RE: ACTION OF THE BOARD CONCERNING SITE SPECIFIC DEVELOPMENT PLAN AND
SPECIAL REVIEW PERMIT #1191 FOR AN OIL AND GAS SUPPORT AND SERVICE
FACILITY (BRINE WATER DISPOSAL) IN THE A (AGRICULTURAL) ZONE DISTRICT -
ENVIRO-CYCLE, LLC, % HOWARD BOATRIGHT
A public hearing was conducted on December 21, 1998, at 10:00 a.m., with the following present:
Commissioner Constance L. Harbert, Chair
Commissioner W. H. Webster, Pro-Tem
Commissioner George E. Baxter- EXCUSED
Commissioner Dale K. Hall
Commissioner Barbara J. Kirkmeyer
Also present:
Acting Clerk to the Board, Esther Gesick
Assistant County Attorney, Lee Morrison
Planning Department representative, Scott Ballstadt
Health Department representative, Trevor Jiricek
Public Works representative, Don Carroll
The following business was transacted:
I hereby certify that pursuant to a notice dated September 25, 1998, and duly published October 28,
1998, in the Fort Lupton Press, a public hearing was conducted on November 9, 1998, to consider
the request of Enviro-Cycle, LLC, % Howard Boatright for an Oil and Gas Support and Service
Facility (brine water disposal) in the A (Agricultural) Zone District, at which time said matter was
continued to December 21, 1998. Pursuant to a notice dated December 4, 1998, and duly
published December 9, 1998, in the Fort Lupton Press, a public hearing was conducted on
December 21, 1998. Lee Morrison, Assistant County Attorney, made this a matter of record. Scott
Ballstadt, Department of Planning Services representative, presented a memorandum dated
December 21, 1998, marked Exhibit P, and stated the applicant is requesting this hearing be
continued due to unresolved issues. In response to Chair Harbert, Jacqueline Johnson, attorney,
stated the issue of jurisdiction between the Oil and Gas Commission and the State Health
Department is still unresolved. She requested this matter be continued to January 13, 1998, at
10:00 a.m. Chair Harbert commented there will be two new Board members at that time which will
need to review the tapes of the previous hearings for this case.
No public testimony was offered concerning this matter.
Commissioner Hall moved to continue the request of Enviro-Cycle, LLC, % Howard Boatright for a
Site Specific Development Plan and Special Review Permit#1198 for an Oil and Gas Support and
Service Facility(brine water disposal) in the A(Agricultural)Zone District, based on the request from
the applicant as entered into the record to January 20, 1999, at 10:00 a.m. The motion was
seconded by Commissioner Webster, and it carried unanimously.
