HomeMy WebLinkAbout991480.tiff HEARING CERTIFICATION DOCKET NO. 99-36 RE: APPROVE SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT #1226 FOR A MINERAL RESOURCE DEVELOPMENT FACILITY IN THE A (AGRICULTURAL) ZONE DISTRICT - LIGHTNING WIRELINE, INC. A public hearing was conducted on June 16, 1999, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chair Commissioner Barbara J. Kirkmeyer, Pro-Tern - EXCUSED Commissioner George E. Baxter Commissioner M. J. Geile Commissioner Glenn Vaad Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Lee Morrison Planning Department representative, Eric Jerman Health Department representative, Sheble McConnellogue Public Works representative, Don Carroll The following business was transacted: I hereby certify that pursuant to a notice dated June 2, 1999, and duly published June 5, 1999, in the Fort Lupton Press, a public hearing was conducted to consider the request of Lightning Wireline, Inc., for a Mineral Resource Development Facility in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Eric Jerman, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. Mr. Jerman described the location of the site and stated the surrounding uses consist of the Town of LaSalle, agriculture, residences, and two Union Pacific Railroad lines. He further stated of eight referrals sent, two responded in favor and none were opposed. The Town of LaSalle indicated the site may be annexed in the future. Mr. Jerman submitted a letter from Todd and Lisa Spindler, marked Exhibit E, in favor of the proposal if the traffic remains the same, and a letter from James and Mary Ann Conlin, marked Exhibit F, opposed to the application. Mr. Jerman stated Condition of Approval#2.D provides for a waste handling plan to address any chemicals at the site. Mr. Jerman clarified that the Town of LaSalle has no conflicts with this proposal and no prime farm ground will be taken out of production because farming is not feasible due to the size of the parcel. In response to Commissioner Geile, Mr. Jerman reiterated that the Town of LaSalle has no concerns with this proposal and Condition of Approval #2.D was added by the Health Department prior to review by the Planning Commission. Responding to Chair Hall and Commissioner 13axter, Mr. Jerman indicated the locations of the various surrounding uses and stated he is not sure of the Town's zoning. Commissioner Geile commented that the Town of LaSalle had not reviewed the proposal at the time of the Planning Commission hearing. 991480 �� P� Pit PL1309 HEARING CERTIFICATION - LIGHTNING WIRELINE, INC. (USR #1226) PAGE 2 Mike Reavis, applicant, stated he has tried to comply with all of the requirements, as well as address the concerns expressed by surrounding property owners. He stated Lightning Wireline, Inc., will not use Weld County Road 50.5, and will exit to the south on Walnut Street, which is gravel, and turn west on Weld County Road 50 to State Highway 85. He also stated he will provide dust control north cf the site. In response to Commissioner Geile, Mr. Reavis stated he would prefer to build a six-toot screening fence rather than plant trees. Mr. Jerman clarified that Planning Services staff will review the proposed Landscaping Plan; however, greenery is recommended. Mr. Reavis stated there is a cluster of trees on the property which he would like to transplant and spread throughout the property. In response to Commissioner Baxter and Chair Hall, Mr. Reavis indicated he will comply with what the Planning Services staff requests and added that he has reviewed and agrees with the Conditions of Approval and Development Standards. Todd Spindler, surrounding property owner,expressed concern with oil running off the property and damaging nearby crops or livestock. He stated that although he is gone during the day, his neighbors report heavy truck traffic and dust control has not been applied to the roads. Mr. Spindler asked whether the hours of operation would be strictly daylight hours, whether the applicant will operate on the weekends, and expressed concern with the damage caused to the railroad crossings by the heavy trucks. He also expressed concern with the possibility of a six-foot chain link fence which will not screen the site. (Switched to Tape#99-22) Chair Hall commented that the existing concerns will be mitigated or improved by the Conditions of Approval or Development Stancards. In response to Commissioner Baxter, Mr. Jerman stated Development Standard#17 was proposed by the Planning Commission, which limits the hours of operation only to daylight hours, including daylight savings time. Mr. Reavis stated it is dangerous to work on oil wells and equipment after dark; therefore, they will stop working at or before dark, and he added they do occasionally work on weekends due to scheduling by oil companies which he cannot control. In response to Commissioner Geile, Mr. Reavis stated the number of vehicles will remain as stated in the application minus two pieces of equipment, and added the hauling trucks are used out on the job sites and are rarely at the property. Responding to Commissioner Baxter, Mr. Reavis reiterated that he does not operate after dark and stated he does not control the activities of the two employees that live on the site after working hours Commissioner Vaad moved to approve the request of Lightning Wireline, Inc., for a Site Specific Development Plan and Special Review Permit#1226 for a Mineral Resource Development Facility in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission,with the Conditions of Approval and Development Standards as entered into the record.
