HomeMy WebLinkAbout690281.tiffe v 9 J -ta RESOLUTION WHEREAS, Niwot Sanitation District, 1035 Coffman Street, Longmont, Colorado, has requested permission for the installation of a 2000 population equivalent aeration oxidation pond facility on the following described property, to -wit: The East One Thousand Feet (1,000') of the SE± of the SW4 of Section Seven (7), Town- ship Two (2) North, Range Sixty-eight (68) West, of the Sixth Principal Meridian, Weld County, Colorado, and WHEREAS, the said requested aeration oxidation pond facility is located in an agricultural zone, as set forth by the Weld County Zoning Resolution, and WHEREAS, according to the Zoning Resolution of Weld County, said aeration oxidation pond facility may be permitted on the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Weld County Planning Commission has recom- mended that such aeration oxidation pond facility be denied by Resolution dated May 21, 1969, a copy of which is attached, and made a part hereof by reference, and WHEREAS, the Board of County Commissioners has carefully considered the petition and the recommendations of the Weld County Planning Commission filed with the Board, and having carefully weighed the same, finds as follows: 1. That said Sanitation District is located in Boulder County, and any aeration oxidation pond facility should be installed in Boulder County; 2. That said Sanitation District, being located in Boulder County, is a Boulder County problem, and same should be subject to Boulder County regulations; 690 28 1 3. That investigation shows the inhabitants of the immediate vicinity of the area whereat said facility is sought to be installed, are unanimously opposed to the installation of such facility; 4. That further investigation shows that there are locations as good, or better, in Boulder County for the installation of such a facility; 5. That no good reason has been given by the Sanitation District as to why said installation should be in Weld County, rather than in Boulder County; 6. That each of the preceding findings, in and of themselves, and independent of each other, constitutes a separate and individual ground for denial of the application for the installation of the facility. NOW, THEREFORE, BE IT RESOLVED, that the petition of the Niwot Sanitation District, 1035 Coffman Street, Longmont, Colorado, requesting permission to locate a 2000 population equivalent aeration oxidation pond facility on the land indicated above, be, and it hereby is denied, upon each of the grounds set forth in the Board's finding therein. Box 1227 Greeley, Colorado As I discussed briefly with you on the phone last Friday, June 13, the Boulder County Board of Health will be considering a site approval of the proposed Niwot Sanitation District location sewage treatment facilities. This proposal is probably going to be an aerated lagoon. A public hearing is going to be held on Thursday, June 26, 1969, at 7:30 P.M. A member of the Boulder County Board of Health has requested I find out and present at this public hearing what is the feeling of the Weld County officials, including the Weld County Board of Health, the Planning Commission, and the County Commissioners, of the proposed metro system as put forth in the Ken R. White, Engineers, report "Sewerage and Sewage Treatment Facilities City of Longmont, April 4, 1967". This report was forwarded to Mr. Glen Paul by Mr. Eugene Facetti, Senior Public Health Engineer, Colorado Department of Health; and you may wish to secure this copy to pursue this matter further.
