Pursuant to adjournment of the 20th inst. , the Boa d of County Commissioners of Weld
County, Colorado, met at nine o'clock A. M. , with the f blowing members present, viz:

corrections thereto the same were approved.

The Board having under consideration the matter of s( le of lumber and material contained
Ik'\ . in the Old Hyles Bridge and the Board having decided t t it is for the best interest of the
county that such material be sold on motion it was orde ed that the following notice be
published, to—wit:
NOTICE OF SALE
OLD HYLES BRIDGE
Notice is hereby given that on Tuesday, October 28th 1919, at 2: 00 P. M. , the Board of
County Commissioners of Weld County, Colorado, will pro eed to sell the. Old Hyle Bridge on
the premises to the highest and best bidder for cash.
Bridge to be sold by the span, purchaser to remove all material from the bed of the river.

The Board having under consideration the matter of heat of certain offices when used evenings
on motion it was ordered that the custodian purchase an oil stove for use when and where
required in the Court House.

-PAW EE BRIDGE ORDER APPROVING BOND
P C Murry presented his bond in the sum of $700.00 with the National Surety Company as
surety thereon, as contractor for the construction of the Pawnee Bridge located between sections
2 and 3, Tp. 8, Range 56. The same having been considered by the Board on motion it was ordered
that said bond be approved and deposit made with bid returned to contractor.

A petition signed by I J Flatt and others praying for the laying out of a public road described
as follows, to-wit:
Commenoing at the center of section 36, Township 3, Range 61 W, thence
North on the half section line to the Chicago, Burlington and Quincy
Railroad. This road being between three quarters 3/4 and one mile (1)
mile in length.
was presented to the Board when the following action was taken and entered of record, to-wit:
It appearing to the Board that the right of way for said road through patented lands is
donated by the owners thereof, and the Board believing that the public good requires the
laying out of said road, on motion it was ordered that the prayer of the petitioners
be granted and that the right of way through unpatented government land be taken in
accordance with Section 2477 of the revised Statutes of the U. S. , and the line of
road prayed for be and is hereby declared a public highway. The Clerk is directed to record
the petition, plat the road as granted, and notify the Road Overseer of the proper
district to open said road to travel at once.

The Board having under consideration matters in connection with the construction of the
t,'Hyles Bridge, the following agreement was made and entered into, to—wit:

AGREEMENT
THIS AGREEMENT, made in duplicate this 20th day of October, A. D. 1919, by and between
THE STATE HIGHWAY COMMISSION (acting on behalf of the State of Colorado and hereinafter
referred to as "THE COMMISSION") , and the BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD (hereinAfter referred to as "THE COUNTY") ,
WITNESSET H:
THAT, WHEREAS, on the 20th day of October, A. D. 1919, by resolution duly adopted,
TEE COMMISSION (acting under authority of an act relating to highways, known as "The
Highway Law" , approved April 20, 1917, being Chapter 78 of the Session Laws of 1917, made the
following apportionments to THE COUNTY:
FOR CONSTRUCTION WORK:
For construction on Hyle Bridge, Ten Thousand Dollars-2 (410,000)
Making a TOTAL, from the STATE, for CONSTRUCTION, of Ten Thousand Dollars, ($10,000) ;
AND, WHEREAS, said apportionments were made conditional upon certain agreements of THE
COUNTY, by whioh it is to expend, from the county funds, upon the State Routes above specified.
FOR CONSTRUCTION WORK:
For construction on Hyle Bridge, Three Thousand Three Hundred Thirty Three Dollars,
($3,333.00) ;
Making a TOTAL, from the COUNTY, for CONSTRUCTION, of Three Thousand Three Hundred Thirty
Three :Dollars, ($3,333.00) ;
NOW, THEREFORE, IT IS COVENANTED AND AGREED by And between the respective parties:
1. That THE COUNTY, in consideration of the aid to be extended to it by the payment of the
apportionments hereinabove specified as made to it by THE COMMISSION, has done or will do any
and all things necessary or proper to meet and comply fully with the consitions hereinabove
set forth, and to provide promptly the moneys hereinabove described as payable by it; and that
THE COUNTy will expend such moneys within the current calendar year, or within such further
time as may be agreed upon by THE COMMISSION and THE COUNTy, under the supervision of the
State Highway Commissioner and according to the rules and regulations of THE COMMISSION, all
of which is evidenced by a certain resolution adopted by THE COUNTY on the 7th day of November
A. D. 1919.
2. That THE COMMISSION, in consideration of the aforesaid acts, covenants and undertakings -
of THE COUNTY, will pay the aforesaid apportionments at the time and in the manner prescribed
by the rules and regulations of THE COMMISSION and in compliance with the terms and conditions
of such apportionments.
3. That THE COMMISSION and THE COUNTY will co—operate by causing their respective officers
and employees to do and perform any and all aots and things necessary to carry out the terms
and conditions of this agreement.

