RE: APPROVE AGREEMENT FOR UNIVERSITY OF NORTHERN COLORADO SCHOOL OF
NURSING CLINICAL EXPERIENCE AT WELD COUNTY HEALTH DEPARTMENT AND
AUTHORIZE CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Agreement for Clinical Experience
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Weld County Health Department, and the
University of Northern Colorado School of Nursing, commencing September 15, 1994, and ending
September 14, 1997, with further terms and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Agreement for Clinical Experience between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Weld County Health Department, and the University of Northern Colorado School of Nursing be,
and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 30th day of January, A.D., 1995, nunc pro tunc September 15, 1994.

AGREEMENT FOR UNIVERSITY OF NORTHERN COLORADO SCHOOL OF
NURSING CLINICAL EXPERIENCE AT WELD COUNTY HEALTH DEPARTMENT
THIS AGREEMENT is entered into this 9th day of September , 1994 by and
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, Colorado, on behalf of the Weld County Health Department,
whose address is 915 10th Street, Greeley, Colorado 80631, hereinafter referred to as
"Agency," and the University of Northern Colorado, for and on behalf of its School of Nursing
, whose address is 11th Avenue and 21st Street, Greeley, Colorado 80631, hereinafter
referred to as "School".
WITNESSETH:
WHEREAS, School offers an educational program at the Baccalaureate level
integrated for the preparation of professional nurses, and
WHEREAS, Agency has certain facilities and programs in which students in School's
nursing program may obtain their required clinical experiences and desires to provide such
facilities and programs for such purposes, and
WHEREAS, School and Agency now desire to set forth their agreements and
understandings with respect to the provision of such clinical experiences and to define their
respective responsibilities for the same.
NOW, THEREFORE, in consideration of the promises and covenants contained
herein, the parties hereto agree as follows:
I. CLINICAL EXPERIENCE FOR SCHOOL'S STUDENTS AT AGENCY
A. Pursuant to the terms and conditions set forth in this Agreement,
Agency shall allow students in School's nursing program to participate
in Agency's health clinics. Agency shall have the right to choose, in its
sole discretion, in which of Agency's clinics the students may
participate. Additionally, Agency shall have the sole discretion to
determine the level and manner in which the students may participate.
Such determination shall be made in consultation with School's faculty,
in order to accommodate and satisfy School's policies and accreditation
criteria (both voluntary and regulatory).
B. The parties agree that School's students' participation in Agency's
health clinics is for training purposes only and is designed to give them
experience in a clinical setting. As such, the students and

faculty involved in the clinical experience shall be required at all times to adhere to
the rules, regulations, procedures and standards of the Agency which may pertain to
the clinics.
II. DUTIES AND RESPONSIBILITIES OF SCHOOL
A. School shall provide for the administration and operation of the School
of Nursing courses which will include the clinical experience offered
students using the Agency facilities.
B. School shall provide qualified and competent faculty members
adequate in number for the instruction and supervision of students
using the Agency facilities.
C. School shall select and provide the students to be assigned to such
clinical experiences. Said students shall have completed all
prerequisite academic and clinical course work prior to their selection
for the clinical experience.
D. School shall instruct all students assigned to the Agency facility
regarding both the legal and ethical standards for confidentiality of
records and patient/client data imparted during the clinical experience.
E. School's faculty, staff and students shall not be considered Agency
employees for any purpose and said persons may not hold themselves
out as employees or agents of Agency or otherwise make any
representation or commitments on behalf of Agency.
F. Faculty and students of the University of Northern Colorado are
covered by the State of Colorado self-insurance program. School shall
provide to Agency certificates of liability insurance coverage for
students and faculty.
G. Participating students shall carry mandatory health insurance coverage
under the University's health insurance program or show proof of
enrollment in a comparable accident and sickness health insurance
plan. School shall ensure compliance with this requirement.
H. School employees, including faculty and staff, are covered by
workmen's compensation insurance with the State Compensation
Insurance Fund. This coverage does include all students enrolled in

