RE: APPROVAL OF RECORDED EXEMPTION #1780 - EWEGEN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under Section
30-28-101(10)(d), CRS, as amended, did determine at a public meeting held in the Chambers of
the Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known
as Recorded Exemption #1780, does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land", and
WHEREAS, the request for Recorded Exemption #1780 was submitted by Lester A. and
Judith W. Ewegen, 37615 Weld County Road 39, Eaton, Colorado 80615, for property which is
described as Lot C of SE #155 located in the E%, NEV of Section 30, Township 7 North, Range 65
West of the 6th P.M., Weld County, Colorado, being more particularly described in the plat which
shall be provided by the applicant and known as Exhibit "A", said plat to be recorded, and
WHEREAS, this request is to divide the property into parcels estimated to be approximately
one-half acre and one-half acre.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms, "subdivision" and "subdivided land".
BE IT FURTHER RESOLVED by the Board that Recorded Exemption #1780 submitted by
Lester A. and Judith W. Ewegen be, and hereby is, approved conditional upon the following:
1. Prior to recording the plat, the applicant shall connect into the Town of Eaton public
sewer for both lots. A copy of the approved connection shall be submitted to the
Department of Planning Services.
2. The applicant shall submit a mylar plat to the Department of Planning Services to
be recorded in the office of the Weld County Clerk and Recorder. The plat shall be
prepared in accordance with the requirements of Section 11.7 of the Weld County
Subdivision Ordinance. The plat shall be submitted within sixty days from the date
of approval by the Board of County Commissioners. The applicant shall be
responsible for paying the recording fees.

Dear Commissioners:
This request for a recorded exemption is submitted by Lester A. and Judith W. Ewegen. The parcel
of land on which this proposal is being made is described as Lot C of SE -155 located in the E2, NE4
of Section 30, 17N, R65W of the 6th P.M., Weld County, Colorado. The property is located west of
and adjacent to WCR 39 and approximately 1/2 mile south of WCR 78. This request is to divide a
one acre parcel, Lot C of SE -155, into two lots of a 1/2 acre each.
The parcel under consideration, Lot C of SE -155, was approved by the Board of County
Commissioners in 1982. Access to both proposed lots is existing from Weld County Road 39.
Proposed Lot A has an existing septic system and proposed Lot B will connect to the Town of Eaton
public sewer supply. North Weld County Water District provides water to each proposed lot. The
Weld County Health Department, Public Works Department and the Town of Eaton have reviewed
this request and have no conflict of interest. Proposed Lot A contains an existing home and a new
home is proposed for Lot B.
The Department of Planning Services' staff recommends that the Board of County Commissioners
approve this request. Section 11.8.5 of the Weld County Subdivision Ordinance allows a lot in the
A (Agricultural) zone district to be created that is less than one acre if exempted by the Board of
County Commissioners. Staff feels that the creation of a lot in this area is compatible with the
surrounding area. Directly to the south of this request is the Town of Eaton's Hawkstone
Subdivision. The Eaton Country Club and Golf Course lie to the west and north. Two additional

residences also lie directly to the north. Urban services are available to this site, which include
public water and sewer. The proposal also meets the intent of the Weld Comprehensive plan which
allows a lot to be created in the A (Agricultural) zone district that is non-productive farm ground.
Currently, proposed Lot B is vacant ground and proposed Lot A contains an existing home.
The Department of Planning Services' staff recommends conditional approval of this request. It is
the opinion of the Department of Planning Services' staff that this request complies with the
standards of Section 11.5.1 through 11.5.6 of the Weld County Subdivision Ordinance.

Your recorded exemption application will be processed on or before August 31, 1995. If it is determined
that the application meets the approval criteria of the Weld County Subdivision Ordinance, you will be
notified that the recorded exemption is approved. If the staff determines that the application does not meet
the approval criteria, you will be notified and asked to appear before the Board of County Commissioners
at a public hearing. You will be informed of the hearing date prior to the hearing. The Board of County
Commissioners will then consider your application and make a final decision on the recorded exemption.

1. Explain the reason for the proposed recorded exemption and how each proposed lot will be used.
The division of one oversized lot into two smaller lots
for residential use.
2. Describe the location, size and present use of the area where each proposed new lot will be created.
A single residential lot approximately one acre in size located
adjacent to the 12th hole of the Eaton County Club with one
dwelling.
3. Explain how the proposal is consistent with the Weld County Comprehensive Plan and any adopted
municipal plan, if applicable.
It fills in within an existing building pattern without
requiring additional services and helps preserve quality
farm acreage.
4. Explain how the uses permitted will be compatible with existing uses surrounding the proposed
recorded exemption.
There are currently four houses along this quarter -mile
piece of Weld County Road 39, all are on lots of similar or
smaller size.
5. Explain how the proposal is consistent with the intent of the zoning district it is located within.
Although the ground is zoned agriculture it would be very
difficult to use for other than residential purposes.
6. Explain how the proposal is consistent with efficient and orderly development.
It is within and adjacent to similar development.
7. Explain how adequate provision for the protection of the health, safety, and welfare of the inhabitants
of the neighborhood and the County will be accomplished.
All services including fire protection are currently in
place, no hazardous industry or commercial ventures would be
permitted.

RE: APPROVAL OF SUBDIVISION EXEMPTION NO. 155 - EATON COUNTRY CLUB
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Department of Planning Services staff received
a request from the Eaton Country Club for a subdivision exemption,

There is a dimensioning error one of the lines as indicated on the drawing portion of the plat.
