TO CONSIDER AMENDMENT AND COMBINATION INTO ONE PERMIT, OF USE BY
SPECIAL REVIEW PERMIT #847 AND AMENDED SPECIAL USE PERMIT #369 FOR
OPEN CUT GRAVEL MINING IN THE A (AGRICULTURAL) ZONE DISTRICT, GEISERT
PIT - COUNTY OF WELD
A public hearing was conducted on June 24, 1998, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated May 20, 1998, and duly published June 10, 1998,
in the Platteville Herald, a public hearing was conducted to consider the request of the County of
Weld for a Site Specific Development Plan and Amended Special Review Permit#847 to consider
amendment and combination into one permit, of Use By Special Review Permit#847 and Amended
Special Use Permit #369 for Open Cut Gravel Mining in the A (Agricultural) Zone District. Lee
Morrison, Assistant County Attorney, made this a matter of record. Scott Ballstadt, Department of
Planning Services representative, presented a brief summary of the proposal and entered the
favorable recommendation of the Planning Commission into the record as written. Mr. Ballstadt
gave a brief description of the location of the site and explained this application is for the purpose
of combining Special Review Permit#847 and Amended Special Use Permit#369 into one permit.
Currently they are two separate mining operations and uses. He stated this application also
amends the permit boundary to exclude two portions of the existing permit which have been
annexed by the City of Greeley. Mr. Ballstadt stated the Planning Commission voted to delete
Condition of Approval #2.F. regarding landscaping of the site and he requested the Board delete
Development Standard #13, also dealing with landscaping, for consistency.
Don Carroll, Department of Public Works representative, stated this request is to combine two
separate mining operations; however, it will reduce the size of the mining area. He explained the
City of Greeley annexed a 10-acre portion of the permit adjacent to 11th Avenue for the new
Sheriff's Posse facility and an additional 19 acres for the new Public Works facility. Mr. Carroll
stated there is an 8.2 acre wetland area which will be banked for future use. He stated this
proposal will be similar to other County mining operations. In response to Commissioner Kirkmeyer

and Chair Harbert, Mr. Carroll stated he anticipates there will be no problem complying with
Development Standard #14 and explained he has gone through the State application process and
the site is in compliance with the State landscaping and reclamation requirements. He stated the
County will not do landscaping along the "H" Street corridor because it is likely the City will annex
this area in the future and then the landscaping would have to be moved to allow for development.
Mr. Carroll stated the present grasses and shrubs are adequate as required by the State and once
the area has been annexed, heavier landscaping will be considered. In response to Chair Harbert,
Mr. Ballstadt stated the permit boundary is adjacent to 11th Avenue; however, this amendment
does not include that portion of the permit because it has been annexed by the City and the County
does not have jurisdiction. Responding to Chair Harbert, Mr. Carroll stated it is likely the City will
want landscaping along "H" Street between the two annexed parcels; however, the City did not
specifically request it. No public testimony was offered concerning this matter.
Commissioner Kirkmeyer moved to approve the request of the County of Weld for a Site Specific
Development Plan and Amended Special Review Permit #847 to consider amendment and
combination into one permit, of Use By Special Review Permit #847 and Amended Special Use
Permit #369 for Open Cut Gravel Mining in the A (Agricultural) Zone District, based on the
recommendations of the Planning staff and the Planning Commission, with the Conditions of
Approval and Development Standards as entered into the record and the deletion of Development
Standard#13. The motion was seconded by Commissioner Webster, and it carried unanimously.
This Certification was approved on the 29th day of June, 1998.