and sealed on its behalf by the State Highway Commissioner, attested by the Secretary of

was presented to the Board when the following action was taken and entered of record, to-wit:
The Board having carefully considered the report of the viewers herein, as well as the
objections made thereto, and finding the report correct as to form, and believing the public
good requires the laying out of the road as recommended by the viewers, it was on motion
ordered that the report be approved and adopted, and the road therein described and recommended
by the viewers be and is hereby declared a ,public highway. The Clerk is directed to record

RESOLVED, by the Board of County Commissioners of the County of Weld, State of Colorado,
that 373 mills on the dollar of valuation is hereby fixed as the rate of levy necessary to
raise the interest which will become due in the year 1920 on the bonds of said District, and in
acordance with the statute the said rate of levy is increased 15* making a levy of 429 mills
on the dollar of valuation for said interest on said bonds; and
BE IT FURTHER RESOLVED, that 310 mills on the dollar of valuation is hereby fixed as the
rate of levy . necessary to raise the installment of principal which will become due in the
year 1920 on the bonds of said District, and in accordance with the statute the said rate of
levy is increased 15*, making a levy of 356 mills on the dollar of valuation for said install-
ment of prinoipal on said bonds; and
BE IT FURTHER RESOLVED, that the rate neceSsary to raise the amount required to meet the
maintenance, operating and current expenses of said District for the fiscal year commencing

$20,850 is required to pay the installment of principal which will become due on the 1st day
of September, A. D. 1920, on:'the outstanding bonds of said District; and

for the purposes of said District of the real estate included in said District and assessable

IRRIGATION DISTRICT
WHEREAS, it has been certified to the Board of County Commissioners of Weld County,by the
Board of Directors of the Green City Irrigation District, that the. sum of $2000.00 is required to
pay the interest which will become due during the year 1920, on the outstanding bonds of said
District, end that the sum of $3600 is required to pay the installment of principal which will
become due during the year 1920 on the outstanding bonds of said District , and that the
sum of $2144.00 is required to meet the maintenance, operating and current expenses of said
District for the fiscal year commencing on the 1st day of January 1920 ; and
WHEREAS, the returns from the Assessor of Weld County, show-the total assessment and valuation
for the purposes of said District of the real estate include3::in said District and assessable
for the purposes of said District to be $19,290, the number of acres of land assessable being
1929 acres, assess d at the rate of $10.00 per acre; Now. Therefore, Be it
RESOLVED, by the Board of County Commissioners, County of Weld, State of Colorado, that
104 mills on the dollar of valuation is hereby fixed ag the rate of levy necessary to raise' the
interest which will become vitae in the year 1920 on the bonds of said District, and in accordance
with statute the said rate of levy is increased 15*, making a levy of 119 mills on the dollar
of' valuation for said interest on said bond; and
BE IT FURTHER RESOLVED, that 187 mills on the dollar of valuation is hereby fixed as the rate
of levy necessary to raise the installment of principal which will become due in the year 1920,
on the bonds of said. District , and in accordance with the statute the said rate of levy is
increased 15*, making a levy of 215 m111s, on the dollar of valuation for said installment of
princi pal on said bond; and
BE IT FURTHER RESOLVED, that the rate necessary to raise the amount required to meet the
maintenance, operating and current expenses of said District for the fiscal year commencing on
4he lst day of January, 1920, as estimated by the Board of Directors of said District, is hereby
fixed; and in accordance with the statute the said rate is increased 15*, mating a total levy
of 128 mills on the dollar of valuation for said maintenance, operating and current expenses:

