I did receive the agreement between the town and the water district. My reading of the agreement clearly reflects that the town is restricted to a 10%growth rate. This would amount to 50-55 water taps per year,to service all of the projects currently within the town,not to mention projects the town is wishing to annex. As I have previously notified you,we cannot annex to the town unless we are assured a"continuous flow"of water taps. All of our builders,and their lenders,without exception,require a guarantee of water service from us prior to their purchasing sites. Owing to the restrictions contained in your agreement with the water district,we would be unable to make that guarantee;in effect putting us out of business. In addition to the water shortage,the town of Fredrick and the town of Firestone have not reached an agreement on their respective planning areas. This means that we will be entangled in the same"Catch 22" that we were faced with when we decided to develop in the county. We have already spent almost four years getting our approvals. That includes almost one year trying to annex into Fredrick. My recollection is that you were opposed to that annexation,and because of that opposition we decide to go to the county. The MUD does not require annexation if the town con not service the property. The MUD also requires that the towns agree on planning areas,which has not been done. Unless I can be provided with hard evidence that water taps will be available when we need them,and assurance that Fredrick will not appeal the annexation,I don't see how I can possibly go forward. Rick, I know you understand that we cannot be expected to wait until the town can provide us sufficient water service. I also believe that your attempts to settle on planning areas with Fredrick were sincere,even though they did not succeed. Unless there is some unimaginable compromise,an attempted annexation to the town at this time would be equal to a loss of our property and our investment.
