AND MARY JEAN MUELLER A public hearing was conducted on November 1, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Todd Hodges The following business was transacted: I hereby certify that pursuant to a notice dated October 16, 1995, and duly published October 19, 1995, in the North Weld Herald, a public hearing was conducted to consider the request of Larry L. and Mary Jean Mueller for a Site Specific Development Plan and Special Review Permit for an art gallery in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Todd Hodges, Planning Department representative, presented a brief summary of the proposal and suggested Condition of Approval #6 be deleted since it already has been met by the applicant and the Health Department has signed off on the review. He then entered the favorable recommendation of the Planning Commission into the record as written, including said deletion. William Crews, CPL, represented the applicant, requested approval of the Permit, and agreed with the Conditions of Approval and Development Standards, including the previous deletion by staff. He noted the applicants would like to have an open house on November 11, 1995, and are requesting they be allowed to open their business immediately upon approval and file the plat subsequently. Responding to questions from the Board, Mr. Crews stated it would take a minimum of one week to file the plat, with no complications. Mr. Morrison noted the normal time requirement for the plat is 15 days; however, he suggested the Board include a provision in Condition of Approval #2 that the applicants not be found in violation if operating the business prior to recording the plat provided the plat is recorded within 20 days. No public testimony was offered concerning this matter. Mr. Hodges stated obtaining the proper signatures from the Planning Commission may cause a delay, and there may be other problems with the plat, which must be approved by staff prior to recording. After further discussion, Commissioner Kirkmeyer thanked Mr. Crews for being up front with the situation and stated, since the progression is questionable and there will most likely be no problems, no changes are necessary. She noted if non-compliance occurs, she is sure it will be corrected quickly. Commissioner Harbert agreed, and, after additional comments, Commissioner Webster moved to approve the request of Larry L. and Mary Jean Mueller for a Site Specific Development Plan and Special Review Permit for an art gallery in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record, including the deletion of Condition of Approval #6.