BE IT FURTHER RESOLVED, that a levy of 119 mills on the dollar of assessed valuation for \
- Irrigation District purposes of all the assessable real estate included in said District in
Weld County, Colorado, to raise the amount of money required to pay interest which will become
due in the year 1920 on the bonds of said District , be and same is hereby made on all the
assessable real estate included in said District, situate in said County of Weld; and

the maintenance, operating and current expenses of said district for the fiscal year
commencing on the 1st day of January, 1920, is Twenty (20) cents for each acre of land
assessed in 1919 for the purposes of said district according to the valuation placed thereon
for district purposes and including the fifteen (15*) per cent which the Board of County
Commissioners is required to add in making the levy for said expenses; and
WHEREAS, the returns from the Assessor of Weld County show the total assessment and
valuation for the purposes of said district of the real estate included therein and assessable
• for the purposes of said district to be $776,320.000.he number of acres of land assessable
being 77631.57 acres assessed at the rate or, $10.00 per acre ; now, therefore, be it
RESOLVED, by the Board of County Commissioners of the County of Weld, State of Colorado , that
the rate necessary to raise the amount required to meet the maintenance, operating and current
expenses of said district for the fiscal year commencing on the lst day of January, 1920, as

the Statute the said rate is increased fifteen (15*) per cent , making a levy of Twenty (20)

$2.70 per acre is required to be raised to pay the interest which will become due during the

WHEREAS, it has been certified to the Board of County Commissioners of Weld County, by the
Board of Directors of the Henrylyn Irrigation District that the amount required to meet the
maintenance, operating and current expenses for the fiscal year commencing on the let day of
January 1920 is $1.00 for each acre of land assessed for 1919 for the purposes of said District
according to the valuation based thereon for District purposes and including Fifteen (15*) per cent
which the Board of County Commissioners is required to male the levy for •said expenses; and
WHEREAS, it has been certified by the said Board of Directory_ o7,.said District to the Board of
County Commissioners of Weld County that a tax of $3.17 per aglIEWS levied to provide for the
payment of coupons of the bonds of the District for the present and ensuing year and that the
said tax be distributed as follows:
For payment of coupons of the first issue of bonds 41 cents per acre
For the payment of coupons of the second issue of bond s $2.76 per acre
which amount included the 10 which the Board of County Commissioners is required to add in
making the levy for said purposes; and
WHEREAS, it has been certified to the Board of County Commissioners by the Board of Directors
of The Henrylyn Irrigation District that the sum of x`3.1 e ,cre is required to be raised to
meet the principal of the first issue of bonds which arell or which will become due during the year
1920, itOluding the 150 required to be added; and
WHEREAS, tHe returns from tHe Assessors of the counties of Weld and Adams show the total
asseesment and valuation for the purposes of said District of the real estate included in said
District to be $311,900.00 the number of acres of land assessable being 33 190.38 acres, assessed
at the rate of $10.00 per acre; now, therefore, be it
RESOLVED, by the Board of County Commissioners, county of Weld, State of Colorado, that the
, rate necessary to raise the amount required to meet the maintenance, operating and current
expenses of said District for the fiscal year commencing on the 1st day of January, 1920,
as estimated by the Board of Directors of said District; anD in accordance with the statute said
rate is increased 15* making a levy of $1.00 on each acre of land assessed for the taxes of
1919 for the purposes of said District based on the valuation of $10.00 per acre for said

rate necessary to raise the amount required to be paid upon interest upon said bonds of the second
issue as estimated by the Board of Directors of said Distriot is hereby fixed; and in accordance
with the statute said rate is increased 15* , making a levy of $2.76 on each acre of land assessed
for the taxes of 19IR for the purposes of said District to be applied on interest upon the bonds

included in said District situate in the County of Weld; and be it further
RESOLVED, that a, levy of 276 millS on the dollar of assessed valuation for. irrigation
district purposes of all the assessable real estate included in said District in Weld County,
to raise the amount of money to pay interest now due or to become due in the year 1920, on he
bonds of the second issue of said District, be and same is hereby made on all the assessable
real estate included in said District situate in said county of Weld; and be it further
RESOLVED, that a levy of 313 mills on the dollar of assessed valuation for irrigation
District purposes of all the assessable real estate included in said District in Weld County,
to raise the amount of money required to pay the principal of said bonds of the first issue
now due or to become due in the year 1920, be and the same is hereby made on all of the
assessable real estate included in the said District situate in said County of Weld; and be -

