Box 326 Greeley, CO, 80632 Subject: West Hill-n-Park Fourth Filing improvements agreement Dear Mr. Lind: Department of Planning Services staff reviewed the West Hill-n-Park improvements agreement, submitted on February 14,along with the Board of County Commissioner's resolution for the West Hill-n-Park Final Plat approved on August 30, 1996. The following concerns should be addressed prior to the scheduled hearing at 9:00 am on Wednesday, February 28, 1996 and are as follows: 1. Evergreen Landscape Buffer-Condition of Approval number four(4)states,"An evergreen vegetative landscape buffer shall be planted along the northern edge of the West Hill-n-Park fourth filing. A planting plan shall be submitted to the Department of Planning Services staff for review and approval. The planting plan shall show the location, size and numbers of proposed landscape materials. The landscape buffer shall be installed prior to release of building permits. The landscape buffer shall be maintained by the Developer and Homeowners' Association. Dead,dying, or destroyed vegetation shall be replaced immediately after notice at the Developer and Homeowner' Association expense." a. Planting Plan-The proposal for the evergreen buffer which was submitted on January 19, 1996 shows 16 shade trees or conifers planted at approximately 100 feet apart. Staff is concerned that the proposal does not meet the requirements or the intention of the resolution concerning the landscape buffer. It is important that the species of the evergreens be indicated on the planting plan so that staff may determine if the proposed distance between trees is adequate to create a landscape buffer. Staff does not feel that a 100 foot spacing of any species of tree would be adequate for the landscape buffer. The trees shall be of an evergreen species and shall be planted north of Mesa Verde Drive within the Hill-n-Park 4th filing. The planting plan for the evergreen buffer was not attached to the packet submitted on February 14, 1996. A planting plan meeting all the criteria of condition of approval number four (4) should be submitted prior to the scheduled hearing with the Board of County Commissioners for staff review and comment. b. Maintenance of Buffer- Staff has concerns about the feasibility of the proposed maintenance of the evergreen buffer and would like the applicant to describe in detail how the trees will be maintained. A 962419 Kenneth Lind West Hill-n-Park Fourth Filing Page 2 drip irrigation system would be much more efficient in direct watering of the trees and conservation of water than the use of a tanker truck,as proposed, for the irrigation of the trees. Staff recommends that the evergreen landscape buffer and any proposed irrigation system be installed on or prior to May 1, 1996. 2. Parks-Condition of Approval number five(5)states,"The parks located in the Third and Fourth filings of West Hill-n-Park shall be constructed. The parks shall be constructed in compliance with the West Hill-n-Park Official Unit Development Plan which was recorded January 5, 1971. Playground equipment such as slides,sandbox,and swings shall be provided,along with picnic tables and benches. A landscape plan shall be submitted to the Department of Planning Services for the park areas and shall be in compliance with the Official Unit Development Plan. The applicant shall submit a landscape and site development plan for the park areas located in the Third and Fourth Filings to the Department of Planning Services for review and approval. The parks shall be completed prior to release of building permits in the Fourth Filing. The Developer and Homeowners' Association shall be responsible for construction and maintenance of the park areas" a. Playground Equipment-The proposal submitted on February 14, 1996 includes a proposed site plan of the parks located in West Hill-n-Park Third and Fourth filings. The proposal does not include locations or costs for slides and sandboxes. Staff suggests that slides be included in the two larger parks, one located in the Third filing and one in the Fourth Filing of West Hill-n-Park and that the omission of the sandboxes needs to be justified. Staff recommends that the playground equipment be installed prior to release of any building permits in the Hill-n-Park Fourth filing. b. Planting Plan - The proposed site plan also includes a planting plan for the parks in the Third and Fourth filings. After reviewing the proposed list of species for the grass and trees there are concerns after discussing the proposal with the Ag Extension office and various nurseries of the area. The proposed grass seed mix of 50%Fairway Crested Wheat,20%Perennial Rye, 10%Annual Rye,and 20% Tall Fescue appears to be a dryland pasture mix and is not suitable for a park environment. The species that were suggested by the nurseries were a blend of Bluegrasses or a blend of Fescues for a park environment. The Fescues are a more drought tolerant and lower maintenance species but will require some irrigation to maintain an adequate stand. Staff recommends that the trees and associated irrigation system be installed on or prior to May 1, 1996 and that the turf and any proposed irrigation system be installed on or prior to June 1, 1996. c. Maintenance of Plantings - The watering and maintenance of the grass has not been adequately addressed through this proposal. An irrigation system should be investigated for the grass areas of the park in addition to the drip system that is proposed for the trees in the parks. The selection of shade trees for the parks is somewhat broad and staff would recommend deleting the Cottonless Cottonwoods from the list of proposed trees. The selection of Maples and Ash are much more appropriate for a small park setting. Please take into consideration all the concerns and comments that the Department of Planning Services has made. If a new proposal for the improvements agreement is not found satisfactory, staff will recommend denial of the West Hill-n-Park Fourth Filing improvements agreement. Any proposed amendments to the improvements agreement should be submitted at least three (3) days prior to the Board of County Commissioners hearing. In your February 22nd letter you indicate that we submitted an Improvements Agreement to you on February 14th. Actually, the Improvements Agreement was submitted to you on January 19, 1996 and on February 14, 1996 a slightly revised Improvements Agreement was submitted to you (the only change was in three dates and the addition of $300 . 