Dear Mrs. Kirkmeyer, I appreciate being able to meet with you last Tuesday at your office. You were most generous with your time. I am pleased that you will look into the thing that would allow us to make an application for a plat on our 70 acres. With the commitment we have for 50 water taps from Left Hand Water District,we would like to apply for a subdivision plat on our 70 acres. We understand we could get a final plat only the number of lots we have a firm commitment for water taps. We would final plat the balance of the lots, as taps become available. I also understand that any entitlements are good for only three years. This prevents the development of a plan that is outdated. Carlson P.O. ox 247 Eastlake, Colorado, 80632 Dear Mr. Carlson, The Board of County Commissioners met to discuss their policy concerning adequacy of water. The Board has historically based the determination of adequacy of water upon the ability of an applicant to demonstrate that water will be available for the proposed development, and a guarantee of this availability has been extended in a contractual form. The Board did discuss the possibility of recognizing additional documentation and contractual agreements to validate adequacy of water. The Water District has indicated an interest in negotiating with developers in the affected area to obtain commitments for financing infrastructure expansions to serve development in the affected area. The financing aspects of obtaining this commitment from the water provider have always been the responsibility of the developer. The Weld County Commissioners are aware that Left Hand Water District is waiting approval for 1041 review by the Boulder County Commissioners, and they understand the possible time delays associated with this review. They are, nevertheless, reluctant to change their policy on water adequacy. The Board has historically relied upon this policy, and believes it is in the best interest of Weld County to maintain tangible evidence of water availability. The Board did discuss the possibility of recognizing additional documentation and contractual agreements to validate adequacy of water.
