MORGAN AND PATRICIA A. MAHONEY A public hearing was conducted on June 21, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro -Tern Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Shani Eastin The following business was transacted: I hereby certify that pursuant to a notice dated May 24, 1995, and duly published June 8, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of Clifford D. Morgan and Patricia A. Mahoney for a Site Specific Development Plan and Special Review Permit #1080 for a boarding kennel (60 dogs/15 cats) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Shani Eastin, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. She noted the City of Greeley has requested the Permit be subject to a five-year review. Patricia Mahoney and Clifford Morgan, applicants, were present and reviewed their background, explaining 60 dogs and 15 cats were proposed as an absolute maximum number of animals since the facility will be a vacation resort for pets. Mr. Morgan noted they are on a septic system, not City of Greeley sewer, as detailed in Development Standard #10. Dorothy Stewart, owner of the home at 3220 47th Avenue, Greeley, read a prepared statement opposing said proposal, which was later submitted for the record as Exhibit E. Bonnie Carwin, surrounding property owner, stated she submitted a letter at the Planning Commission meeting and agrees with Mrs. Stewart. She requested certain stipulations be placed on the Permit and submitted said request in writing as Exhibit C. Trevor Jiricek, Health Department, presented a decibel chart as Exhibit D. Ms. Eastin responded to Ms. Carwin's concerns by confirming the Planning Commission added requirements for buffers on all sides, the facility to be centrally located on the property, submittal of a screening plan, and use of the existing access only. Ms. Carwin responded to questions from the Board. Mr. Morgan reiterated the facility will be centralized on the site with 50 -foot setbacks, and a screening plan will be submitted. He noted the drainage from their property will not affect Ms. Carwin and the 40 trees which were removed will be replaced. Ms. Mahoney explained the animals will be exercised and rotated outside, with a maximum number of five outside at one time. She also stated the animals will be housed inside at night and assured the noise level would not exceed 60 decibels at the property line. Ms. Mahoney noted they will be living on site and would also like it kept nice and quiet for themselves. She confirmed all Conditions of Approval and Development Standards are acceptable. Commissioner Harbert moved to approve the request of Clifford D. Morgan and Patricia A. Mahoney for a Site Specific Development Plan and Special Review Permit #1080 for a boarding kennel (60 dogs/15 cats) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record.
