Sanford Davis. Fort Lupton, Colorado . Dear Sir:- County Commissioner J. W. Birkle directed me to write to you relative to conditions under which county road was established along the nest side of section 9, Township 1 North. :range 6C V!est. I have looked this matter up and I find that a road thirty feet in width, extending North and South along the Nest side of section 9, said Township r nd Range, was granted by the Board of County Commissioner, of `ele County, Colorado , on the 8th day of May, 1915. It was stipulated in the petition for this road that the Fulton Ditch Company would build a new ditoh as a substitute for the old ditch in the line of road and the earth removed therefrom was to be placed so as to not interfere with public travel. The Board granted the road upon recommendations of the viewers, which was that the county be to no expense of build- ing fences. changing or altering ditches in the road . Mr. Birkle suggests that you take the ditch matter with the Fulton Ditch Company and see if they will not remove the earth from the road and place same in the old ditch as originally agreed upon.
