RE: GRANT MOBILE HOME PERMIT #2095 - ELEAZAR SOTO
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 15th
day of July, 1998, considered the request of Eleazar Soto, 7347 Richard Street, Fort Lupton,
Colorado 80621, for a mobile home to be used as a principal dwelling, and
WHEREAS, said mobile home is to be occupied in an A (Agricultural) Zone District on a
parcel of land being more particularly described as follows:
Lot 2, Block 44, Aristocrat Ranchettes, Section 27,
Township 2 North, Range 66 West of the 6th P.M.,
Weld County, Colorado
WHEREAS, the Board of County Commissioners, having heard all of the testimony,
finds that said request should be granted subject to the following conditions:
1. The applicant shall apply for a building permit for the mobile home prior to
locating the mobile home on the property.
2. If the legal water supply is a cistern, the applicant must apply for, and obtain, an
approved cistern permit from the Weld County Health Department, which permit
must be renewed on an annual basis. In accordance with Weld County
Ordinance No. 172, upon the availability of water from the Aristocrat Water
Project, or any other community water supply system, the cistern permit will not
be renewed and the applicant will be expected to obtain water from that water
system.
3. The mobile home shall meet the minimum setback and offset requirements for
the A (Agricultural) Zone District.
4. The mobile home shall not be occupied until such time that the applicant has
complied with the above mentioned conditions.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the request of Eleazar Soto for permission to place a mobile home
to be used as a principal dwelling on the above described parcel of land, which was found to be
in compliance with Section 43 of the Weld County Zoning Ordinance, be, and hereby is, granted
subject to the hereinabove listed conditions.

The Department of Planning Services' staff has reviewed this request and recommends that this
request be approved for the following reasons:
1. It is the opinion of the Department of Planning Services'staff that the applicant has shown compliance
with Section 43.2.6 of the Weld County Zoning Ordinance, as follows:
a. Section 43.2.6.1.1-The proposed mobile home is compatible with the surrounding area, is
in harmony with the character of the neighborhood and its effects upon the immediate area.
The surrounding area is an Agricultural subdivision with mostly mobile homes and
manufactured homes and Agricultural uses.
b. Section 43.2.6.1.2-The proposed mobile home is compatible with the Weld County
Comprehensive Plan. The mobile home will be placed in an Agricultural subdivision to be
used as a principal residence and will not interfere with agricultural uses.
c. Section 43.2.6.1.3-There is available water and sewage disposal facilities for the mobile
home. The applicant has applied for a cistern permit and a septic permit with the Weld
County Health Department.
d. Section 43.2.6.1.4-The general health, safety and welfare of the inhabitants of the area and
the county will not be jeopardized or compromised by the location of the mobile home n this
site.

The Department of Planning Services' staff recommendation for approval is conditional upon the
following:
1. The applicant shall apply for a building permit for the mobile home prior to locating the mobile home
on the property.
2. Prior to the occupance of the mobile home, the mobile home shall be connected to an approved
septic system and a legal water supply.
3. The mobile home shall meet the minimum setback and offset requirements for the A(Agricultural)
zone district.
4. The mobile home shall not be occupied until such time that the applicant has complied with Conditions
1 through 3 as stated above.

Wednesday, July 15, 1998 at 9:00 a.m. you will be holding a public hearing concerning
a mobile home permit for Eleazar Soto, Lot 2, Block 44, Aristocrat Ranchettes, Section
27,T2N, R66W of the 6'" P.M.,Weld County, Colorado. This is located at 7347.Richard
Street, Aristocrat Ranchettes, Ft. Lupton, CO.
We received notice of this request because we are within the 500 feet of the property.
We pre comnietely against this request. The mobile home is already sitting on the
property and is a piece of junk. Many residents of Aristocrat Ranchettes are trying to
keep any more of these junk homes from being moved into the area. There are many
new mobile/modular homes being put in and it certainly adds to the area. Trailer Parks
do not allow this junk to be put in their parks,why should you allow it in Aristocrat
Ranchettes.
If this request is denied. is there a time frame in which this junk has to be moved out, or
will the county let it sit there and rot further? You need to follow up if it is supposed to
be moved out to see that it has been done.
There is also a property between Hart and Harold on Caster that has put several old
trailers on the property, probably without permits, and now all three are trash. Is there
something you can do about this?

Dear Ms. Soto:
I have scheduled a meeting with the Weld County Board of County Commissioners for July 15, 1998, at 9:00
a.m. This meeting will take place in the County Commissioners' Hearing Room, First Floor, Weld County
Centennial Center, 915 10th Street, Greeley, Colorado. It is recommended that you and/or a representative
be in attendance to answer any questions the Board members may have.
A representative from the Department of Planning Services will be out to the property a minimum of ten days
prior to the hearing to post a sign adjacent to and visible from a publicly maintained road right-of-way which
identifies the hearing time, date, and location. In the event the property is not adjacent to a publicly
maintained road right-of-way, one sign will be posted in the most prominent place on the property and a
second sign posted at the point at which the driveway (access drive) intersects a publicly maintained road
right-of-way.
The Department of Planning Services' staff will make a recommendation concerning this application to the
Board of County Commissioners. This recommendation will be available twenty-four(24) hours before the
scheduled hearing. It is the responsibility of the applicant to call the Department of Planning Services' office
before the Board hearing to make arrangements to obtain the recommendation.

