Respectfully, QadAdti- Judy Curtis Council President Enclosure biuj ayea 982357 RESOLUTION RE: CONFLICT OF INTEREST---Commissioner Connie Harbert WHEREAS, the Weld County Council has been notified of a relationship which may have the appearance of a conflict of interest in Commissioner Connie Harbert's official duty as a Weld County Commissioner; and, WHEREAS, the Home Rule Charter for Weld County provides in Section 16-9- as follows: Section 16---Conflict of Interest (1) General: No County officer, member of an appointed Board, or employee shall have any interest in any enterprise or organization doing business with Weld County which might interfere with the unbiased discharge of his duty to the public and the best interest of the County. This restriction shall not apply where the officer, member of an appointed board, or employee's department has no direct contact nor business transaction with any enterprise or organization. And, WHEREAS, pursuant to Colorado Revised Statutes 24-18-109(3)(b) and 24-28-110, Commissioner Harbert has disclosed (in writing) a relationship which may have the appearance of a conflict of interest in her official duty as a Weld County Commissioner to the Secretary of State of Colorado; and, WHEREAS, the Weld County Council, furthermore does not perceive any personal benefit pursuant to Colorado Revised Statutes 24-18-109 for Commissioner Harbert; and, WHEREAS, the Weld County Council, in interpreting the Weld County Home Rule Charter, does not find this matter to be a conflict of interest, as referred to in Section 16. NOW, THEREFORE, BE IT RESOLVED, that Weld County Commissioner Connie Harbert is not in a position of conflict of interest concerning her sale of property to Gerardo Ramos and Maria Isabel Gutierrez in her continued work on the Board of County Commissioners or as a member of the Housing Authority Board. The above and foregoing Resolution was, on motion duly made and seconded, adopted unanimously on the 17th day of November 1998. In accordance with the Home Rule Charter, section 13-8-(6), enclosed is also a copy of the Council's Report to the People for the third quarter of 1998. aerfa't 4)35-7 Or°, RESOLUTION _LD G' ; :rf 177 rini 23 PI Lj: 52 RE: SALARIES OF WELD COUNTY COMMISSIONERS CLERK TO THE B0JF1 WHEREAS, Section 13-8(1) of the Weld County Home Rule Charter states that the Weld County Council shall set the salaries of all elected officials; and furthermore, in the case of County Commissioners, the Charter provides for a delay in the effective date of said salary increases so as to provide for equal compensation of all Commissioners at all times; and WHEREAS, the Weld County Council has, by a majority vote agreed that the salaries of the Weld County Commissioners should be set at $56,000. per year for the years 2001 and 2002. NOW, THEREFORE, BE IT RESOLVED, that all Weld County Commissioners shall be paid $56,000. per year for the years 2001 and 2002 with said salary to take effect on the first working day of 2001. • The motion expressed in the above Resolution was, duly made and seconded, and approved by the following vote on the 20th day of October, 1998. This report summarizes the activities of the Weld County Council during the third quarter of the calendar year 1998. July 21, 1998 Council Meeting - Galeton Elementary School • Weld County Compliance Officer Sharyn Frazer explained the Weld County Planning and Zoning Department's community meetings and an education program that has drastically reduced the number of compliance violations. • The Council reviewed the facts it had gathered regarding setting the Coroner's salary. It was decided to gather more information regarding Weld County elected officials' benefits before setting salaries. August 18, 1998 Council Meeting - Milliken Town Hall • At the August 18, 1998 meeting the Council discussed and set salaries for the elected officials of Weld County. • The Council decided to seek more information before ruling on a possible conflict-of-interest letter received from Commissioner Connie Harbert. September 15, 1998 Council Meeting - Hudson Town Hall • Weld County citizens presented their opinions regarding the Weld County elected officials' salaries that had been set at the August Council meeting. The Council decided to continue the discussion about salaries at the October Council meeting. • Sharon Hopper presented her concerns about the truck traffic generated because of nine gravel pits in the Rinn area. • Janet Meisinger reported her petition to run for the Weld County Council had been improperly denied by the Weld County Clerk/Recorder. • Tim Erickson reported that he had to pay for documents provided by the office of the Weld County Clerk to the Board while an employee of the Greeley Tribune was not charged for the same documents. During the third quarter of 1998, Council members have researched answers to questions and concerns brought to their attention by citizens of Weld County. In that process Council members have talked periodically with the Commissioners and various Elected Officials and Department Heads. This report is not meant to be an exclusive enumeration of the activities entered into by the Council. It is, however, an attempt to communicate with the voters regarding its activities. The County Council believes that the Weld County Home Rule Charter continues to be a viable tool for the citizens of Weld County.
