RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH
LEGAL ACTION AGAINST DAVID WAGY FOR VIOLATION OF THE WELD COUNTY
ZONING AND BUILDING ORDINANCES -VI #9600054
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, David Wagy, VI #9600054, is allegedly in violation of the Weld County
Zoning and Building Ordinances, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been correctec, and
WHEREAS, on the 13th day of April, 1999, a public hearing was held before the Board
of County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, David Wagy, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to refer said
violation to the Department of Planning Services, with an instruction to delay action upon such
referral until May 13, 1999, to allow time for the property owner to bring the subject property into
compliance by removal of current tenant and for an inspection of the property by the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that said violation be, and hereby is, referred to the Department of
Planning Services with an instruction to delay action upon such referral against David Wagy
until May 13, 1999, to allow adequate time for the removal of the current tenant and for the
property to be brought into compliance.

CASE SUMMARY

February 14, 1996 Initial complaint received. Triplex built in the agricultural zone district on a one acre
lot.
April 23, 1996 Site inspection conducted. The triplex located on the property is not a use allowed by
right in the agricultural zone district. The property is also in violation of the Building
Code Ordinance. Remodel of the structure from a single family dwelling to a multi-
family dwelling without the appropriate building permits. There is also a welding
business on the property covered under a Nonconforming Use (NCU-308).
April 23, 1996 Five day letter sent.
April 29, 1996 Telephone call between Julie Chester, Zoning Compliance Officer and David Wagy.
It was recommended that he meet with a Planner to discuss a Planned Unit
Development application, and an amendment to the Comprehensive Plan.
April 30, 1996 Presented this violation to Planning staff. The property is located in the Mixed Use
Development study area. It was determined that Mr. Wagy needed to meet with Todd
Hodges, Planner, and apply for a sketch plan, on November 1, 1996, apply to amend
the Comprehensive Plan, and complete a change of zone and a final plat.
April 30, 1996 Letter to Mr. Wagy from Julie Chester explaining the decisions made in the staff
meeting.
July 1, 1996 Thirty day letter sent.
July 26, 1996 Letter from Daniel Maus,Attorney, advising the Department of Planning that he will be
representing Mr. Wagy.
September 10, 1996 Telephone call between Julie Chester and Dan Maus,Attorney, representing Mr. Wagy.
He stated that they are dealing with Ed Day with Roberts Architects and things are
proceeding.
November 18, 1996 Telephone call between Ed Day and Julie Chester. Ed called to give a status report on
the Wagy property. He stated that the survey is complete and a meeting between them
is scheduled next week. He stated that the Wagy's were having financial problems.
March 25, 1997 Telephone call between Todd Hodges, Planner and Ed Day, Roberts Architects. Mr.
Day stated that he has not been able to get the application together due to a loss in
staff. He will be completing other projects and will then finish with the Wagy
application.

March 3, 1998 At the request of Todd Hodges, Planner, Sharyn Frazer left a telephone message for Ed
Day. Based on the fact that no progress has occurred within the last year, the message
stated that he would need to submit the Sketch Plan application within one week or the
Department of Planning would proceed with the violation.
March 9, 1998 Mr. Day came into the office and picked up the application for a sketch plan. It was
agreed that he would submit the materials by April 18, 1998.
March 18, 1998 A schedule was submitted to the Department of Planning Services with definite time
lines for submittal of all three phases on the Planned Unit Development. Staff agreed
to extend the submittal date for the sketch plan until May 20, 1998.
May 20, 1998 A sketch plan application was submitted for processing to the Department of Planning
Services.
August 17, 1998 Comments regarding Sketch Plan from Julie Chester, Planner, to David Wagy. The
letter included a complete overview of requirements based upon consistency with the
Weld County Subdivision ordinance, Zoning Ordinance, Planned Unit Development
Ordinance, the Comprehensive Plan and the Mixed Use Development Plan.
June 24, 1998 Facsimile addressed to Monica Daniels-Mika from Robert Nash, surrounding property
owner, opposing the Planning Unit Development.
October 14, 1998 Julie Chester and Sharyn Frazer met with Mr. Nash regarding the situation occurring on
the property. Mr. Nash was opposed to David Wagy being able to continue to rent the
property while waiting for possible approval of a Planned Unit Development.
February 2, 1999 E-Mail from Robert Nash, surrounding property owner to Julie Chester, inquiring as to
the status of the application.
February 24, 1999 Office visit between Julie Chester and Todd Hodges, representative for Mr. Wagy. Julie
explained to Mr. Hodges that the change of zone application must be submitted to the
Department of Planning by March 10, 1999, or the case would be scheduled before the
Board of County Commissioners on April 13, 1999. Todd Hodges indicated that they
had been talking to the Town of Frederick about annexation, however, they are having
problems because of contiguity. Mr. Hodges will discuss option with Ed Day,
Architect, and Mr. Wagy.
February 24, 1999 Telephone call between Julie Chester and Ed Day, Roberts Architects. He was
informed that if the change of zone application was not submitted by March 10, 1999,
the violation would be scheduled before the Board of County Commissioners at
violation hearings on April 13, 1999.
March 2, 1999 Letter from Julie Chester to David Wagy. The letter informed him that the change of
zone would need to be submitted by March 10, 1999, the structure converted back to
a single family dwelling, or he would be scheduled to appear at violation hearings.

