HomeMy WebLinkAbout960144.tiff RESOLUTION RE: GRANT ACCESSORY DWELLING PERMIT #68 - GURNSEY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board of County Commissioners of Weld County, Colorado, on the 7th day of February, 1996, considered the request of Virginia Gurnsey, 10510 Weld County Road 15, Longmont, Colorado 80504, to place a dwelling on a parcel of land to be used as an accessory dwelling, and WHEREAS, said accessory dwelling is to be occupied in an A (Agricultural) Zone District on a parcel of land being more particularly described as follows: Part of the NW% of Section 8, Township 2 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, the Board of County Commissioners, having heard the testimony of those present, finds that said request should be granted subject to the following conditions: 1. Within thirty days of approval by the Board of County Commissioners, the applicant shall apply for a building permit for the principal dwelling unit. 2. Prior to the occupancy of the principal dwelling unit, the home shall be connected to an approved septic system and a legal water supply. 3. The Environmental Protection Services Division of the Weld County Health Department was unable to locate a septic permit for the septic system serving the existing house. Any existing septic system(s) which is not currently permitted through the Weld County Health Department will require and ISDS Evaluation prior to the issuance of the required septic permit(s). In the event the system(s) is found to be inadequate, the system(s) must be brought into compliance with current ISDS regulations. 4. The applicant shall sign and return to the Board of County Commissioners a completed Certificate of Compliance for the temporary accessory dwelling unit. 5. The temporary accessory dwelling unit shall not be occupied until such time that the applicant has complied with Conditions 1, 2, 3, and 4 above. 6. Dear Commissioners: This request for a Zoning Permit for a Temporary Accessory Dwelling Unit to the Farm is submitted by Virginia Gurnsey. The parcel of land under consideration is approximately 6 1/2 acres in size, described as part of the SW4 of the NW4 of Section 8,T2N, R67W of the 6th P.M., Weld County, Colorado. The property lies within the urban growth boundary of Firestone, Frederick and Dacono. There is currently one residence on the property. The Weld County Zoning Ordinance allows for a stick-built home to be used as a temporary accessory dwelling unit if used as an accessory to the farm. On the other hand, a zoning permit for a mobile home allows only for a mobile home to be used as an accessory dwelling unit for a medical hardship. However,the Zoning Permit for a Mobile Home for a Medical Hardship does not allow for a stick-built home. Staff has concerns that while the applicant can substantiate a medical hardship,the Zoning Permit for a Temporary Accessory Dwelling Unit to the Farm for which the applicant has applied, is specific under the Weld County Zoning Ordinance as to its use and intent: -The mobile home or accessory dwelling unit will be occupied by persons customarily employed at or engaged in the operation of the use where the mobile home or accessory dwelling unit is located. -The mobile home or accessory dwelling unit is necessary for the effective and economic operation of the use and/or protection of the agricultural use. -The mobile home or accessory dwelling unit will not be used as an income source by the applicant for rental to persons not principally employed upon the lot. The Temporary Accessory Dwelling Unit will be serviced with water from a tap from the Central Weld 960144 ZPAD-68, p.2 County Water District. A septic system is proposed to provide both residences with sewage disposal. There are currently two accesses to the property. The Weld County Department of Public Works has no conflicting interest with the current accesses. The Weld County Health Department is requiring any existing septic systems which are not currently permitted serving the existing residence receive an 1.S.D.S. Evaluation. Neither the Mountain View Fire Protection District nor the Tri-Area Planning Commission had any conflicts with their interests. The applicant is asking that the zoning permit be granted for a person or persons to help her maintain the property. In addition,the applicant has submitted a letter by A. Alexander M. Jones, MD stating the house would be beneficial to the health of the applicant's mother. The applicant did not apply for a Zoning Permit for Temporary Accessory Use During a Medical Hardship because section 43.2.4.1.1 does not allow for anything other than a mobile home to be used in addition to the principal dwelling unit for a medical hardship. Therefore,the applicant applied for a Zoning Permit for a Temporary Accessory Dwelling Unit to the Farm to be used as a caretaker's residence. Staff requests that the Board consider this application and determine whether it complies with the standards for a Zoning Permit for Temporary Accessory Dwelling Unit to the Farm in accordance with Section 43.2.3 in the Weld County Zoning Ordinance.
