RE: AUTHORIZATION FOR THE WELD COUNTY ATTORNEY TO PROCEED WITH LEGAL
ACTION AGAINST WINSLOW AND ANDREA TAYLOR FOR VIOLATION OF THE WELD
COUNTY ZONING ORDINANCE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Winslow and Andrea Taylor, VI #2192, are allegedly in violation of the Weld
County Zoning Ordinance, and
WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has
not been corrected, and
WHEREAS, on the 8th day of August 1995, a public hearing was held before the Board of
County Commissioners for the purpose of hearing testimony relating to said violation, and
WHEREAS, Winslow Taylor, property owner, was present at said hearing, and
WHEREAS, the Board of County Commissioners deems it advisable to delay referral of said
violation to the Weld County Attorney's Office until January 1, 1996, to allow adequate time for the
property owners to bring the property into compliance and for an inspection of the property by the
Department of Planning Services staff, and
WHEREAS, the Board deems it advisable to proceed with legal action against the above
named individuals without further Board action if the subject property is not brought into compliance
by January 1, 1996.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that if said violation still exists on January 1, 1996, the Weld County Attorney
be, and hereby is, authorized to proceed with legal action against Winslow and Andrea Taylor and
to remedy the violation of the Weld County Zoning Ordinance, and any other persons occupying
the properties, any persons claiming an interest in the properties, and any persons acting in active
concert with the identified parties.

The property referenced above remains in violation of the Weld County Zoning Ordinance. I
have scheduled a meeting with the Board of County Commissioners on August 8, 1995 at
10:00 a.m. to consider the Zoning Violation occurring on your property. This meeting will take
place in the County Commissioners' Hearing Room, first floor, Weld County Centennial Center,
915 Tenth Street, Greeley, Colorado. It is recommended that you or a representative be in
attendance to answer any questions the Board of County Commissioners might have about the
violation.
The Department of Planning Services' staff will be recommending that the Board of County
Commissioners authorize the County Attorney to proceed with legal action to remedy the
violation. Our records indicate that you were made aware of the nature of the violation, the
action necessary to correct the violation, and that you were given sufficient time to remedy the
violation. The property will be reinspected August 7, 1995.

The property was inspected to determine compliance with section 31.2 and 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time.
The property is exactly as it was the first time I inspected it, except now the weeds on the
property are all very high and the neighbors are concerned about a fire hazard. After the
inspection I called the fire district for the area and talked to a gentleman by the name of
Dominique. He was going to check the property to see if there is a fire hazard located there. The
neighbors are still concerned about a health hazard being there also, so I called the Health
Department and talked to Gary Hague again. He said he would also recheck the property.
To bring the property into compliance the non-commercial junkyard would need to be
completely removed from the property or totally screened from all adjacent properties and public
rights of way.

Dear Sirs
I am writing this letter to let you know that I am very concerned
about the properly behind my house. I have called on this matter before.
So far I have yet to see any progress. I am concerned because it is like a
a dump bthindd ay house. We are retired and we aren't able to do much .
Every year I have our house exterminated and we pay quit a hit of money
for this . I feel if this area wasn't so neglected by the owners who do not live
here and never come and clean up would at least cleaned it up or
something . Next to me the house is very neglected I think there is rats in
there. I am worried they will come into my house. We get a lot of hugs
in the summer because the weeds are so high. My address is -445
Dunmire. Please make these people take care of there property is this too
much to ask ? I don't think so

The uses on the above described property arc being considered as a zoning violation of Section 31.2 and
31.3.9 of the Weld County Zoning Ordinance.

The violation can he corrected by removing the non-commercial junkyard or completely screening the
non-commercial junkyard from all adjacent property and public rights of way. If the screening option is
chosen, a detailed screening plan must be submitted and approved by the Department of Planning Staff.
It is the intention of this office to assist and cooperate with you without imposing undue hardships:
however, we have no discretion in this matter if you fail to correct this violation. You have 30 (Thirty)
days from June 6, 1995 to correct this zoning violation. Failure to do so will result in this office
scheduling the violation before the Board of County Commissioners to consider whether to refer the
violation to the County Attorney's office for legal action.

The property was inspected to determine compliance with section 31.2, 31.3.9 of the Weld
County Zoning Ordinance. The property is not in compliance at this time.
The non-commercial junkyard is still located on the property. The non-commercial junkyard
consists of tires, used building materials, large drum containers, and other miscellaneous junk. I
spoke with Mr. Taylor on the phone and he indicated that it would-be very difficult for him to
clean up the property because of time limitations and cost. He also indicated that his lot has
looked this wayfor many years and could not understand why we are giving him a violation
now. I explained that Evanston is a target area and we aren't picking on him individually. He
indicated that he could try and clean up the area.
No pictures were taken at the time of inspection.

County Zoning Ordinance. The property is not incompliance at this time.
This property is directly west of the residential properties on Dunmire Street. The non-
commercial junkyard consists of hundreds of tires, building materials, large drum containers, and
miscellaneous junk. There have been numerous complaints concerning the health hazards of this
property, as many rodents, snakesand other animals live in the tires and other junk. There was
no contact with the property owner at the time of inspection due to the fact that this lot is empty.
To bring the property into compliance the non commercial junkyard would need to be
completely removed from the property or totally screened from all adjacent properties and -public
rights of way.
