RE: ACTION OF BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY, COLORADO,
CONCERNING SITE APPLICATION OF NORBERT H. KMOCH AND AUTHORIZE
CHAIRMAN TO SIGN
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has received a site application from Norbert H. Kmoch, P.O. Box
480145, Denver, Colorado 80248-0145, concerning the construction of a lift station located on the
following described parcel of land, to -wit:
Part of the SW% of Section 18, Township 3 North,
Range 66 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the regulations for site applications for the construction of a lift station require
review of the site application by the Board of County Commissioners, and further, that various local
and state agencies be given the opportunity to review and comment on said site application, and
WHEREAS, the site application from Norbert H. Kmoch was submitted to the Board of
County Commissioners of Weld County for review and comment, a copy of said application being
attached hereto and incorporated herein by reference, and
WHEREAS, after study and review, the Board finds that said site application is compatible
with the Weld County Comprehensive Plan, and that it is in the best interest of Weld County to
recommend approval of said application.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the site application submitted by Norbert H. Kmoch be, and hereby is,
recommended favorably to the Colorado Department of Health, Water Quality Control Division, as
being compatible with the Weld County Comprehensive Plan.
BE IT FURTHER RESOLVED by the Board that the Chairman be, and hereby is, authorized
to sign said site application.

THE DEPARTMENT OF PLANNING SERVICES' STAFF RECOMMENDS THAT THIS REQUEST BE
APPROVED FOR THE FOLLOWING REASONS:
1. Improvements to the treatment facility will not adversely affect the local
water quality. The design of the system will be of sufficient capacity to
serve the approved service area.
2. The Weld County Health Department and North Front Range Water Quality
Planning Association have reviewed this proposal and have no objections to
the lift station as proposed.
3. The request complies with the Weld County Comprehensive Plan. The request
proposes improvements to an existing sewage treatment facility which
services 34 lots in the Poirot Subdivision and a new City Hall complex
within the incorporated municipality of Platteville.

Platteville, Colorado, at 7:13 p.m. on Tuesday, July 18, 1995, at the Platteville Town Hall, 411
Goodrich Avenue, Platteville, Colorado, on the appQcation of Platteville Development Partners,
Ltd., for approval of the preliminary plat of the proposed Poirot Planned Unit Development
(PUD). At said hearing, Chairman Robert Sterkel presided and the following members of the
Planning and Zoning Commission were present:

Also present were Robert K. Thorson, Town Administrator; and Dale Boyd and Dasel hallmark
of Platteville Development Partners, Ltd., applicant.
Chairman Sterkel accepted into the record without objection Exhibit A, the completed '
application and supporting documents submitted by the applicant; Exhibit B, Affidavit of
Posting; Exhibit C, Affidavit of Mailing of Notice; Exhibit D, Published Notice of Public
Hearing; and Exhibit E, the Platteville Comprehensive Plan.
Testimony was presented on behalf of the applicant by Dasel E. Hallmark, P.E., in favor
of the application.
No testimony opposing the application was presented.
The Planning and Zoning Commission makes the following findings of fact:
I. The July 18, 1995, public hearing held with respect to said application was duly
convened and the Planning and Zoning Commission had jurisdiction to consider
the application.
2. The applicant seeks approval of a Preliminary Plat for the proposed Poirot PUD.

3. Notice of the Public Hearing was given pursuant to all of the requirements of
section 16-3-3 b. of the Platteville Municipal Code and section 31-23-215, C.R.S.
4. The proposed use is in general compliance with the Town's Comprehensive Plan.
5. The applicant has shown the reasonableness of his plan, the lack of adverse effect,
and compliance with all of the requirements of section 16-3-3 e. 10. of the
Platteville Municipal Code.
' 6. The Planning and Zoning Commission, after considering all relevant facts, finds
and determines that the Preliminary Plat for the proposed Poirot PUD is in general
compliance with Chapter 16 of the Platteville Municipal Code.
Based on the foregoing findings, the Planning:and Zoning Commission hereby approves
the Preliminary Plat of the proposed Poirot PUD with the following conditions and recommends
that the Board of Trustees of the Town of Platteville, Colorado, approve said Preliminary Plat
with the same conditions:

1. All requirements of the Colorado Department of Transportation regarding access from
Main Street must be met, and the Town provided copies of all required permits;
2. The design, location, and installation of the sanitary sewer lift station must be approved
by the Colorado Department of Public Health and Environment, the Town's consulting
engineer and the Platteville Public Works Department;
3. The "Development Criteria" which appears on several plats and plans must be changed
to meet the Town's zoning regulations;
4. All plats, plans and other documents to be filed with the Weld County Clerk and
Recorder shall clearly stipulate the type of fencing allowed along the storm drainage -way,
the maintenance requirements of said fence and the maintenance requirements of the
storm drainage -way itself; and
5. The applicant's request for exemption from the open space requirement and request to pay
cash in lieu of open space, must be approved by the Board of Trustees.