Dear Mr. Wagy:
The Department of Planning Services' staff and various referral agencies have reviewed your
Sketch Plan application for the proposed Wagy Planned Unit Development (PUD). The Sketch Plan
comments and agency referral responses may not be all inclusive, as other concerns or issues may
arise during the remaining application processes.
Copies of the following referral agency comments are enclosed:

OVERVIEW
The PUD Sketch Plan proposes a residential lot with an existing multi-family structure and a
commercial lot with an existing welding shop, located on two acres. The proposal is located within
the MUD area and is proposed to be served by Left Hand Water District and private septic systems.
The application proposes two lots which are each approximately one acre.
The following comments are based upon consistency with the Weld County Subdivision Ordinance,
Zoning Ordinance, and Planned Unit Development Ordinance, the Weld County Comprehensive
Plan and Mixed Use Development Plan.

r COMPREHENSIVIE PLAN:
C.Goal 2 ensures the compatibility of commercial land uses with adjacent land uses. This proposal
is located in a rural area with Agricultural uses and residences surrounding the proposal. The
commercial use has been substantiated as a Nonconforming Use, however, expansion of this use
would further conflict with surrounding land uses. Future applications must address mitigation of
any potential conflicts occurring between non-compatible land uses.
C.Goal 3 states that new development should either be located in areas free of natural hazards,
such as wildlife, geologic hazards, floods and high winds, or be designed to mitigate the hazards.
This site is located within an area which is designated as a moderate geological hazard. The
application materials indicated that the site is not within a geological hazard area, however,
according to The Geologic Hazard Area map, dated May 10, 1978, prepared from data and
information from the Colorado Geological Survey, this site is located within an area which is
designated as a moderate geological hazard. Future applications must.address mitigating this
hazard. J
C.Goal 4 ensures that adequate public services and facilities are available to serve the commercial
development or district. The application materials indicate that each structure is served by an
individual septic system. The Weld County Health Department indicated in their referral response
that they were unable to locate a permit for the multi-family structure. The PUD ordinance, Section
2.20, states that all PUD's containing commercial and/or industrial uses shall be served by a public
sewer system. All PUD's shall be served by a public water system as defined in the PUD ordinance.
Future applications shall address incorporating a public sewer system for the proposal. Urban-scale
development requires public services on an urban level.
C.Goal 5 ensures maintenance of a quality commercial environment which is free of unsightly
materials including inoperable vehicles, unscreened outdoor storage of items, refuse and litter.
Section 33.6.1.9 of the Weld County Zoning Ordinance addresses outside storage and states that
uses in the commercial Districts involving outdoor storage of vehicles, equipment, or materials when
permitted shall be screened from all public rights-of-way and all adjacent properties. Adequate
screening for outside storage must be addressed in future applications. A Site Plan Review would
also be required prior to any use on the commercially zoned lot as indicated in the Weld County
Zoning Ordinance, as amended.
C.Goal 7 States that all new commercial development should pay its own way.
R.Goal 2 ensures that adequate public services and facilities are available to serve the residential
development or disl:rict. The St. Vrain Sanitation District serves the MUD area with public sewer and
shall be utilized in future applications. Section 2.9.2 of the MUD Ordinance states that the St. Vrain
Sanitation System, a private sanitation system, shall service all sewage disposal within the MUD
area for uses except those specifically called out and exempted from the PUD process in Section
2.5 of the plan. This proposal is not listed as an exempted use under Section 2.5 and, therefore,
future applications shall address connecting to the public sewer system.
R.Policy 5 states that residential development should demonstrate compatibility with existing
surrounding land-use in terms of:general use, building height, scale, density,traffic, dust, and noise.
Staff has concerns regarding the compatibility of a multi-family residence located in a rural area.
Surrounding uses include single-family residences and Agricultural uses. Future applications must
address mitigation of potential incompatibility issues previously stated.