on-the-job training programs, except those students involved in student
teaching.
I. School's faculty shall orient students to the Agency, unless agreed
upon otherwise.
J. School's faculty and students shall adhere to the rules, regulations,
procedures, and standards promulgated by Agency at all times they are
participating in the clinical experience. School shall ensure compliance
with this requirement.
III. DUTIES AND RESPONSIBILITIES OF AGENCY
A. Agency shall endeavor to maintain a learning environment conducive
to sound educational and clinical experiences during the term of this
Agreement.
B. Agency has ultimate responsibility for the quality of care given to
patients. Agency staff in the clinics to which School's students are
assigned shall be responsible for orienting faculty to Agency policies
and protocols, particularly where special rules and regulations are
necessary.
C. Agency shall permit students, staff, and faculty of the School of Nursing
to utilize facilities such as the library, lounges, conference rooms,
audio-visual equipment, or other teaching equipment consistent with the
regulations and policies set by the Agency.
D. Agency staff shall communicate with School's representatives
concerning any problems that might arise due to a student's
performance. A written report shall be provided to the faculty or staff
member of School who is in charge of student supervision.
E. School staff shall have the responsibility for evaluating performance
and assigning grades to School's students who participate in the clinical
experience. Agency shall not be required to maintain educational
records concerning any student assigned to the Agency facilities. All
documents in regard to a student's performance shall be forwarded to
the School upon the student's completion of the clinical experience.
F. Agency staff are not to be considered employees of the University of
Northern Colorado for any purpose and said staff may not hold

themselves out as employees or agents of the University or otherwise
make any representations or commitments on behalf of the School or
University.
IV. JOINT RESPONSIBILITIES AND TERMS OF AGREEMENT
A. This Agreement shall commence as of the date set forth above, nunc
pro tunc September 15, 1994, and continue in full force and effect
through September 14, 1997, unless sooner terminated by either party
pursuant to the termination provisions set forth in Section IV. B., below.
B. This Agreement may be terminated at any time during the term set forth
in Section IV. A., above, for any reason by either party hereto upon
ninety (90) days written notice to the other party delivered to the
address shown above.
C. During the term of this agreement, arrangements shall be made for
periodic meetings between representatives of School and Agency to
promote understanding of and adjustments to any operation or activity
involved herein.
D. The nature of this agreement is such that each party undertakes
obligations to the other party with no passage of funds between the
parties or between personnel of their respective staffs.
E. The parties hereto agree that they shall conduct their activities under
the auspices of this agreement in accordance with State and Federal
non-discrimination laws.
F. Agency recognizes that School is bound to comply with the standards
set by and in the Family Educational Rights and Privacy Act (Buckley
Amendment) in the handling of the educational records of students
enrolled in its programs. Agency shall endeavor to assist School in
meeting such standards.
G. Any written notice or communication provided for, required, or permitted
herein shall be addressed to the following:

H. It is agreed by both parties that any causes of action arising out of this
Agreement shall be venued in the courts of Weld County, Colorado, to
the extent that those courts are reposed with subject matter jurisdiction.
Both parties agree to submit themselves to the personal jurisdiction of
those courts.
This Agreement shall be construed in accordance with the law of the
State of Colorado.
J. This Agreement constitutes the entire agreement between the parties
and supersedes all prior written and oral agreements. Any changes,
modifications, supplementations, or amendments to this Agreement
must be reduced to writing and signed by the parties which are
signatory hereto.
K. Any waiver by either party of any term or provision in this contract at
any one time shall not constitute a waiver of any other or all provisions.
Any waiver of any part or provision of this Agreement at any one time
shall not constitute a waiver for all times.
IN WITNESS WHEREOF, the parties have caused this agreement to be executed by
their duly authorized representatives as of the day and date first hereinabove written.

Subject: Non -Financial Agreement with University of Northern Colorado
School of Nursing
Enclosed for Board approval is a non -financial agreement between the Weld County Health
Department and the University of Northern Colorado's School of Nursing.
This agreement outlines the responsibilities of each party with respect to the clinical experience
offered at the Health Department for UNC Nursing students.
The term of the agreement is September 15, 1994 through September 14, 1997. Because the
Health Department just received this agreement from U.N.C., its processing is untimely.
