RE: APPROVE REQUEST FOR CONSENT TO EXCEPTION LOCATION WELL FROM
PATINA OIL AND GAS CORPORATION AND AUTHORIZE CHAIR TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Weld County, Colorado, has received a request for Consent to Exception
Location for Frenzel B 15-5 from Patina Oil and Gas Corporation, 1625 Broadway, Suite 2000,
Denver, Colorado 80202, and
WHEREAS, said Consent to Exception Location covers land more particularly described
as follows:
Township 5 North, Range 64 West, 6th P.M.
Section 15: SW'/NW'% (2348' FNL, 462' FWL)
Weld County, Colorado
WHEREAS, Weld County is entitled to .225 percent royalty interest on production, and
WHEREAS, the exception to the location has been requested due to topographic
limitations, namely the South Platte River, and
WHEREAS, said Consent to Exception Location has been reviewed by a member of the
Weld County Attorney's staff and found to be in order, and
WHEREAS, the Board deems it advisable to approve said Consent to Exception
Location on the parcel of land described herein.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Consent to Exception Location with Patina Oil and Gas
Corporation, on the hereinabove described parcel of land be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said Consent to Exception Location.

Dear Interest Owner:
Patina Oil & Gas Corporation ("Patina") requests your written consent to an exception location for the
captioned well (the "Well")to be drilled to test the Codell formation.For such Well,the Colorado Oil and
Gas Conservation Commission("COOCC") requires the Well to be located in the center of the forty acne
tract,with a tolerance of two hundred d(200)feet in any direction.Due to the topography of the area,Patina
has staked the Well at a location 2348'FNL and 462'FWL as shown on the attached plat.
The Rules and Orders of the COOCC requite that Patina obtain consent from the owners of the cornering
and contiguous units toward whom the Well is located.You are an owner in a cornering and contiguous
unit If you object to the exception location,you must file a written objection with the COGCC within 30
days of your receipt of this notice.The address of the COGCC is The Chancery Building, 1120 Lincoln
Street, Suite 801,Denver,Colorado 80203.A copy of the objection letter should also be sent to Patina.
If you have no objection to the referenced well location, please evidence your consent to the exception
location by returning one original, hilly signed copy of this letter to the undersigned at your earliest
convenience.Thank you for your prompt attention to this matter.Please call if you have any questions.

. : Patina Location Exception
COLORADO
Patina Oil has requested an exception for a drilling window location(Frenzel B 15-5) adjacent to
a drilling unit partially owned by the County (Loustalet 15-1). The regulatory window would
place the well in the South Platte River if no exception is obtained. The move places the well
165' south of the edge of the window but still 29T from the edge of the unit. (would normally be
no closer than 1120' from edge of unit). The County only holds a royalty interest in the amount
of.225% in Loustalet 15-1 and the Prima Energy, the operator, has no objection to the exception.
I therefore recommend consent to the exception.