P.Goal 3 requires adequate facilities and services to assure the health, safety, and general welfare
of the present and future residents of Weld County. Mountain View Fire District will require a review
of construction plans for utilities prior to any construction materials being delivered to the site.
Future applications shall address these, and the other concerns of Mountain View Fire Protection
District. The fire district and school district will have further opportunity to comment if you choose
to proceed further with the PUD application process. (Also, see the above commercial and
residential goals regarding connection to a public sewer system.)
The application materials state that domestic water is being provided by the Left Hand Water
District, however, a letter from the water district indicating that water is being supplied for the
commercial and residential lots has not been supplied. Future applications will include a
"commitment to serve" letter from the water district.
Future submittals shall address how the proposed PUD meets the intent of the public facilities
standard which requires urban-scale development be provided with an urban level of public
services.
PUD.Policy 4.2 states that a planned unit development which includes a residential use should
provide common open space free of buildings, streets, driveways or parking areas. Common open
space is defined as any usable parcel of land or water essentially unimproved and set aside,
dedicated, designated or reserved for public or private use or for the enjoyment of owners or
occupants of land adjoining or neighboring such an area. The common open space should be
designed and located to be easily accessible to all the residents of the project and usable for open
space and recreation. Open space restrictions are permanent, not for a period of years. A
homeowners association shall be established before any residences are sold, and membership in
the association is mandatory for each residential owner. The homeowners association is
responsible for liability insurance, taxes and maintenance of open space, streets, private utilities
and other facilities.
The Sketch Plan map has not indicated any common open space for this proposal. The MUD area
requires a minimum of 20% common open space for residential areas and 20% common open
space for commercial uses. In areas preserved as common open space, a detailed description of
the type(s) of grass and landscaping which will be utilized and the maintenance schedule for such
landscaping shall be submitted to the Department of Planning Services for review and approval.
Future application, submittals shall give the location of and details for all common open space
amenities as documented in the PUD Sketch Plan.
T.Policy 4.2 states that the County should review and determine that all road, street, or highway
facilities are adequate in width, structural capacity, and classification to meet the traffic demands
of any land development. The County will, as a condition of land development, require
improvement of roads, street, or highway facilities when dictated by traffic demand and land
development patterns. The applicant will be required to commit to the necessary improvements
needed to.meet the MUD Standards for construction at a later date. A Road Improvements
Agreement between the county and the property owner/applicant shall be submitted prior to
recording the final plat. The applicant shall reserve an additional right-of-way for Weld County
Road 7 and Weld County Road 20 '/2 to accommodate future build out and this reservation must
be delineated on the plat in future applications. Both roads are designated as four-lane undivided-
secondary roads in the MUD area. Both Weld County Roads 7 and 201/2 would require 100 feet
of right-of-way for full build out purposes; there is presently 60 feet.

There are two access points designated for each lot of this PUD. Future applications shall
delineate one main access from a county road. All access shall be from an internal road system,
with no direct access on to the county road. Section 2.1 of the Planned Unit Development
Ordinance 197 (Access Standards) states that all PUD developments will be served by an internal
paved road system. Therefore, in accordance with Design Standards for streets as set forth in
Section 10.2 of the Weld County Subdivision Ordinance, the interior street system is required to
be paved. Design and construction of the streets must conform to county standards and then, if
requested for designation as public streets by the applicant, they may be accepted for
maintenance by the county in the future.
SUBDIVISION ORDINANCE

Section 10.2 of the Weld County Subdivision Ordinance, as amended, dictates street standards for
PUD's and subdivisions. T.Policy 4.3 states that all road, street, and highway facilities should be
developed, constructed, and paved in accordance with adopted county standards. County streets
are required to have a minimum 60 foot right-of-way width, which includes 10 to 11 feet per lane and
4 feet per shoulder. All cul-de-sac radii must be a minimum of 65 feet and maximum block length
between intersecting streets is 1,500 feet.
Access to the proposal shall adhere to MUD standards and all roadways within the proposal shall
adhere to MUD design standards. It appears that the roads do not meet the minimum width of 60
feet of right-of-way.
Concerns pertaining to access shall be addressed in the change of zone application should the
applicant wish to proceed
Section 10.6 dictates utility easement standards for county subdivisions and PUD's. These
standards are strictly enforced by the Weld County Utility Advisory Committee, requiring a minimum
total width of 20 feet apportioned equally on abutting properties within the development and a
minimum of 15 feet allocated along front lot lines and any other perimeter areas. Future submittals
must include the delineation of utility easements on each lot as required by the Design Standards.
Section 12 lists subdivision improvements that are the responsibility of the property
owner/developer to complete. The required improvements agreement which is entered into between
the owner/developer and Weld County guarantees construction of all improvements in accordance
with the approved PUD final plan; the agreement is covered in Section 13. Future submittals must
include a completed improvements agreement addressing road construction, water system, utility
extension, landscaping, signage and any other applicable elements of the PUD.
PUD ORDINANCE
Section 2.1 discusses Access Standards for the internal street(s) of a PUD. Future applications
shall address access standards as stated previously.
Section 2.3 states that Bulk Requirements (minimum setback, offset, lot size, height of buildings
and lot coverage) in the PUD zone district may be varied from the requirements of a specific zone
district. The applicants have not indicated any deviation from the R-3 (Medium Density Residential)
district Bulk Requirements for the proposed development.

