 17
000028. I reminded both parties that this violation case has been referred to the Board
of County Commissioners on September 8, 1998.

August 28, 1998 Memo to the file from Sharyn Frazer. Due to the number and frequency of complaints
received in the Department of Planning Services, it has been determined that this case
be presented before the Board of County Commissioners.
September 3, 1998 Pictures of the site were taken with the digital camera.
The commercial sale of railroad ties is not a use allowed in the Agricultural zone district. Therefore is a violation
of Section 31.2 and 31.3.9 of the Weld County Zoning Ordinance.
The Department of Planning also recommends that the County Attorney be authorized to proceed with legal
action against any other persons occupying the properties, any persons claiming an interest in the properties, and
any persons acting in active concert with the identified parties.
Copies of the violation materials are available at the Department of Planning Services' office or the Weld County
Attorneys Office.

I have received approximately 20-25 phone calls from surrounding property owners in the area, complaining
about the sale of railroad ties occurring on this property. I have conducted numerous site inspections, but have
not been able to observe any activity taking place. I have sent written correspondence to both parties and have
left numerous notices on the fencing surrounding the property.
I have been able to speak with both Gabino Lara and John Underhill by telephone, and they both state that they
will appear at the Board of County Commissioners' Violation Hearings on September 8, 1998, at 10:00 a.m.
Due to the number and frequency of complaints, I feel we should proceed with this case at the hearings.

As I explained in my letter dated July 16, 1998, the uses on the above described property are being considered
as a zoning violation of Sections 31.2 and 31.3.9 of the Weld County Zoning Ordinance. I have corrected the
legal description, based on a site inspection of the property, as stated above. The Assessor's files indicate that
the property is owned by Mr. Underhill.
I have scheduled a meeting with the Board of County Commissioners on September 8, 1998 at 10:00 a.m., to
consider the violations occurring on the property. This meeting will take place in the County Commissioners'
Hearing Room, first floor, Weld County Centennial Center, 915 Tenth Street, Greeley, Colorado. It is
recommended that you or a representative be in attendance to answer any questions the Board of County
Commissioners might have about the violations.
The Department of Planning Services' staff will be recommending that the Board of County Commissioners
authorize the County Attorney to proceed with legal action to remedy the violation. Our records indicate that
you were made aware of the nature of the violation, the action necessary to correct the violation, and that you
were given sufficient time to remedy the violation. If you have any questions concerning this matter, please call

It is the intention of this office to assist and cooperate with you without imposing undue hardships; however, we
