Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated August 7, 1995, and duly published August 10, 1995, in the Windsor Beacon, a public hearing was conducted toconsiderthe request of Boyd and Allison Meyer for a Site Specific Development Plan and Special Review Permit for retail sale of buffalo meat and other buffalo oriented products in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She noted the Cities of Greeley and Windsor both recommended denial; however, a petition was received from all area residents supporting the proposal and no other opposition has been received. Ms. Eastin reviewed the site area and noted the Department of Public Works' concerns have been addressed and the access will be paved. She answered questions from the Board and confirmed no discussion occurred at the Planning Commission hearing concerning the recommendations from the Cities of Greeley and Windsor. Vern Nelson, Nelson Engineers, represented the applicant and stated the applicant agrees with the recommendation from staff and the Planning Commission, is in compliance, and has met all requirements. He also confirmed agreement with the Conditions of Approval and Development Standards, noting Condition of Approval #3d, concerning Public Works' requirements, has been addressed, and Condition of Approval #3e, concerning the Colorado Department of Transportation's (CDOT) requirements, will be addressed. Responding to questions from the Board, Mr. Nelson stated a maximum of 16 cars per day to the site has been estimated; therefore, the traffic impact will be low. He stated the site is about 300 to 350 feet off Highway 392 and confirmed Boyd Meyer, applicant, owns said property. Mr. Nelson reiterated the residents of the house to the south have no objection and the access road will be paved to the bridge. He also confirmed the access permit for improvements will be acquired from CDOT. Mr. Meyer reiterated the area residents are positive and excited about the proposal, and he stated ten -foot shoulders exist on the Highway if accel/decel lanes become necessary. Responding to questions from the Board, Mr. -Meyer said he and his wife will be operating the business and think live animals on site will help make it successful. He stated they now -have 65 head of buffalo, which will last approximately eight months, and they would eventually like to process 150 head per year. He noted the building will require less than one acre, which is in grass and difficult to irrigate, with his total grazing area being a seven -acre parcel. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Boyd and Allison Meyer for a Site Specific Development Plan and Special Review Permit for retail sale of buffalo meat and other buffalo oriented products in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. Responding to a question from Commissioner Kirkmeyer, Ms. Eastin confirmed Condition of Approval #3e covers the requirement of the access permit.
