Dear Ms. Kirkmeyer,
I have never been one to make much noise especially when I don't see
much reason to expect a sympathetic ear. However, there comes a time
when even the most patient need to vent some steam. My time has come.
It would seem that Bryant Gordon, who inherited property at 4172 WCR
11, applied for a recorded exemption and was denied by the planning
commission. He then appealed to the Board of Commissioners and has
received a conditional approval. Therein lies my complaint. The planning
commission denied his application because (1.) the exemption requested
would require access via a private road, a road which the county has no
interest especially an interest in it's maintenance,(2.) the area seems to be
gravitating to light industrial and commercial and (3.) there just isn't
adequate waters service for the properties already in the area. Add to that,
the fact that Mr. Gordon has been an absent land owner, his property looks
like a dump or a junk yard and in the summer it's a real fire threat for his
neighbors because he does not cut the weeds and the Sheet Grass along with
the dead trees and other junk and trash attracts Rats, and other vermin as
well as being a fire and safety hazard. The Private Road accessing three
properties has been maintained for the past twenty seven years by only two
of the home owners living on it. Now Mr. Gordon wants to add a new place
in place of the junk yard he inherited and put manufactured house's on the
existing and the newly created parcel. Neither of which I believe will be
"Owner Occupied". You see since he became a Weld County land owner
several years ago he has steadfastly maintained that he intended to put a
new modular home on the original piece which he wanted to "REN"f" out,
and I believe that is his intention for both of the parcels if he can get
approval from the Commissioners to go ahead with his scheme.
You may take this letter as confirmation that the Lewis's at 4192 WCR
11 are adamantly "OPPOSED" to any such use of the land and the access
road we have built and maintained. I am a firm believer that a property
owner should have the right to do with their own property whatever meets
the land use established by the appropriate agencies until those purposes
affect my rights and values. Mr. Gordon has on several occasions let us
know that he owns many rental properties in Missouri, and since he only
visits here when he is working on the Weld County Land Use and
Commissioners, I am sure his intent is to create additional maintenance
burdens on the existing owners that currently use the private access road in
question. He will do that by installing rental properties where in his absence
there won't be any maintenance help either financially, or physically.
Neither can we expect any pride of ownership for those properties, that is
already evidenced in the properties current condition.
COMPLAINT #2
As you know an absent owner leaves the property unattended. Please
accept this letter as an additional complaint regarding the property
belonging to Dave Mallory at 4212 ? WCR 1 1 . Since he was allowed to
divide and sell a small parcel years ago, his property, which is next to our
and also uses the private access road has became a junk yard and a place to
collect and si:ore trashed mobile homes, junk cars and trucks, wooden
pallets and other junk. Some of that "junk" creates a fire hazard, it attracts
vermin and in general is a eye sore to the community. My question is this,
how can he be permitted to operate a salvage yard, junk yard or other
storage facility on AG property? Does he have proper permits? And if not,
are there any other ordinance that can compel him to clean up the mess?

And if you decide to drive down road 11, please look at 4162 WCR,
belonging to Gwen Tracey, where the original mobil home is falling down
in the yard, and is also creating a definite fire hazard especially if the weeds
on Gordons ajoining property get touched off by lightning or even a
cigarette discarded by one of the oil service people using the road. And in
addition this place is a magnet for rats and skunks as well.

Finally I want to thank you for allowing the city of Dacona to annev the
Colorado National Speedway. Last year we learned that that had happened
only after calling your home to complain about the condition of Road 11 .
Wow, since taking over that maintenance, Dacona has I'm sure collected a
lot of tax revenue, all of which has probably been spent on lawyers planning
further annexations. Certainly none has been spent on Road 11 . I'm really
glad my kids are grown and don't have to ride a bus on that road. On many
occasions I need 4 wheel drive to get from road 10 to my drive way and out
again. Hopefully we won't need emergency service during one of those
times. It would be a real travesty if someone loses a home or even their life
because Dacona doesn't maintain that road. I know it's not really your
problem any more, once again Weld County has managed to forget about
the southwest part of the county, at least until tax collection time. One more
thing about Colorado National Speedway, it seems that they must now own
the exclusive rights to the frontage road, road 10, road 8 and the on and off
ramps at exit 232, because whenever they have a race or other need to use
those rights away, I have been turned away by Erie and Dacona police after
races and not allowed to use those roads to return to my home, and even on
Saturday May 8th at noon, Road 10 was blocked by Racers waiting to get
into the track. I thought I was going to get into a real altercation not only
with race car owners but with the track security person who believed I was a
bother wanting to use his road. Since when does a non-resident from Denver
and elsewhere get priority for those road usages? It certainly isn't an
emergency. But it has taken away my rights as a citizen and a tax payer of
Weld County to come and go from my home. And with that priveledge
comes the dust and the noise way until late hours and on weekends when I
expect to relax and enjoy living a quiet life in the country.
These are my concerns, they have been building up and now I'm mad.
But I don't expect you or the commissioners to even try to do anything. At
least you know-how I feel.

Subject: Lewis Letter
Kim, the letter sent to Commissioner Kirkmeyer from Darrell and Phyllis Lewis
complains about the following properties: 4172, 4212 & 4162 WCR 11.
I inspected the properties today, and have determined that noncommercial
junkyards exist on all. three (misc. debris, lots of junk & derelict vehicles) .
I will issue violations against all three 5-25-99. Let me know if you need
anything else.
