The Board having carefully considered the report of the.viewers herein,sa well as the objectiorm mode thereto,and finding the report correct as to
form,and believing the public good requires the laying out of the road as recommended by the viewers,it was on motion ordered that the report be approved
and adopted,and the road therein described and recommended by the viewers be and is hereby declared a public highway. The Clerk is directed to record
the report,plat the road,draw warrants in favor of parties for damages awarded,end cause notices to be posted of opening of said road,and notify the
Road Overseer of proper District to open the same to travel in sixty days as required by law.

1, KNOW ALL MEN BY THESE PRESENTS, That Bright A. Hoshiko and
\W Paul Hoshiko, Jr. , first parties, of the County of Weld and
".4 State of Colorado, for the consideration of the herein expressed
V`b promises of Weld County, Colorado, second party, do hereby sell
and convey to Weld County, Colorado, the right of way for a public
highway over and across the following strip of land situate in

a A strip of ground sixty (60) feet wide for public

K Q Beginning at a point which is 149.5 feet West and
30 feet North of the Southeast corner of Section
Thirty-five (35) , Township Five (5) North, Range
Sixty-four (64) West of the 6th P. M. , thence North ,,
21° 18' East 335 feet to a point on the East line
of the newly located County Road; thence North 165: 1
feet; thence South 210 18' West 512.2 feet to the
North line of the County road along the South boundary
of said Section 35; thence Easterly 64.4 feet to the
point of beginning, as is shown on 'the survey attached
hereto .
The consideration of this deed is that Weld County does hereby
agree that it will, at its own cost and expense, upon written
demand of first parties, their heirs, or assigns, install from
one irrigation and one domestic water wells located in the future
by first parties east of said right of way steel pipe lines of not
more than fifteen inches (15" ) in diameter from said wells to a
point fifteen (15) feet beyond the west boundary line of said tract
above described; the installation of said pipelines to be done at
the sole cost of Weld County. When said installations are completed,
Weld County will automatically be released from any further installation
and the future maintenance and repairs owill be borne by first
parties, their heirs or assigns .

The consideration herein stated is in full compensation
for all damages which would be considered and assessed in any
award or verdict in a proceeding under the Statutes Of Colorado,
to condemn said strip of land for public road, and this deed is
of like effect.

WELD COUNTY, COLORADO, TO ACCEPT RIGHT-OF WAY DEED FROM BRIGHT HOSHIKO AND PAUL
HOSHIKO, JR. , FOR A STRIP OF GROUND SIXTY (60) FEET WIDE IN SECTION 35, TOWNSHIP
5 NORTH, RANGE 64,WEST, OF THE 6TH P.M. , TO RELOCATE COUNTY ROAD #820, BETWEEN
SECTIONS 1, 2, 35, 36, TOWNSHIP 5 NORTH, RANGE 64 WEST , CF THE 6TH P.M. :
WHEREAS, it has become necessary to relocate County Road #820 between
Sections 1, 2, 35, 36, Township 5 North, Range 64 West, of the 6th P.M., Weld
County, Colorado, and
WHEREAS, Bright A. Hoshiko and Paul Hoshiko, Jr., have offered the
right-of-way for the relocated road over and across the following strip of land
situate in Weld County, Colorado, to-wit:
A strip of ground sixty (60) feet wide for public highway purposes,
more particularly described as follows:
Beginning at a point which is 149.5 feet West and 30 feet North of
the Southeast corner of Section 35, Township 5 North, Range 64 West,
of the 6th P.M., thence,North 21° 18' East 335 feet to a point on
the East line of the newly located County Road; thence, North 165.1
feet; thence, South 21° 18' West 512.2 feet to the North line of the
County Road along the South boundary of said Section 35; thence,
Easterly 64.4 feet to the point of beginning, as is shown on the survey
attached hereto; for the consideration that Weld County does agree that

health and welfare of the public that said road be relocated.
NOW, BE IT RESOLVED, that the Board of County Commissioners of Weld County,
Colorado, hereby accepts the Right-of-Way Deed and terms as aforesaid from Bright A,
Hoshiko and Paul Hoshiko, Jr. to relocate County Road #820 between Sections 1, 2,
35, 36, Township 5 North, Range 64 West, of the 6th P.M., Weld County, Colorado, and
the Chairman of the Board is hereby authorized to sign this Deed and Agreement on be-
half of the County.
A copy of which Right-of-Way Deed, Surveyor's Map and Agreement is hereto
attached and by reference made a part hereto.
Rtference is hereby made to the Records of the Weld County Recorder,
Recorded Book 1502 at Page 511 •
The above and foregoing resolution was, on motion duly made and seconded,
adopted by the following vote:

ROAD PETITION.
To the Honorable Board of County Commissioners of Weld County, Colo.
GENTLEMEN:—We, the undersigned, Citizens of your County, respectfully represent that the necessities of the
public require a County wagon road to be laid out as follows, to-wit: Commencing at
the south west corner of sec I and the south east corner of sec 2
Tewnship 4 range 64 thence north between sections I & 2 and sec 35 & 36
and. Continue north to '. Le lincoln highway. in township 5 Range 64.

Said road to be not less than sixty (60)feet in width.
We therefore petition your honorable body to cause to be laid out and opened a County road as above described, and
we, the owners of the land through which said road is sought to be laid out, in consideration of the sum of one dollar to us
each and severally in hand paid by the said County of , the receipt of
which is hereby acknowledged, and of the laying out and opening of said road, hereby agrees to give the right of way through
our lands as shown by the plat accompanying this petition, and relinquish all claims for damage by reason thereof.
