RE: VIOLATIONS OF THE WELD COUNTY ZONING ORDINANCE
A public hearing was conducted on January 12, 1999, at 10:00 a.m., with the following present:
Commissioner Dale K. Hall, Chair
Commissioner Barbara J. Kirkmeyer, Pro-Tern - EXCUSED
Commissioner George E. Baxter
Commissioner M. J. Geile
Commissioner Glenn Vaad
Also present:

Planning Department representative, Sharyn Frazer
Building Inspection Department representative, David Sprague
The following business was transacted:
I hereby certify that a public hearing was conducted to consider whether to authorize the
County Attorney to proceed with legal action against the individuals named for violations of the
Weld County Zoning Ordinance. Cases were heard as follows:
VI #9800063 - OTTINGER: David Sprague, Building Inspection Department, presented the
case report for the record and stated the property is in violation of the Weld County Building
Code Ordinance. This case is being continued from October 13, 1998. Mr. Sprague stated
some of the violations have been taken care of and the remaining violations are being worked
on. Mr. Sprague stated if another building permit is issued, the remaining violations can be
completed under that permit.
Mr. Charles Ottinger, property owner, was present at the hearing. Mr. Ottinger stated due to
being out of town frequently and financial responsibilities, he has been unable to complete
construction. Responding to Commissioner Geile, Mr. Ottinger stated the walls in the loft of the
garage needed sheet rock to be complete. In response to Commissioner Hall, Mr. Ottinger
stated he will be out of town until April, 1999 and will have the construction completed by the
end of June, 1999. Mr. Sprague stated a new building permit would give Mr. Ottinger six
months to complete the work. Responding to Commissioner Baxter, Mr. Sprague stated a
Certificate of Occupancy could be issued if the occupant applies for and is issued another
building permit to ensure the work is completed.
Commissioner Geile moved to refer VI #9800063 against Charles and Renee Ottinger to the
County Attorney for legal action, with the instruction to delay action upon such referral until
January 19, 1999, to allow adequate time for a new building permit to be obtained, allowing for
additional time for the property owners to bring the property into compliance. The motion was
seconded by Commissioner Baxter, and it carried unanimously.

VI #9800177 - FOGG: Mr. Sprague presented the case report for the record and stated the
property is in violation of the Weld County Building Code Ordinance. Mr. Sprague stated the
final inspections for this property are scheduled for January 13, 1999, and recommends
continuing this violation until the February 9, 1999 hearing.
David Fogg was present at the hearing.
Commissioner Baxter moved to continue VI #9800177 against Jerry and Ruth Fogg/David and
Micki Fogg until February 9, 1999, at 10:00 a.m. The motion was seconded by Commissioner
Geile, and it carried unanimously.
VI #9800171 - DAMON: Sharyn Frazer, Department of Planning Services, presented the case
report for the record and stated the property is no longer in violation of the Weld County Zoning
Ordinance.
Mark Damon was present at the hearing.
Commissioner Vaad moved to dismiss VI #9800171 against Mark Damon. The motion was
seconded by Commissioner Baxter, and it carried unanimously.
VI #9800181 - ANCHONDO: Ms. Frazer presented the case report for the record and stated
the property is in violation of the Weld County Zoning Ordinance. Ms. Frazer stated several
attempts (in English and Spanish) have been made to contact the property owners with no
results. Ms. Frazer submitted pictures marked as Exhibit A. In addition, Ms. Frazer stated as of
January 11, 1999, the amount of derelict vehicles, campers, trailers and mobile homes had
increased; and therefore, she recommends this violation be sent to the County Attorney for
immediate legal action. In response to Chair Hall, Ms. Frazer stated she obtained the property
owners names from the Warranty Deed on file at the Clerk and Recorder's office, dated
July 29, 1996.
Ruben or Ruby Anchondo, property owners, were not present or represented at the hearing.
Commissioner Geile moved to refer VI #9800181 against Ruben and Ruby Anchondo to the
County Attorney for immediate legal action. The motion was seconded by Commissioner
Baxter, and it carried unanimously.
