ARCHIVE BOX MISSING AS OF 12/ 19/2017 '1JC RESOLUTION RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT#402 - INB LAND AND CATTLE, LLC, % TOMM OWENS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, by Resolution #780228 on April 12, 1978, the Board did approve Use by Special Review Permit#348 for an oil recycling and disposal site for Stan Rech, Box 303, Fort Lupton, Colorado 80620, on the following described real estate: That part of the W% of the SW% of Section 22, Township 2 North, Range 66 West of the 6th P.M., Weld County, Colorado WHEREAS, by Resolution 780229 on December 18, 1978, the Board did amend said resolution, at which time the Department of Planning Services case number reflected Use by Special Review Permit#372, and WHEREAS, by Resolution#790252 on May 16, 1979, the Board did revoke Use by Special Review Permit#348 for said oil field disposal site, said revocation also being effective for Department of Planning Services case#372, and WHEREAS, by Resolution #790253 on October 31, 1979, the Board did approve Use by Special Review Permit#402 for an oil field fluids disposal site for Stan Rech, Box 303, Fort Lupton, Colorado 80620, on the above-described real estate. WHEREAS, Tomm Owens of Orr Land Company, on behalf of INB Land and Cattle, LLC, has requested vacation of any and all previously issued permits on the above described property as a Condition of Approval for Amended Recorded Exemption #1871 and Subdivision Exemption #706, and WHEREAS, the Department of Planning Services and Health Department staff have verified the facility is no longer active, and the site has been reclaimed with mitigation of all potential environmental concerns, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendations of the Department of Planning Services and Health Department staff and all of the exhibits and evidence presented in this matter and, having been fully informed, deems it advisable to approve said vacation. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that Special Use Permit#402 be, and hereby is, vacated. HAND DELIVERED Scott, On behalf of INB Land & Cattle L.L.C. we are requesting that any and all previously issued permits for "31 Water Disposal" be vacated immediately. The permit numbers of record are S.U.P. 348, S.U.P. 372 and S.U.P. 402, all were issued to a Mr. Stanley Rech, INB Land & Cattle has owned this property for several years and has worked with the Weld County Health Department to mitigate any environmental problems which may possibly arise from contaminated soils. INB Land & Cattle L.L.C., has already received an award from the State Oil Gas Commission for the reclamation of the project. Please carry this request and present it to the County Commissioners at the earliest possible opportunity. Mr. Owens is making the request on behalf of INB Land & Cattle LLC as the water disposal facility is no longer active and the site has been reclaimed. Background information: "31 Water Disposal" Legal Description: AmRE-1871, being part of the SW1/4 of Section 22, T2N, R66W Location: East of and adjacent to WCR 31 and north of and adjacent to WCR 18 SUP-348, SUP-372 and SUP-402 were approved for a water disposal facility under the ownership of Stanley and Jeff Rech. INB Land & Cattle LLC recently applied for a recorded exemption. The facility is no longer active and the site has been reclaimed. INB Land & Cattle LLC has received an award from the Oil and Gas Conservation Commission for the reclamation of the site and INB has worked with the Weld County Health Department to mitigate any potential environmental concerns. One of the conditions of approval from the Department of Planning Services required the applicant to vacate the SUP's. This request for vacation of SUP-348, SUP-372 and SUP-402 is intended to satisfy the Department of Planning Services' condition. 982030 TLOO I Z. Hello
