RESOLUTION
RE: APPROVAL OF RECORDED EXEMPTION #1785 - ALM
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d). CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1785, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1785 was submitted by Carl A. and
Josephine Alm, 36945 Weld County Road 43, Eaton, Colorado 80615, for property which is
described as Lot B of Amended RE #1276, located in the SEY4 of Section 22, Township 7 North,
Range 65 West of the 6th P.M., Weld County, Colorado, being more particularly described in the
plat which shall be provided by the applicant and known as Exhibit "A", said plat to be recorded,
and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
4 acres and 93 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1785 submitted by
Carl and Josephine Alm be, and hereby is, approved conditional upon the following:
1. A Weld County septic permit is required for any proposed home. It shall be installed
according to the Weld County Individual Sewage Disposal System (ISDS)
regulations.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Subject: RE -1785, Lot B of Amended Recorded Exemption 1276, located in the SE4 of Section

Dear Commissioners:
This request for a recorded exemption is submitted by Carl A. and Josephine Alm. The parcel of
land on which this request is being made is described as Lot B of AmRE-1276, being in the SE4 of
Section 22, T7N, R65W of the 6th P.M., Weld County, Colorado. The property is located North of
and adjacent to Weld County Road 78 and approximately 3/4 mile west of Weld County Road 45.
This request is divide Lot B of AmRE-1276, 97 acres, into two parcels of 4 acres and 93 acres, more
ore less.
RE -1276 was approved by the Department of Planning Services' July 20, 1990. RE -1276 created
two lots of 116 acres and 8 acres, more or less. AmRE-1276, approved by the Department of
Planning Services' on August 9, 1994, amended RE -1276 to two parcels of 98 acres and 20 acres,
more or less. The applicants are now requesting to further divided Lot B of AmRE-1276 into two
parcels of 93 acres and 4 acres, more or less. Access to proposed Lot B is existing onto Weld
County Road 78. Access to Lot A is proposed onto Weld County Road 78. North Weld Water is
proposed as the water source, and septic systems are proposed for sewage disposal on both lots.
The Department of Planning Services' staff has concerns that the proposed division is inconsistent
with the Agricultural Goals and Policies as stated in the Weld County Comprehensive Plan. The
division of this parcel would create two buildable lots thus contributing to a sprawl row type
development. The applicants currently have the right to build a home on the parcel the way it
currently exists. Both lots are identified as prime farm ground by the Department of Agriculture Soil
Service, Teamwork, Integrity, Quality

Conservation Service. This request, if approved, would allow for a residence on both lots further
intensifying the residential uses on the property and potential reduction in prime agricultural farm
ground. The Comprehensive Plan promotes preserving the agricultural use of the prime agricultural
ground.
The Department of Planning Services' staff requests that the Board of County Commissioners
consider this proposal and determine if the standards of Section 11.5.1 through 11.5.7 of the Weld
County Subdivision Ordinance have been met.

The Department of Planning Services has determined through the review that the standards
of Sections 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance have been met.
This Recorded Exemption is approved with the following conditions in accordance with
information submitted in the application and the policies of the County.
A Weld County septic permit is required for any proposed home. The septic system shall
be installed according to the Weld County Individual Sewage Disposal System (ISDS)
regulations.
Prior to recording the plat, the applicant shall submit evidence that an ISDS evaluation
has been completed by the Weld County Health Department on all existing septic systems.
The Individual Sewage Disposal System permit shall be finalized and approved by an
Environmental Protection Specialist within one (1) year of the application date.
The following note shall be placed on the recorded exemption plat prior to recording:
A Flood -Hazard Development Permit shall be required for any new construction or
substantial improvements of existing structures in the Flood Hazard Overlay District
located on the property.
The applicant shall submit a mylar plat to the Department of Planning Services to be
recorded in the office of the Weld County Clerk and Recorder. The plat shall be prepared
in accordance with the requirements of Section 11.7 of the Weld County Subdivision
Ordinance. The plat shall be submitted within sixty (60) days from the date of approval
