RESOLUTION OF RECOMMENDATION TO THE BOARD OF COUNTY COMMISSIONERS
Moved by Richard Kimmel that the following resolution with the amendment, to"
Condition of Approval 3c and the addition of a new Development Standarii #15, -and
the subsequent renumbering of the remaining Development Standards, be_„}ntroduced

REQUEST: A Site Specific Development Plan and a Special Review permit for a
recreational facility/shooting range in the A (Agricultural) zone
district.

Part of the SW4 of Section 20, T1N, R68W of the 6th
P.M., Weld County, Colorado.
LOCATION: Approximately 1/2 mile southeast of the intersection of Weld County
Road 8 and Weld County Road 3.
be recommended favorably to the Board of County Commissioners for the following
reasons:
1. The submitted materials are in compliance with the application
requirements of Section 24.7 of the Weld County Zoning Ordinance.
2. It is the opinion of the Planning Commission that the applicant has shown
compliance with Section 24.3 of the Weld County Zoning Ordinance as
follows:
- The proposal is consistent with the Weld County Comprehensive Plan's
Urban Growth Boundary Area Goals and Policies. The Town of Erie
recommended conditional approval.
The proposal is consistent with the intent of the Agricultural zone
district and, as a recreational facility, is provided for as a Use
by Special Review.
- The uses which would be permitted will be compatible with the
existing surrounding land uses which include oil and gas production,
a rural residence, a landfill, dry land farmland, pasture and a
stream. The proposal will be compatible with the future development
of the surrounding area.
The applicant has demonstrated a diligent effort to conserve
productive agricultural land in the locational decision for the
proposed use.

The proposed site is in the low Geologic Hazard Overlay District.
Conditions of Approval and Development Standards will address this
issue. No overlay districts affect this site.
Use by Special Review Development Standards and Conditions of
Approval will ensure compliance with Section 45.3 of the Weld County
Zoning Ordinance and will provide adequate protection of the health,
safety and welfare of the neighborhood and County.
This recommendation is based, in part, upon a review of the application materials
submitted by the applicant, other relevant information regarding the request, and
responses from referral entities.
The Planning Commission's recommendation for approval is conditional upon the
following:
1. The attached Development Standards for the Special Review permit shall be
adopted and placed on the Special Review plat prior to recording the plat.
The plat shall be delivered to the Department of Planning Services and be
ready for recording in the Weld County Clerk and Recorder's office within
15 days of approval by the Board of County Commissioners.
2. The Special Review activity shall not occur nor shall any building or
electrical permits be issued on the property until the Special Review plat
is ready to be recorded in the office of the Weld County Clerk and
Recorder.
3. Before scheduling the Board of County Commissioners Meeting:
a. A legal, permanent access shall be obtained to the site.
b. The Federal Aviation Administration shall review the proposed use,
and determine if there is any hazard to aviation in the area.
c. The Weld County Sheriff's Office shall review and make a
recommendation regarding safety requirements at this site
4. Prior to recording the plat:
a. A landscaping plan shall be submitted and approved by the Department
of Planning Services' staff in accordance with Section 45.3.3.4 of
the Weld County Zoning Ordinance.
5. Prior to use of the site as a shooting range, the site shall be fenced and
warning signs shall be posted every 200 feet.

The Chairperson declared the resolution passed and ordered that a certified copy
be forwarded with the file of this case to the Board of County Commissioners for
further proceedings.

SITE SPECIFIC DEVELOPMENT PLAN
SPECIAL REVIEW PERMIT
DEVELOPMENT STANDARDS

1. The Site Specific Development Plan and Special Review permit is for a
recreational facility/shooting range in the A (Agricultural) zone district
as submitted in the application materials on file in the Department of
Planning Services and subject to the Development Standards stated hereon.
2. Approval of this plan may create a vested property right pursuant to
Section 90 of the Weld County Zoning Ordinance.
3. No permanent disposal of wastes shall be permitted at this site.
4. Wood shavings, saw dust, and waste materials shall be handled, stored and
disposed of in a manner that controls fugitive dust, blowing debris, and
other potential nuisance conditions.
5. Fugitive dust shall be controlled on -site.
6. The maximum permissible noise level shall not exceed the industrial limit
of 80 dB (A), as measured according to 25-12-102, Colorado Revised
Statutes.
7. Adequate toilet facilities shall be provided for the public.
8. An individual sewage disposal system consisting of a minimum of a vault
privy, is required for the proposed facility and shall be installed
according to the Weld County Individual Sewage Disposal Regulations.
9. A septic system is required to be designed by a Colorado Registered
Professional Engineer if a system other than a vault privy is utilized.
10. All pesticides, fertilizer, and other potentially hazardous chemicals
shall be stored and handled in a safe manner. Reference 25-8-205.5
Colorado Water Quality Control Act and Rules and Regulations thereof.
11. Individual Sewage Disposal System permit shall be finalized and approved
by an Environmental Protection Specialist within one year of the
application date.
12. The access road, road within the facility, and the parking areas shall be
graveled.
13. Any buildings which are built shall comply with the adopted codes and
standards of the Mountain View Fire Protection District.
14. This permit shall be reviewed every five years.

15. No person may possess a firearm on the premises without meeting the age
requirement or hunter's safety requirements of Colorado State law unless
they are currently participating in a hunter's safety course on the range.
16. All construction on the property shall be in accordance with the
requirements of the Weld County Building Code Ordinance.
17. The property owner or operator shall be responsible for complying with the
Design Standards of Section 24.5 of the Weld County Zoning Ordinance.
18. The property owner or operator shall be responsible for complying with the
Operation Standards of Section 24.6 of the Weld County Zoning Ordinance.
19. The property owner or operator shall be responsible for complying with
Section 45.3 of the Weld County Zoning Ordinance.
20. Personnel from the Weld County Health Department and Weld County
Department of Planning Services shall be granted access onto the property
at any reasonable time in order to ensure the activities carried out on
the property comply with the Development Standards stated hereon and all
applicable Weld County Regulations.
21. The Special Review area shall be limited to the plans shown hereon and
governed by the foregoing Standards and all applicable Weld County
Regulations. Major changes from the plans or Development Standards as
shown or stated shall require the approval of an amendment of the Permit
by the Weld County Planning Commission and the Board of County
Commissioners before such changes from the plans or Development Standards
are permitted. Any other changes shall be filed in the office of the
Department of Planning Services.
22. The property owner or operator shall be responsible for complying with all
of the foregoing Development Standards. Noncompliance with any of the
foregoing Development Standards may be reason for revocation of the Permit
by the Board of County Commissioners.

The applicant has requested a waiver of Section 45.3.1 of the Weld County Zoning
Ordinance, which indicates, "a Special Review permit may be issued for a period
up to five years."
The Town of Erie has indicated they would like to see this Special Review permit
renewed on a yearly basis.
Planning staff has attempted to appease both parties by indicating this permit
shall be reviewed every 5 years.