Dear Applicant:
Your mobile home zoning permit application is being processed by our office. If it is determined that the
application meets the approval criteria of Section 43 of the Weld County Zoning Ordinance and you have
submitted a petition with the signatures of at least 70% of the surrounding property owners who have no
objection to your request, you will be notified that the zoning permit is approved. If the staff determines that
the application does not meet the approval criteria, you will be notified and asked to appear before the Board
of County Commissioners at a public hearing. You will be informed of the hearing date at least a week prior
to the hearing. The Board of County Commissioners will then consider your application and make a final
decision on the zoning permit for the mobile home.
It is the policy of Weld County to refer an application of this nature to any town or municipality lying within three
miles of the property in question or if the property under consideration is located within the comprehensive
planning area of a town or municipality. Therefore, our office has forwarded a copy of the submitted materials
to the Fort Lupton Planning Commission for its review and comments. It is recommended that you and/or a
representative be in attendance at the Fort Lupton Planning Commission meeting to answer any questions the
Commission members may have with respect to your application. Please call City of Fort Lupton at 970-346-
0326, for further details regarding the date,time, and place of this meeting.

With the assistance of the Natural Resources Conservation
Service (NRCS) we have reviewed the application for Mobile Home
Zoning Permit, Case # ZPMH-2095, and have the following concerns :
SOIL LIMITATIONS
****************
Construction of a septic system will encounter severe
limitations if performed on Valent sand or Vona loamy sand soils
because of poor filter materials . Severe limitations will also
be found if a system is installed on the Nelson fine sandy loam
because of shallow depth to rock. The Olney loamy sand presents
only moderate limitations to septic system development because of
slow percolation.
REVEGETATION
************
Our inspection of the site revealed existing cover of annual
weeds and trash. If this application is approved we recommend
that the land be revegetated using the enclosed grass seeding mix
and instructions for planting. Many of the soils on Aristocrat
Acres are highly erosive and will benefit from perennial cover
that does not contribute to the invasive weed population.

RECOMMENDED PRACTICES FOR GRASS SEEDINGS
COVER CROP: If possible, plant a cover crop of long season grain sorghum, or forage sorghum from mid-May to mid-
June before planting grass during winter. This cover will hold the soil and grass seed in place while the grass becomes
established. Mow the cover crop before physiological maturity is reached to a height of 12" to 18"to prevent sorghum
seed from sprouting next summer. Seeding rates should be five to ten pounds per acre for forage sorghum or two to four
pounds per acre for grain sorghum, with the higher seeding rates used on clayey soils. Planting should be done from
northeast to southwest if possible, or west to east if not.
PLANTING: Sometime between November 1 and April 30 when the ground is unfrozen, plant the grass 1/4 to 3/4 inches
deep in 7" to 12" rows. Planting should be done from northeast to southwest if possible, or west to east if not. Use a
grass drill equipped with an agitator box, depth bands, and double disc furrow openers with the drop tube placement
directly between the disks.
MULCHING: New seedings not planted into a cover crop should be protected by a mulch of 4000 lbs. per acre weed-free
native grass hay crimped into the soil surface. Crimping the hay into the soil surface will help prevent it and the grass
seed from blowing away. It will also slow evaporation which will leave more water for seed germination, and retard weed
germination and growth.
WATER EROSION: Mulching may not be enough to prevent erosion on steep slopes or in areas of periodic water flow.
In these areas, install silt fences perpendicular to the direction of water flow. This will help to prevent water from building
up enough force as it flows to wash out the mulch or grass seed.
FERTILIZER: Because many weed species emerge before the grass will, any fertilizer applied will be utilized by the
weeds, making them even more competitive. No fertilizer is recommended for native grass seedings in this area.
WEED CONTROL: Until the grass seedlings have reached a five leaf growth stage mowing is the preferred method of
weed control. Mowing off the tops of the grass plants should be avoided. Timeliness of any weed control option is
essential. Contact Colorado Cooperative Extension Service for herbicide recommendations, or NRCS for the best time
for mowing operations. Weeds will need to be controlled with mowing or herbicides until the grasses are established,
usually the first four years after planting. Once established, the grass can withstand heavy traffic or grazing.

The Environmental Protection Division of the Weld County Health Department
has reviewed your application for a cistern permit for the home located at 7347
Richard Street, Aristocrat Ranchettes Subdivision, Fort Lupton, Colorado.
The Division approves this application. You may install your cistern. However,
this approval is contingent upon the following:
1) In accordance with Weld County Ordinance No. 172, upon the availability
of water from the Aristocrat Water Project or any other community water
supply, this permit will not be renewed. You must obtain water from that
water system.
2) This permit must be renewed each year on this date.
3) The cistern permit shall not be valid once water service is available from
the Aristocrat Ranchettes Project or some other community water supply.
4) The cistern must be placed a minimum of 100 feet from any portion of the
septic system.

Prior to receiving a final permit for use of the cistern, the following must occur:
1) Our Division must do a final inspection of the cistern after it has been
installed (but not yet covered with dirt) and is full of water. You must
schedule this inspection.
2) Our Division must collect a water sample for bacterial analysis. This
sample will be collected at the time of inspection. The analysis must
reveal that the water in the cistern is suitable for human consumption. In
the event the test fails, a retest must be conducted.
Please be reminded that the installation and operation of this cistern must
comply with Ordinance No. 172. This Ordinance includes a mandatory annual
renewal fee and bacteriological water test. A copy of this Ordinance is enclosed
for your records.