Section 2.5 states that common open space shall be designed to be useful to the occupants and/or
residents of the PUD Zone District for recreational and scenic purposes. Future applications shall
address open space which is easily accessible to all residents of the proposed development.
Section 2.6 Compatibility of uses within the proposed PUD as well as with surrounding uses needs
to be further documented by the applicants. It appears that most of the adjacent land use is
dedicated to farming and residential uses. The department recommends that any future owner
should be made aware of the agricultural uses existing in the area and recommends that the Right
To Farm Covenant should be placed on the plat.
Section 2.9 A Landscaping plan is required for all PUD applications. Future applications shall
include a landscape plan which addresses Section 6.3.3 of the PUD Ordinance and Section 2.6 of
the MUD Ordinance. The plan shall include plant materials, planting schedule and on-going
maintenance. Additionally, the Landscape map shall delineate landscaping in accordance with the
design criteria set forth in Section 2.6 of the MUD Ordinance. The map shall meet the requirements
of Section 9.3 of the PUD Ordinance.
Section 2.11 states that all development located within the MUD area, as delineated on the MUD
Structural Map 2.1, shall be subject to the additional development criteria as indicated in the MUD
Ordinance #191.
Section 4.4.1.3 Compatibility of uses permitted in the proposed PUD with the existing or future
development of the surrounding area as permitted by the existing zoning, and with the future
development as projected by the Comprehensive Plan or master plans of affected municipalities and
Intergovernmental Agreements. The property under consideration is located within the designated
urban growth boundaries of the Towns of Firestone and Frederick and the Tri-Area
Intergovernmental Agreement area. The Towns of Firestone and Frederick did not respond to a
referral sent on June 19, 1998. However, according to the Intergovernmental agreement, the
applicant must enter into an annexation agreement with either the Town of Frederick or the Town
of Firestone.
Section 4.2.5.8-The applicant shall complete a statement describing how the storm water drainage
will be handled. The Department of Public Works indicated that storm water drainage was not
adequately addressed in the Sketch Plan and must be addressed if the applicant chooses to go
forward with the Change of Zone.
Section 4.4.1.2 The conformance of the uses allowed in the proposed PUD with the Performance
Standards of the PUD Zone District contained in Section 2 of the PUD Ordinance. Section 2 lists
20 Performance Standards as criteria to be considered in the review of all PUD applications. The
Standards covered here are those that are most applicable to this proposal, however, future
applications shall address all of the 20 standards which are applicable.
Section 2.14-Parking Requirements-All parking and loading areas within a PUD
shall comply with Section 41 of the Weld County Zoning Ordinance. All parking and
loading areas shall be paved and striped, unless specifically waived by Weld County
Public Works Department.
Section 4.4.1.5 The determination that the street or highway facilities providing access to the
property are adequate in functional classification, width, and structural capacity to meet the traffic
requirements of the uses of the proposed PUD Zone District, The Public Works Department has