RESOLVED, that the above and foregoing levies as herein made, shall include the levy heretofore

� ABSTRACT OF ASSESSMENT
The abstract of assessent as returned by the County Assessor, and filed in this office
on September 3rd, 1919, showing a grand,. total valuation of taxable property in Weld County for
the year 191, to be$107,746,500 was presented to the Board. And in considering said abstract
it appears that since the. filing thereof by the County Assessor and its approval by the
Colorado Tax Commission, certain changes were made in the corporation valuations by the State
Equalization Board; that after said changes were made the grand total valuation of all taxable
property in Weld County for the year 1919 is $107,742,580.OO.

INCREASE OF TAX LEVIES YEAR 1919
The following communication was received from the Colorado Tax Commission authorizing the
Board of CountY Commissioners of Weld County, Colorado, to fix levies for the year 1919 in excess

fully understood by the Board and the same was accepted as sufficient authority to proceed with

The petition of the Industrial Sugar Company respectfully shows and alleges:
1. That your petitioner is a corporation duly organised and existing under the
laws of the State of Colorado with its principal office and postoffice address at Fort Morgan,
in the County of Morgan and State of Colorado, but With authority to transact ..all kinds of
business for which it ra,s incorporated in the County of Weld, State of Colorado. That the
principal business for which your petitioner was incorporated was and is to construct
equip, and operate beet sugar factories for the manufacture of all kinds of sugar and its
by—products out of sugar beets; that incidental thereto is has the right to acquire the
necessary sites for beet sugar factories, for railroad rights—of—way thereto, and the construc—
tion and operation of railway trains thereon by itself or others for the purpose of carrying
on its principal business as aforesaid; that for said purpose and for and as a sugar factory
site, your petitioner has purchased and now ownes the North one—half (N-2) of the Southeast
Quarter (SE4) of Section Thirty—one (31) in Township Two (2) North of Range Sixty-six (66)
West of the Sixth (6) P. M. in Weld County, Colorado, the south. line of which adjouns the
town of Fort Lupton on that side, to wit, the West side of the Public Highway running North
and South at that point, but that the said town of Fort Lupton incorporation limits do not
extend that far North on the North side of said wagon road at said point, and hence is not
affected by the territory right--of-wayPto be covered in this application. That your petitioner
has let a contract to a responsible contractor for the erection of a new six hundred ton daily
capacity beet sugar factory on said site as aforesaid, to be ready for the 1920 crop of beets,
and at a cost to your petitioned. in excess of eight hundred thousand do.lars ($600,00) ; that
your petitioner has secured a right.,of-way by the purchase for its railway tracks from the
right-of-way from the Union Pacific ailway Company through the Southwest quarter (SW1)
of Section Thirty—two (32) , same Township and Range to and near the Southeast (SE) corner of
said eighty acres as aforesaid and ail of it with the exceptions of across the Public Hi ;hway
at said point between said Sections Thirty-one (31) and Thirty-two (32) , Township Two (2) North
Range Sixty-six (66) , and that it is absolutely necessary for the purpose of conducting your
petitioners business, and for which it was incorporated, to have permission to cross said
Publio Highway on grade with two railway tracks at and near the Southeast (SE) corner of the
Northwest quarter(NW1) of the Southeast quarter ( SE 1) of said Section Thirty-one (31)

