APPROVED WITH CONDITIONS The Department of Planning Services has determined through the review that the standards of Sections 11.5.1 through • 11.5.6 of the Weld County Subdivision Ordinance have been met. This Recorded Exemption is approved with the following conditions in accordance with information submitted in the application and the policies of the County. A Weld County septic permit is required for any proposed home. The septic system shall be installed according to the Weld County Individual Sewage Disposal System (ISDS) regulations. The following note shall be placed on the plat: All proposed or existing structures will or do meet the minimum setback and offset requirements for the zone district in which the property is located. The applicant shall designate a building envelope on Lot B for residential purposes. This lot shall be approved by the Department of Planning Services'staff and placed on the plat. The Environmental Protection Services Division of the Weld county Health Department was unable to locate a septic permit for the septic system located on the smaller parcel of this application. Any existing septic system(s) which is not currently permitted through the Weld county Health Department will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate,the system(s) must be brought into compliance with current I.S.D.S. regulations. The applicant shall submit a mylar plat to the Department of Planning Services to be recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared in accordance with the requirements of Section 11.7 of the Weld County Subdivision Ordinance. Recorded 04/17/96 12:42P Dear Todd: This letter is to challenge the notation on the plot for RE1862, which is "20.00 ACCESS EASEMENT FROM LOT "A" TO COLORADO STATE HIGHWAY# 37". This notation has no basis for being placed upon the plot. I have attached the original recorded warranty deed dated 5/9/95 which has no access easement noted. In fact the only easement agreed to is " a 20 foot wide easement for an existing domestic water line across this parcel ....". We were told that Lot "A" would have an access easement to the north through Lot "B" if ever the property was sold. Consequently the property was sold in 1996 and there is an access easement from Lot "A" through Lot "B" as noted on the plot and signed off on by the sellers on 4/9/96. When we challenged the notation of the "20 access easement from Lot "A" to Colorado State Highway# 37" the planner reviewing our request stated that a mistake was make and that the notation should not be on the plot. She also stated that a property should only be approved with one access. Our property does have easements which are not in dispute for: 1. Ingress and egress for Gerrity Oil 2. Mountain Bell Telephone Company 3. Public Service Company. In closing I would like to make the following points: 1. We did not sign off for an easement or right of way for Lot "A", 2. We did not sign any plot designating an easement or right of way for Lot "A", 3. The county cannot arbitrarily give an easement or right of way across our property without our consent, 4. One of our principal concerns remains that if the present status of this issue is not corrected it will become a problem in some future years and for some future owners. It is our request that the plot for Recorded Exemption No. 0801-34-1-RE1862 be corrected with the removal of the notation of"20 access easement from Lot "A" to Colorado State Highway# 37." Ashen Dear Shani: Per our telephone conversation of March 10, 1998 and your request that I write you a letter as to what I know about the road Mr. and Mrs. Barthol have been talking to you about. I have gone through my files and various papers as to the roadway that seems to be in dispute. The following documents indicate that the road has been in existence a long time and it being the only roadway into Lot A of the above Recorded Exemption and probably the reason the engineer did show it on the survey. The Barthols were aware of the road from the day they acquired first the property, it was pointed out to them at that time. Their name appears on the last Weld County Ownership Plat, the road also is shown on the same plat. The roadway is not only the road into Lot A, electrical and telephone service to Lot A utilizes the same area. This is also the access road for oil company service people. This is not the first time the road problem has surfaced with Mr. Barthol, a couple of years ago he plowed large drainage ditches across the road which he and the Morgans owners of Lot A apparently resolved among themselves. • If you and I could meet next week, week of March 16, there might be a solution to this problem without the neighbors becoming like the Hatfields and McCoys. If you and I agree on the solution, I could meet with the two parties and make an attempt to get them together.