reviewed this request and, in a referral response received June 29, 1998, determined that the
requested right-of-way width does not meet Weld County standards and stated that the applicants
will be required to delineate additional right-of-way as a reservation. Public Works further states
that Geometric Design Standards and Road Structure Requirements should be utilized in designing
the typical road cross section to adequately match the development. The typical cross section
should reflect the MUD cross section including lane widths, sidewalk, curb and gutter and overall
right-of-way.
The applicant will be required to submit an Improvements Agreement Regarding Collateral for all
improvements for the proposed PUD. Future PUD submittals shall demonstrate compliance with
Weld County street standards and the plat amended to show the required additional right-of-way.
Section 4.4.1.6 Compliance with the applicable requirements contained in the Weld County Zoning
Ordinance regarding overlay districts, commercial mineral deposits, and soil conditions on the site.
The proposed development does lie within an Geological Hazard area as described in the Weld
County Zoning Ordinance and on the Geological Hazard area map. The proposal also lies within
the Mixed Use Development Area and shall adhere to MUD standards.
Section 6.3 outlines the 8 Major Components of the Development Guide.
Section 6.3.6 specifies that signage within a PUD shall adhere to all requirements in the PUD,
Zoning and MUD Ordinances. All permanent signs and sign structures shall be delineated on the
plat and shall require building permits.
The remaining major components include Service Provision Impacts, Landscaping Elements, Site
Design, Common Open Space Usage, MUD Impacts and Intergovernmental Agreement Impacts
which have been addressed'elsewhere in these comments.
MUD ORDINANCE
Section 1.1.3 Amendment Procedure-The applicant must submit a proposal to amend the MUD
Structural Plan in accordance with the procedures set forth in Section 1-2 of the Weld County
Comprehensive Plan, as amended. Any applicant submitting a proposal to amend the MUD
Structural Land Use Map 2.1 shall also submit a deed or legal instrument to the Department of
Planning Services identifying their interest in the property. This procedure can only occur in May
and November each year and must be completed prior to the Change of Zone.
This proposal must meet all the design standards of the Mixed Use Development Ordinance
design standards, as defined in the PUD ordinance, Section 2.17.
Section-2.6.2, #4 This section in the MUD Ordinance states that-whenever the use of the property
to be developed or redeveloped will conflict with the use of adjoining property, there shall be an
opaque planted screen between the two properties. The screen shall moderate the impact of
noise,light, aesthetic concerns, and traffic.
Section 2.6.3, #5 This section in the MUD Ordinance states that loading, service, or storage areas
must be screened with an opaque screen that is an integral part of the building architecture. Chain
link fencing with slats or pallets are not an acceptable screening material. Plant material shall be
used to soften the appearance of the screen.

The Development Guide requirements, which are a part of the Change of Zone application must
address the eight major components of the PUD development and must also meet the
requirements of the Mixed Use Development Ordinance. This issue must be addressed in future
applications. Other concerns may arise during the PUD Change of Zone and Final Plan application
processes.
SUMMARY
If you choose to proceed with the PUD application process, the next step is to submit the PUD
Change of Zone application, unless determined that substantial changes from the submitted Sketch
Plan would warrant the need to submit a new Sketch Plan application. The PUD Change of Zone
procedures are described in Section 5 of the Weld County PUD Ordinance, Ordinance 197. Your
submittal must address all issues discussed above, as well as the questions and concerns of the
referral agencies as listed previously. The PUD Change of Zone submittal must include a complete
development guide.
Due to the magnitude of concerns regarding this site, you may decide to seek conversion of the site
to uses allowed by right.
Please review the enclosed materials and then call to schedule an appointment so that I may
reserve a sufficient amount of time to meet with you. The purpose of the meeting will be to
• familiarize you with the PUD District application procedure and discuss any problems or concerns
identified in this letter. Once again, comments made during the Sketch Plan phase of the PUD and
agency referral responses may not be all inclusive, as other concerns or issues may arise during

I have asked for several years how and why are there multiple rentals across
the street from me with very little actual clear response on the matter_
For the record, rm opposed to any duplex, triplex, apartment and or trailer
rentals in this area.
The two biggest issues that come to my mind are my property value impact
and setting a precedence.
Since I live 60 feet away and my bedroom is line of sight from family
upstairs, the two rentals downstairs, and the trailer rental on the property
owned by Daviid Wagy, I am most directly effected by the traffic, noise,
parking issues and other matters that,go along with tenants who are,in a
revolving rental mode.
All the homes and farms for miles in any direction are single family, and
the people who come to this area are paying the price to enjoy those benefits.
I have already talked to an appraiser and a multiunit across the street from
me will diminish the value of my property. Who then will compensate me
for this devaluation?
If the Wagy FIJI)is approved, does this mean that all of us can mow build
apartments and it will be approved? What will the limit he as to how big
and how many units.
Who will be the governing body for character of the community, what
character or flavor will there be as to where will retail be, multi-family,
single-family, parks, schools, gravel pits, gas stations, adult stores, bars,
churches, farms and all the other issues that require a community to ban
together and seek a local government to resolve these kinds of things?

building code violations. I will also be representing him in his PUD application process. I have.just
visited with Mr. Wagy today and have been unable to contact Mr. Loren Bley who will, in all

The uses on the above described property are being considered as a zoning violation of Section 31.2 and
31.2.1 of the Weld County Zoning Ordinance. This is not a use allowed by right in the Agricultural zone
district.
The violation can be corrected by amending the Comprehensive Plan and completing a Planned Unit
Development or converting the triplex back into a single family residence.
It is the intention of this office to assist and cooperate with you without imposing undue hardships;
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from July I, 1996 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.