00 for fence completion) . All information related to the evergreen landscape buffer and parks was provided to you on January 19, 1996 . The one month it took staff to review and respond, and your subsequent demand that modifications be submitted to you within one business day of your letter was illogical and unreasonable. In any event, we submit with this letter a revised Improvements Agreement which is in total compliance with the January 5, 1971 Development Plan. Following the format of your February 22nd letter, changes we have made are as follows : 1 . (Evergreen Landscape Buffer) . Highland Nurseries has provided a planting plan which is included. The plan provides for 34 - 6 ' Austrian pine trees with a caliber of 1-1/2 to 1-3/4 inch. The plan also provides for a drip irrigation system which will be designed and installed at the time of planting by Highland Nurseries . Maintenance, like all other parks and landscaping, will be provided by the developer until the Homeowner' s Association F:\KFL\LETTERS\LUNDHODG.4 962419 Weld County Department of Planning Services February 26 , 1996 Page 2 takes over maintenance . With the drip irrigation system it is contemplated that maintenance will be minimal . The trees and drip irrigation system will be installed on or before May 1, 1996 . 2a. (Playground Equipment) . Slides have been included in the larger parks in both the Third and Fourth Filings . 12 ' x 12 ' sand boxes have been added to the two parks in the Third Filing and the two parks in the Fourth Filing. The playground equipment will be installed on or before May 1, 1996 . 2b. (Planting Plan) . Highland Nurseries has designed appropriate types and locations of trees to be installed in both Third Filing and Fourth Filing parks . Highland Nurseries is of the opinion that cottonless Cottonwood trees are especially appropriate for parks . The type of tree and location of planting is specifically identified in the enclosed plans . The trees and associated irrigation system will be installed on or before May 1, 1996 . The grass seed mix as originally proposed has not been changed. In closing I would note that your comments of February 22, 1996, especially as related to the parks are not in compliance with the 1971 Development Plan. Staff should also comply with said 1971 plan rather than attempting to add conditions and requirements that are not included in said 1971 plan. As you may know Baessler Construction Company, Inc. is the exclusive builder of homes in the 3rd. filing of West Hill-n-Park known as Arrowhead South. As the sales agents for and representatives of Baessler Construction Company, Inc. we have a substantial interest in seeing that the parks in said subdivision are constructed to meet public park standards. In addition, the third filing covenants dictate that, at the completion of park construction, the Arrowhead South home owners association will maintain said parks. The home owners association will, therefore, also be assuming the liability of said parks. Thus, the parks must meet certain quality, safety an ADA standards. In an effort to become better informed as to the afore mentioned standards we have had several conversations with Ron Williams parks superintendent and Steve Agerot parks supervisor city of Greeley, Tom Hamblen city of Evans, Bob Churchich Churchich Recreation playground consultant, EDAW park architect, several landscape companies, and insurance carriers. In short, our findings indicate that building an insurable park is a process that calls for a professional design and the professional installation of approved park fixtures and landscaping. WE also found out that the Arrowhead South homeowners association must show that the parks are of sufficient size as to prevent overcrowding which could cause accidents. Since the county has never insisted that West Hill-n-Park Inc. construct the parks in earlier subdivision filings we are concerned the children now living in those areas may create an overcrowding condition in the third filing parks. Mr. Roy Lundvall has apparently represented to the homeowners that the parks will not have a sprinkler system and that watering will be done via a water truck. The line was constructed and installed by Hall Irwin based upon design by Zoyioupolous Engineering. The City of Evans is in a position to accept this line, as well as the balance of the water distribution system pending fire flow verification at the highest elevation in Arrowhead. As of this date, we have not been able to complete the field testing that will verify there are 1,000 gallons per minute available. As soon as we are able to verify this, I will recommend accepting the water distribution system to the Evans City Council. Prior to seeding the ground will be prepared with a harrow to provide some leveling and to break up the surface to better accept the seed. Seeding: Following all preparation, apply seed at the rate of three pounds per thousand square feet with the use of a Brillion or Broadcast seeder as best suits the conditions. Raking-in of seed will not be necessary with the use of the drill-type seeders. Seed used shall be 50% Fairway Crested Wheat, 20%Perennial Rye, 10% Annual Rye, and 20% Tall Fescue, All seed shall be good quality with germination and purity of at least 85%.
