HomeMy WebLinkAbout961046.tiff HEARING CERTIFICATION DOCKET NO. 96-27 RE: SITE SPECIFIC DEVELOPMENT PLAN AND SPECIAL REVIEW PERMIT#1112 FOR AN OUTDOOR RECREATIONAL FACILITY (HUNTING, FISHING, FIELD DOG TRIALING, AND BIRD RAISING) IN THE A (AGRICULTURAL) ZONE DISTRICT - BAKER A public hearing was conducted on June 12, 1996, at 10:00 a.m., with the following present: Commissioner Barbara J. Kirkmeyer, Chair Commissioner George E. Baxter, Pro-Tem Commissioner Dale K. Hall Commissioner Constance L. Harbert Commissioner W. H. Webster Also present: Acting Clerk to the Board, Shelly Miller Assistant County Attorney, Lee Morrison Planning Department representative, Gloria Dunn The following business was transacted: I hereby certify that pursuant to a notice dated May 22, 1996, and duly published May 30, 1996, in the North Weld Herald, a public hearing was conducted to consider the request of Greg G. Baker for a Site Specific Development Plan and Special Review Permit for an outdoor recreational facility (hunting, fishing, field dog trialing, and bird raising) in the A (Agricultural) Zone District. Lee Morrison, Assistant County Attorney, made this a matter of record. Gloria Dunn, Planning Department representative, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written, with the following exceptions: Correct Reason #2.d. to reference Development Standard #8 rather than #9; and delete Conditions of Approval #3 and #4, which were met prior to this hearing, and renumber the remaining Conditions of Approval consecutively. Tom Hellerich, Attorney, represented the applicant and stated the applicant plans to enhance the existing wetlands, continue a small cow/calf operation, and add eight dogs and numerous birds to the site. He reviewed the goals as met by the applicant and stated the proposal includes hunting and fishing, with 28-acres of permanent easement to a wildlife status. Mr. Hellerich stated the total site is 149 acres and will include a 1500-foot clubhouse. He noted no objections to staffs recommendation including all Conditions of Approval and Development Standards. Mr. Hellerich further explained there will be approximately 6,000 birds per year on site and trucks will deliver food about every two weeks. He said the hours of operation will be from sunrise to sunset, with a maximum of four hunters allowed on site at one time and only one additional employee from 8:00 a.m. to 5:00 p.m. He reviewed the manner of handling waste and stated 250 trees per year will be added over the next five years as part of a voluntary program. Mr. Hellerich then responded to questions from the Board concerning 961046 PL1032 RE: HEARING CERTIFICATION - BAKER (USR #1112) PAGE 2 previous use of the land and the designated wetlands and reiterated agreement with all Conditions of Approval and Development Standards. James Croissant, surrounding property owner, questioned where hunters would be allowed andhow the dogs would be controlled. Greg Baker, applicant, explained new fences would be installed along with the Federal easement agreement and noted Mr. Croissants input as to the type of fencing is more than welcome. He confirmed all hunts will be guided and the dogs will always be controlled and supervised. Responding to questions from the Board, Mr. Baker stated a sincere attempt to contact any surrounding land owner prior to entering onto land to retrieve a bird is required by law; however, most likely the bird would be left if contact is not possible. Commissioner Hall moved to approve the request of Greg G. Baker for a Site Specific Development Plan and Special Review Permit for an outdoor recreational facility (hunting, fishing, field dog trialing, and bird raising) in the A (Agricultural) Zone District, based on the recommendations of the Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record and as amended by staff. The motion was seconded by Commissioner Baxter, and it carried unanimously. This Certification was approved on the 17th day of June, 1996. APPROVED: �' " 1.
