RESOLUTION /_/
WHEREAS, a public hearing was held on Wednesday, March 8,
1967 at 1:30 P.M. in the chambers of the Board of County Commissioners
of Weld County at Greeley, Colorado for the purpose of hearing
the petition of Robert Helmer and Alida Helmer, Route 4, Emporia,
Kansas, requesting a change of zone in the West Greeley District
from "A" Agriculture to "M -H" Mobile Home District, and
WHEREAS, Mr. Robert Helmer was
present

by
his attorney, Robert A. Ruyle, of Greeley, Colorado,
WHEREAS, there was no one present in opposition to the change
of zone, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements from those present, and
WHEREAS, the Board of County Commissioners has studied the
request of the petitioners and studied the recommendations of the
Weld County Planning Commission as submitted on February 7, 1967,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS that the petition of Robert Helmer and Alida Helmer,
Route 4, Emporia, Kansas, for change of zone in the West Greeley
District from "A" Agriculture to "M -H" Mobile Home District, said
area being more particularly described as follows:
Tracts 3 and 4 of the Anders and Frances Anderson farm
located in the WZ of the SW+ of Section 24, Township 5
North, Range 66 West of the 6th P.M., Weld County, Colo-
rado, consisting of 15.55 acres more or less,
is hereby granted under the conditions following:
1. Any water and sanitation facilities to be installed shall
be approved by the State Health Department.
2. All applicable subdivision regulations, zoning regu-
lations and mobile home and mobile home park regulations
shall be followed and complied with to the satisfaction
of the Board of County Commissioners of Weld County.

Chairman Anderson: We will call the hearing to order. Mr. Telep will you
read the notice.
Mr. Telep, County Attorney read the legal notice that appeared in the
Greeley B000ster, the legal paper for Weld County, tolorado.
Chairman Anderson: Let it be on record that the Planning Commission has all
the maps and plats.
Mr. Helmer: The area where we are requesting the change of zone is located
from 35th Avenue about 700 feet north of Ninth Street out of Evans, which
is approximately 3/4 of a mile south of the Elks Club on the east side of
the road.
Mir. Dunbar: Mr. Helmer, why don't you explain what you are going to do.
Mr. Helmer: here is the blue print of it. We have 15.55 acres in the tract
with 97 spaces platted for the tract. We will own these spaces. We will
put in all the improvements which will be paved streets, curb and gutter,
sidewalks and the utilities. We will maintian these utilities and the
spaces will be rented they will not be for sale. We will have an office
service center and there will be someone in this office to keep a record
of the motor court. If somebody movesin there will be a record of
who they are and where they came from and everything at the office
available to any authorized person who should be desirous of the information.
Mr. Dunbar: Are you planning on developing all of the

Mx. Dunbar: What about sanitation?
Mr. Helmer: At the Planning Commission I have had Mr. Paul Radasch of the
engineering firm of Nelson, Haley, Patterson and Quirk - design a septic
system which the county health officer approved, which we don't anticipate
to use. If there is any way possible we hope to get on the Evans District.
We have figured in the cost of building this,if something unforseen
happens and we can't then we will loose this section ( pointsout
area on map) of the trailer spaces on this end of our park where
our leach feud will be for septic tanks. And even if we do have to
go on that the system will still be designed to hook to a city system
when one is available. The only reason we won't connect to one of
these sewer districts is if they won't let us. Our water will come
from the Central Weld Water District from the south.
Chairman Anderson: Where the new pipeline is coming in.
Mr. Helmer: Yes.
Chariman Anderson: Do you have anything special you would like to
ask Harold?
Harold Anderson: This is north 9th Street of of Evans?
Mr. Helmer: Yes, 700 feet to the south property line.
Mr. Dunbar: When do you propose to start?
NIT. Helmer: It would take at least sixty days to get everything in. Our
bids in - dueto the fact that we couldn't get our actual loan
committment until after we had this zoning change, which will take
approximately 60 days. We had our architects drawing but these prints
couldn't be made up until after we got our permission from the Planning
Commission at our last meeting with them. We went ahead and had our
prints made up, which we just received laonday morning. Now just as
soon as we can get our bids in and the technicalities straightened
out we will start construction.
Mr. Dunbar: You haven't purchased the property yet? You have an option on it?
Robert Ruyle: The contract to purchase if filed with the Board of County
Commissioners here in the record showing his unequibable right to
purchase on the condition of the zoning changes made.

declare this hearing cl osed.

the amount of the foregoing deposit and any additional amounts paid or deposited in said escrow on account of said purchase price and being released from
all obligations hereunder, or accepting title to said property in such condition or granting to Seller additional time in which to render said title marketable.
5. The risk of loss of or damage to any of the property described herein until the transfer of title thereto is assumed by Seller.
6. Said deposit and all other payments called for herein if made with other than lawful money of the United States of America. may be converted im-
mediately into cash. Buyer unconditionally guarantees to Seller and said Broker the validity and genuineness of any drafts or checks used as purchase
money in connection with this transaction, and Buyer agrees to immediately pay the amount of any such draft or check if dishonored upon its presentation
for payment.