as aforesaid and as more particularly set forth in the plat and may hereto attached and made a
part hereof. That said highway at said point is Primary Highway No. 49, and at which point it
runs North and South, is straight, and practically level, and is situate in a level prairie
country and presents no obstructions; that said tracks when built will be practically on the
grade of said highway and will only be a short distance in length each way therefrom and used '
for the private switching purposes of said company only to and from said factory and at a
slow rate of speed when crossing said highway, and that during possibly nine months of the
year no cars to speak of will be operated on the same across said Public Highway, that
during what is known "the season" there would probably be from four to six or eight trains of
cars in different numbers backed across' the "same to` anti from said factory per day.
2. That the postoffice address of this applicant is Fort Morgan, Colorado; that
the postoffice address of its general. counsel, William A. Hill, who presents this applicatiom is
Room 1205 First National Bank Building, Denver , Colorado, Telephone Main 2511; that this
application is made under the provisions of Section twenty—nine as amended April 16, 1907, of the
Public Utilities Acts of the State of Colorado, and that in making it your petitioner is wt.iling
to comply with the regulations and in accordance with the specifications provided for in the
Commissioner's record in re Improvement of Grade Crossing in Colorado, 2 Colo. P.U.C. 128;
that the estimated cost of said tracks over said highway as aforesaid will be about five
hundred dollars ($500) .
WHEREFORE; your petitioner and applicant prays and asks that the Public Utilities
Commission of the State of Colorado at the earliest possible period make its order
authorizing this petitioner and applicant to construct and operate said railroad tracks
over said Primary Public Highway No. 49 at the points heretofore stated with the ri:,ht to
continue and maintain the same for the purpose aforesaid and so long as itself, it`s successors
or assigns may have need for the same for the purposes for which they will be constructed and
under further reasonable rules and regulations as may ea provided by your honorable body, and
your petitioner will so ever pray.

DAILY BALANCES- TREASURER.
Came before the Board T. C. Phillips, County Treasurer, and it appearing to the Board that
under statute adopted by the 1919 session of the Legislature, a minumum of 2* is required to be col—
lected by the Treasurer from banks upon daily balances. And the matter having been thoroughly
discussed and considered by the Board and Treasurer, it was moved and carried that it is the sense
of the Board that the amount of 2* be collected by the Treasurer upon his daily bank balances.
IN THE MATTO OF ABATEMENT OF THE
G HENRYLYN IjPIGATI0N DISTRICT TAXES. ORDER OF REMISSION.
THAT WHEREAS, it has been certified to this Board that the following described land,to-wit:
That portion of the SVIle of Seo. 27, Tp. 1 N.R. 63 West, lying South of Prospect Lateral,
containing 80 sores more or less, standing in the name of Lawrence E. Wolffrum, which land is in-
cluded in the Eenrylyn Irrigation District, has been selected by the Bondholders committee (ap-
pointed under a certain agreement dated June 15th, 1918, between the Henrylyn Bondholdsers compa-
ny, the Henrylyn Irrigation District and others) and the Board of Directors of the Henrylyn Irriga-
tion District to be relieved from taxes for the bond interest, in accordance with paragraph XIII of
said contract providing for the ultimate exclusion of certain lands now in said district, and tor th
present relief of said lands from the taxes for bond interest.

AND WHEREAS, the district has certified its willingness to releive said land from all other
irrigation taxes.
NOW THEREFORE, in accordance with said certificate and said contract be it, hereby resolved
that the Treasurer of Weld- County, Colorado, be and he is hereby authorized to cancel all Henrylyn
Irrigation District taxes- assessed and now standing against said described land.
BE IT FURTHER RESOLVED,, that the County Assessor be and he is hereby directed to make- no
further assessments fort hhe taxes- of the said The Henrylyn Irrigation District against said land
until the further order of this Board.
PROVIDED, nevertheless that this order for abatement shall in no manner affect or release
any tax sale certificate now outstanding issued to any individual or company; and in case there
shall be any such outstanding tax sale certificate this order shall in no manner affect or release
such outstanding tax sale certificate or certificates.

Irrigation District, that the lands hereinafter described belonging to the persons whose games are
set opposite the following descriptions , cannot be benefitedby the irrigation works of said dis-
trict, beoause of some natural vonditionand• on that aocount have been by due and proper proceedings
as by statute provided, excluded from the said Henrylyn Irrigation District, and
WHEREAS, the Board of Directors of said district have filed with the County Commissioners
certified copies of resolutions passed by said Board, excluding the lands hereinafter described and
by said resolutions have requested that the taxes now duefor irrigation district purposes be abated;
NOW THEREFORE, in accordance with the resolutions of the Board of Directors of the Henrylyn.
Irrigation District, be it hereby resolved that the Treasurer of Weld County, Colorado, be and he is
hereby authorized to cancel all Henrylyn Irrigation District taxes assessed and now standing against

Pursuant to adjournment of the 6th inst. , the Board of County Commissioners of Weld County,
Colorado, met at nine o'clock a. m. , with the following members present, viz:
