DA FORD, C/O GLEN DROEGEMUELLER A public hearing was conducted on April 26, 1995, at 10:00 a.m., with the following present: Commissioner Dale K. Hall, Chairman Commissioner Barbara J. Kirkmeyer, Pro-Tem Commissioner George E. Baxter Commissioner Constance L. Harbert Commissioner W. H. Webster - EXCUSED Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated March 29, 1995, and duly published April 6, 1995, in the Windsor Beacon, a public hearing was conducted to consider the request of Louis J. Brighi Fourth Family Limited Partnership and Rudolf G. Danford, c/o Glen Droegemueller, for a Change of Zone from A (Agricultural) to C-3 (Commercial). Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, explained that this request is on a 1.3 -acre parcel which is a result of a recorded exemption approved in January 1995. The parcel has dual zoning, with the north part being Agricultural and the south part being Commercial and accessing 59th Avenue. She reviewed the proposed water and sewer systems and staff referrals and stated the Colorado Department of Transportation requested the access be located no less than 200 feet north of the future edge of the traveled way of State Highway 34 Business Route, which was added as a Condition of Approval. Ms. Dunn also noted a late referral was received from the Colorado Geological Survey which suggested an additional Condition of Approval concerning soil suitability and the submittal of a report for review and comments. She suggested the note also be added to the plat and read proposed language for Condition of Approval #2d into the record. Ms. Dunn entered the favorable recommendation of the Planning Commission into the record as written and reiterated the request to add Condition of Approval #2d. Glen Droegemueller, Attorney, represented the applicant and clarified the original application was filed by both Louis J. Brighi Fourth Family Limited Partnership and Rudolf G. Danford; however, subsequent to the application and the recorded exemption, all title has been exclusively transferred to Mr. Danford. He stated the applicant accepts all Conditions of Approval, including the addition of Condition of Approval #2d, and requested approval. Responding to questions from the Board, Mr. Droegemueller confirmed a cistern would be used and the business would include carpet, wallcovering, and flooring material. He stated the applicant will attach to city water and sewer when it becomes available on 59th Avenue. Mr. Droegemueller stated bottled water will be used for drinking and the cistern's dominant use will be for bathroom facilities until City water and sewer becomes available. No public testimony was offered concerning this matter. Commissioner Kirkmeyer moved to approve the request of Louis J. Brighi Fourth Family Limited Partnership and Rudolf G. Danford, c/o Glen Droegemueller, for a Change of Zone from A (Agricultural) to C-3 (Commercial), based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval as entered into the record, including the addition of Condition of Approval #2d.
