WHEP A3, the County Assessor of Weld Count,;, Colorado,
in preparing the 1903 assessment rolls, which were duly certified
to the County 'treasurer for collection in 1904, erroneously
designated Lot Nine (9), Block Three (3), North Greeley, 1n Weld
County, Colorado as Lot Nine (9), Block Three (3), Lucerne; and
IV:AREAS, the area subdivided and platted as North Greeley,
Weld County, Colorado is generally known as Lucerne, and contains
a United States Post Office named and designated by the United
Stf tes Postal Department as Incerne; and
'.'.HEREA3, on December 27, 19014, the 1903 taxes on Lot Nine
(9), 91oelc Three (3), North Greeley, Weld County, Colorado, not
having been paid, the same was sold for taxes to Max Gerry, and
at said tax sale the Certificate w9s issued describing said property
as Lot Nine (9), Block Three (3), Lucerne, when, in fact, the
property sold, and intendad to be sold, was Lot Nine ()), Block
Throe (3), North Greeley, Weld County, Colorado; and
WHEREAS, thereafter, and on April 20, 1908, Treasurer's
Deed was duly executed and delivered to Max Gerry wherein again
the description was erroneously designated as "Lucerne" instead
of the correct description of "North Greeley"; said deed being
subsequently, and on. August 26, 1910, recorded in Book 231, Page
294, Weld County Records; and
JHEREAS, the County Assessor and County Treasurer in Veld
County, Colorado, have, by affidavit, reads knoien the status of the
records of their offices relative to the erroneous description
contained in said Treasurer's Deed.
NOW, THEREFORE, BE a RESOLVED that the County Treasurer
of `.field County, Colorado be, and he is hereby, authorized, empowered
and directed to issue a correction Treasurer's Deed to Max Gerry
and to conform the records of his off ioe, designating the sub-
division in a correction deed as "North Greeley, Weld County,
Colorado; in lieu of and in place and in steed of "Lucerne".
It is further directed, prior to the delivery of said correction
Treasurer's Deed, that the County Treasurer deliver the same to
the County Attorney, Fon. S. Robert Houtchens, for his approval
as to form.

AFFIDAVIT
Charles 0. Bursiel, being first duly sworn, upon his oath
deposes and says:
That he is the duly elected and qualified Treasurer of Weld
County, Colorado; that he has examined the records in the office
of the County Treasurer as they pertain to tax sale of December
27, 1904 for taxes assessed for the year 1903 against
Lot Nine (9), Block Three (3), Lucerne,
which resulted in the issuance of Tax Sale Certificate No. 57lbr
the December 27, 1904 tax sales; that the property actually
assessed and sold on December 27, 1904, resulting in the issuance
of Tax Sale Certificate No. 57, and subsequently in the Treasurer's
Deed to Tex Gerry, dated April 20, 1906 and recorded August 26, 1918
in Book 231, Page 294, Weld County Records, was
Lot Nine (9), Block Three (3) in the Town of North
Greeley, Weld County, Colorado;
that the area platted as North Greeley in Weld County, Colorado is
commonly referred to as "Lucerne", there being a United States Post
Office located in the platted area of North Greeley known and desig—
nated by the United States Postal Department as "Lucerne", whereas
the Subdivision was given the name "North Greeley" according to the
map and dedication recorded March 16, 1892 in Book 2 of Plats, Page
149, Weld County Records, which is located in the
East Half (El) of the Southeast Quarter (SRO of
Section Eighteen (18), Township Six (6) North,
Range Sixty-five (65) West of the 6th p.M., Weld
County, Colorado.

which said property was listed as

That subsequently,the taxes not being paid for 1903, said
property was sold for taxes on December 27, 190, and tax sale
certificate No. 57 We issued therefor.
That the Subdivision in North Greeley, Weld County, Colorado,
which was platted and dedicated on March 16, 1892 in Book 2 of Plats,
Page 49, Weld County Records, and which Subdivision is located in the
East Half (El) of the Southeast Quarter (SEA) of
Section Eighteen (18), Township Six (6) North, Range
Sixty-five (65) West of the 6th P.M.,
is commonly known as Lucerne on account of the location within the
Subdivision of a United States Post Office known as and designated
by the United States Postal Department as Lucerne.
That the assessors records for 1903 assessments, insofar as
they pertain to the assessment of
Lot Nine (9), Block Three (3)
are in error where the same designate the Subdivision as Lucerne;
the correct subdivision was in fact, and should have been d esignated
on the records of the Assessor, as North Greeley*
