RE: APPROVE FACILITIES USE AGREEMENT AND AUTHORIZE CHAIR TO SIGN -
COLORADO MOUNTAIN COLLEGE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Facilities Use Agreement between the
County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Health Department, and Colorado Mountain College, with terms
and conditions being as stated in said agreement, and
WHEREAS, after review, the Board deems it advisable to approve said agreement, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Facilities Use Agreement between the County of Weld, State
of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of
the Health Department, and Colorado Mountain College be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said agreement.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 11th day of March, A.D., 1998.

The requesting organization (and the undersigned officer or agent or representative thereof individually and jointly and severally with
the organization)or individual agrees (a)to pay for any loss or damages to person or property or claims therefore resulting to or arising
from the use of District property or claims therefore resulting to or arising from the use of District property or facilities by such
organization or individual (and those granted access to the facility thereby) whether from occurrence at the property or facility itself
during such use, before or after such use, going to and from such use in or about available parking or otherwise, and (b)to reimburse
or hold harmless the District, the Board of Trustees, and the members, agents and employees thereof from any such loss, damage or
claim, including, but not limited to, its or their attorney's fees.
The prevailing party shall be entitled to an award of its attorney's fees and costs incurred in any legal action to enforce the terms of this
agreement.
It is also understood and agreed that prior to use, the conditions, if any, set forth below upon approval of this application must be
complied with.
I the undersigned will be responsible for cleaning up the space used and returning chairs, tables or other items that may have been
used back to the rooms they were removed from or as designated by CMC. I understand that a custodial rate of$15.00 per hour will be
charged for work over and above the normal cleaning of the areas utilized. I understand alcohol Is prohibited and there Is no
smoking unless posted "smoking area."

RENTAL RATES FOR COLLEGE-OWNED FACILITIES
Effective 7/1/92
The following rates will be charged for the use of College-owned facilities. These include utilities and custodial services for hallways, restrooms and
associated space.Audiovisual equipment is available for rent at additional charges.
Custodial rate of$15.00 per hour will be charged for work over/above the normal cleaning of the areas utilized.Additional fees will be assessed at the
discretion of the site administrator,All revenues should be receipted to the auxiliary fund.
Type of Group:
Class 1 No chagee' College-related or sponsored activities. Public/private nonprofit educational or community groups residing within the College
Service area having a no charge reciprocal facility usage agreements with CMC.
Class 2. One-half of the regular rater.Ppbliic/Pnuate nonprofit or educational groups residing In the college district who!do not hold.a no charge reciprocal
usage agreement with CMC. Public nonprofit educational or community groups outside of the Collegeiservice area, other Slate-supported institutions of
higher learning. Private nonprofit groups or individuals which charge admission fees,and groups utilizing lodging and meal'services.
Class 3 Full rate. Profit-making groups or individuals.

Subject: Agreement for Use of Colorado Mountain C lege Facilities
Enclosed for Board review and approval is an agreement between the Weld County Health
Department and Colorado Mountain College for use of the college's facilities.
The Health Department is requesting use of a meeting room and an overhead projector at
the college for a Health Education Standards training titled "Developing Appropriate Health
Education Materials." This agreement defines the requirements for use of the facilities on
April 1, 1998. The cost for use of the facility and equipment is $35.50. The training is part of a
preventive block grant from the Colorado Department of Public Health and Environment, and the
grant will pay for this rental.
I recommend your approval of this agreement.
