RE: APPROVE AMENDMENT TO INTERGOVERNMENTAL AGREEMENT REQUIRING
CONTROL OF LEAFY SPURGE AND CANADA THISTLE ALONG COMMON
WATERWAYS AND COUNTY BORDERS AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Amendment to the Intergovernmental
Agreement Requiring Control of Leafy Spurge and Canada Thistle Along Common Waterways
and County Borders among the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, on behalf of the Public Works Department and, the
Counties of Adams, Boulder, Larimer, and Morgan, with terms and conditions being as stated in
said amendment, and
WHEREAS, after review, the Board deems it advisable to approve said amendment, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Amendment to the Intergovernmental Agreement Requiring Control
of Leafy Spurge and Canada Thistle Along Common Waterways and County Borders among the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Public Works Department, and the Counties of Adams, Boulder,
Larimer, and Morgan be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said amendment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 31st day of August, A.D., 1998.

AMENDMENT TO INTERGOVERNMENTAL AGREEMENT
REQUIRING THE CONTROL OF LEAFY SPURGE AND CANADA THISTLE
ALONG COMMON WATERWAYS AND COUNTY BORDERS
THIS INTERGOVERNMENTAL AGREEMENT is entered into this day of
1998,by and between the Counties of ADAMS, BOULDER, LARIMER, MORGAN, and WELD,
State of Colorado,by and through their respective Boards of County Commissioners, whose offices
are located at the addresses listed below, and which are referred to collectively herein as "the
Counties."
WITNESSETH:
WHEREAS, pursuant to the Colorado Constitution, Article XIV, Section 18(2)(a) Sections
29-1-203 and 35-5.5-105(3), C.R.S., as amended, Counties may cooperate or contract with each
other to provide for the integrated management of noxious weeds within their respective territorial
jurisdictions, and any such contract may provide for the sharing of costs,the imposition of taxes, and
the incurring of debt; and
WHEREAS, by Intergovernmental Agreement dated December 31, 1997, the Counties
agreed to pursue grant proposal opportunities for the purpose of managing leafy spurge and Canada
thistle in their respective jurisdictions, and
WHEREAS, the Counties submitted a joint grant proposal to the State of Colorado,
Department of Agriculture, Division of Plant Industry, Plant and Insect Section ("State
Department"), which was accepted and resulted in a contract between the State Department and the
County of Weld for the purpose of receiving the grant funds and disbursing said funds to the
Counties in accordance with the terms of the grant proposal, and
WHEREAS, the Counties now desire to amend the Intergovernmental Agreement for the
purpose of stating their respective duties in administering the funds upon receipt.
NOW, THEREFORE, in consideration of the mutual promises and covenants herein, the
Counties hereby amend the Intergovernmental Agreement as follows:
Replace Paragraph 3., of the Intergovernmental Agreement with the following:
3. SUBMISSION OF MANAGEMENT GRANT PROPOSAL:
The Counties have applied for and received a grant from the State of Colorado, Department
of Agriculture,Division of Plant Industry,Plant and Insect Section("State Department"), for
the purpose of managing leafy spurge and Canada thistle in their respective jurisdictions.
The County of Weld has contracted with the State Department to receive the grant funds
("the Funds")and disburse the Funds to the Counties in accordance with the following terms,

which each County hereto agrees to perform and/or comply with:
Adams County: Purchase of one (1) GPS receiver $ 3,000.00
Cost-share herbicides (50%-50%) 1,000.00
2 Solo backpack sprayers to lend 200.00
$ 4,200.00
Boulder County: Monies allocated to Boulder County, as a result of this grant
proposal, would primarily be dispensed by the Soil Conservation
District in the form of cost-share appropriations to private
landowners. Projects will be prioritized with regard to infestation
size and proximity to waterways and rights-of-way, where avenues
for spread are greater. $1,500.00
Larimer County: Cost share a portion of herbicide cost to ditch companies that are
inside the control zone and purchase computer and mapping
equipment. (This equipment will be used to map and monitor Canada
thistle and leafy spurge infestations.)
Cost-share for effected ditch companies $ 3,500.00
Purchase one desktop computer ready for mapping 2,500.00
Purchase one GPS unit 2,800.00
$ 8,800.00
Morgan County: Purchase two solo backpack sprayers to lend out $ 200.00
Purchase one 25-gallon portable sprayer to lend out 200.00
Purchase one Solar electric fence charger 265.00
Purchase 1,000 feet electric fence ribbon 435.00
Purchase one Arc View program license (mapping) 1,200.00
Purchase herbicides for cost share (50%-50%) 3.000.00
$ 5,300.00
Weld County: Cost-share herbicide (50%-50%) $ 14,200.00
Cost-share seed for reseeding operations 3,000.00
Split the cost (50%-50%) of(1) GPS unit 1,500.00
Split the cost (50%-50%) of(2) 25 gal. sprayers 600.00
Digital Camera 700.00
License for Arc View program 1,200.00
Use of(4) 25 gal. sprayers - 100 days 2.000.00
$ 23,200.00
Each County agrees that it will not spend the Funds in any other manner other than what is
stated above.

COLORADO SUBJECT: Amendment to IGA with Adams, Boulder, Larimer, and
Morgan County concerning state grant money
State grant funds were received by Weld County to carry out,the grant proposal submitted to the
Colorado Department of Agriculture (CDA). The CDA stated that Weld County would ultimately be
responsible for how each county spent the funds. Consequently, Bruce Barker and Don Warden
felt it would be important to amend the initial Intergovernmental Agreement(IGA)with the four other
counties and incorporate the part of the grant proposal that outlines how the funds would be spent.
Attached is the amended IGA with the appropriate county signatures.
