RE: APPROVE CONTRACT AND ADDENDUM I TO CONTRACT WITH NATIONAL HOG
FARMS, INC., AND AUTHORIZE CHAIRMAN TO SIGN - BRIDGE #50-67A
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Contract and Addendum Ito Contract
for infrastructure improvements to Bridge #50-67A between the County of Weld, State of Colorado,
by and through the Board of County Commissioners of Weld County, and National Hog Farms, Inc.,
with terms and conditions being as stated in said contract and addendum, and
WHEREAS, after review, the Board deems it advisable to approve said contract and
addendum, copies of which are attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Contract and Addendum Ito Contract for infrastructure improvements
to Bridge #50-67A between the County of Weld, State of Colorado, by and through the Board of
County Commissioners of Weld County, and National Hog Farms, Inc., be, and hereby are,
approved.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said contract and addendum.
The above and foregoing Resolution was, on motion duly made and seconded, adopted by
the following vote on the 27th day of November, A.D., 1995.

THIS CONTRACT, made this' / day of October, 1995, by and between National Hog
Farms, Inc., hereinafter referred to as the Firm, and the County of Weld, State of Colorado,
hereinafter referred to as the County.
WHEREAS, County has received a Community Development Block Grant (CDBG) in the
amount of $371,500 for a project that consists of assisting with public infrastructure improvements
in support of National Hog Farms, Inc., (the Firm), a hog -growing operation. The Firm has
committed to retain its facility in Weld County, Colorado. The purpose of the project is to
encourage economic diversification and job creation which addresses the CDBG program objective
of benefit to low- and moderate -income persons in Weld County.
WHEREAS, The CDBG grant shall assist with the following infrastructure improvements:
Replacement of an existing substandard bridge, designated as Bridge #50-
67A, located on Weld County Road 50, east of the intersection with Weld
County Road 67. The proposed bridge will span approximately 360' across
the South Platte River. The bridge will be constructed of three 120' spans.
The project includes realignment and construction of approach roadway
sections. The total length of the project is 2,350 feet. The construction of
the roadway will provide for 24' wide, 3" thick hot layed bituminous concrete
pavement with 6' wide crushed aggregate shoulders. The asphalt will be
placed on a6" thickness of Class 6 aggregate base course on the
constructed fill and subgrade.
NOW, THEREFORE, IT IS HEREBY AGREED THAT:
A. The Firm commits to retain a minimum of one hundred sixty-four (164) existing, full-
time jobs. At least one hundred thirty-one (80%) of the existing full-time jobs
retained by the Firm shall be filled by low- to moderate -income persons.
B. The Firm shall make every effort to maintain a level of operation that will support
such levels of full employment, hereinafter determined to be at least one hundred
sixty-four (164) full-time positions.
C. The Firm shall allow County and CDBG program representatives to make on -site
visits to verify CDBG program information if reasonable notice has been provided
by County.
D. The Firm expressly acknowledges that such infrastructure improvements would not
have been undertaken but for the Firm's contractual commitment to perform all of
the Firm's obligations hereunder. The Firm commits to retain its operations located
in Weld County, Colorado, upon timely completion of regulatory and legal aspects
and infrastructure improvements required by the project.

ADDENDUM I TO

THIS ADDENDUM I TO CONTRACT, made this P7 day of Oeteber, 1995, by and
between National Hog Farms, Inc., hereinafter referred to as the Firm, and the County of Weld,
State of Colorado, hereinafter referred to as the County.
WHEREAS, Firm and County entered into a contract on October _, 1995, for the

The County shall agree to indemnify and hold Firm harmless for any financial
liabilities, payments, or liquidated damages required under the contract.
